Convicted killer Gary Lee Sampson sentenced to death

After a jury deliberated for more than 16 hours, admitted serial killer Gary Lee Sampson was sentenced to death for the murder of Jonathan Rizzo.

In addition, Sampson received a life term for the murder of Philip McCloskey in the second death penalty case following his 2001 killing spree.

Prior to the verdict, a mysterious letter included with the verdict forms by one of the jurors added a new wrinkle to the case. Judge Leo T. Sorokin said the letter came to his attention through a question from the jury, who said a juror placed a letter in the packet after the jurors had all signed the verdict forms. It is unclear what the contents of the letter are, but Sampson defense attorney Michael Burt said the letter should be preserved for the record, including possible appeals.

Sorokin answered the question by reiterating instructions given to the jury prior to the start of deliberations and telling the jury they “speak through the verdict form.” He later ruled that the letter would be preserved.
 
Sampson, facing death sentence, wants to see juror's secret letter
Convicted spree killer Gary Lee Sampson is asking a judge to let him read a secret letter written by one member of the jury that sentenced him to death earlier this month.

In a motion filed in U.S. District, Sampson's attorneys said the letter, which was found inserted between the pages of the official verdict form as it was being signed, could have a variety of implications about the jury's deliberations, including the possibility that one of the jurors felt they were not being represented by the jury foreperson. Judge Leo Sorokin refused to show the letter to attorneys the day the verdict was delivered but agreed to keep it in a part of the record of the case that it not available to the public.
 
Sampson formally sentenced to death
For the second time, admitted serial killer Gary Lee Sampson was condemned on Friday to death, for a brutal killing spree in 2001 that has forever changed the families of his victims.

“You are condemned to death,” Sorokin told him. And with that, Sampson was escorted away in handcuffs.

The hearing, less than an hour long, was acrimonious at one point as Sampson started to swear at a prosecutor who called him evil and self-entitled. He then swore at the judge, who barked back at him to “shut up.” Sampson then settled down.
 
Gary Lee Sampson attorneys want his death sentence vacated following his death

Attorneys for convicted South Shore spree killer Gary Lee Sampson said that his death sentence should be vacated following his December demise in prison.

“Counsel agree with the government that Mr. Sampson’s death does not call his convictions into question,” the Friday filing by his attorneys in the U.S. Court of Appeals for the First Circuit states. “His death does, however, require that his death sentence be vacated.”

Sampson, 62, died in federal prison in Missouri on Dec. 21. Upon notice of his death, the court ordered a government response in which prosecutors argued that his actual death made moot his ongoing appeal of his sentence of death, but should have no effect on his convictions or sentences.
