A 36th District judge Tuesday dismissed three of four charges against the father of an 11-year-old boy who allegedly killed a 3-year-old boy while playing with a gun.

Judge Ronald Giles said he had no information to show that the gun that killed 3-year-old Elijah Walker belonged to Curry Bryson. Because of that, he dismissed the charges of manslaughter, second-degree child abuse and felony firearm.

“I don’t know what kind of gun actually killed the child,” Giles said in court Tuesday. “I don’t know if it was a gun that was taken from somewhere else. Without that, I definitely cannot find manslaughter. I cannot find child abuse. I definitely cannot find felony firearm. That is enough for the court to dismiss these charges.” ...

Hunh??? So, then, where did the prosecutor get this information:

Wayne County Prosecutor Kym Worthy said the 11-year-old got a handgun from a bedroom closet while he was visiting his father's home on Eastwood Avenue on Monday and threw it out the window into the back yard.

He then got the gun and took it to a parked car that was in the back yard, Worthy said.

The father of an 11-year-old boy who allegedly killed a 3-year-old boy while playing with a gun last August was convicted Wednesday in the fatal shooting.

A jury in 36th District Court found Curry Bryson guilty of involuntary manslaughter and felony firearm. The jury acquitted him of child abuse second degree.

A Detroit man whose 11-year-old son allegedly shot and killed a 3-year-old while playing with a gun will spend up to 17 years behind bars in connection with the case.

Curry Bryson was sentenced Wednesday by Wayne Circuit Court Judge James Callahan to 2-15 years on involuntary manslaughter and 24 months for felony firearms charges for the 2015 death of Elijah Walker, his girlfriend&#8217;s son.
