John Mark Karr's DNA has already been tested by several labs according to a defense motion filed today in Boulder County Court.
Karr, suspected in the 1996 murder of 6-year-old JonBenet Ramsey, is due to appear in court this afternoon to be advised that he is under suspicion in her death.
In documents, Karr's lawyer, Seth Temin, asks the court to allow him access to information and materials used to take Karr's DNA and methods used to test it.
"The circumstances of this case present a unique and storied testing history," Temin wrote. "The reliability of the evidence in this case, the witnesses' qualifications in this case, the usefulness of testimony to the jury in this case, and the weight of the probative value of the evidence in this case versus unfair prejudice are all likely to become issues."
Temin specifically requested all serology and DNA tests that have been performed and continue to be done.
It appears that more than one laboratory handled or had custody of samples subjected to testing in this case and more than one expert has evaluated the samples and testing results," Temin wrote.
The motion also asks for a listing of precautions taken against contamination, instances of laboratory contaminations, and records of trouble-shooting or problems during testing.
Karr, 41, has made public statements that he was with JonBenet when she died, that he loved her and that her death was an accident.
