GUILTY MI - Felony charges against Detroit mayor Kwame Kilpatrick

There didn't seem to be much interest here in this case, and I gave up on it a while ago because it was far too involved to keep up with all the details. There were originally four defendants (one pled guilty to some charges but hasn't been sentenced yet), multiple charges against each, and the trial lasted almost six months.

The jury has been deliberating since last Tuesday, but it could take a while to reach a verdict since there are three defendants, each with their own charges that must be considered. I will probably receive an email alert from local media when the verdicts are rendered, and I will post as soon as I have the information.

In the meantime, WDIV, Channel 4, Detroit has had exemplary ongoing coverage of the trial. There were daily media updates and a blog detailing court proceedings. All the reports can be found at this link:

Detroit corruption trial verdict

Kwame Kilpatrick, Bobby Ferguson guilty on most counts

Ex-mayor faces 20 years in prison; father convicted only on one tax charge

By Robert Snell
The Detroit News

Detroit — Jurors convicted former Mayor Kwame Kilpatrick and contractor Bobby Ferguson of federal racketeering and other charges, but only convicted Kilpatrick's father Bernard on one tax charge.

As the verdict was read, Kilpatrick hung his head at the defendants table.

The eight-woman, four-man jury, which included five blacks and a Hispanic, spent nearly two weeks of deliberation before convicting Kilpatrick of charges that dogged him for years and could send him to prison for two decades.

The jury reached a verdict on 40 of 45 total counts. Among the counts jurors could not decide on bribery charges for Kilpatrick...

Verdict in ex-Detroit mayor corruption trial

ED WHITE, AP

DETROIT — DETROIT (AP) — Jurors reached a verdict Monday in the federal corruption trial of ex-Detroit Mayor Kwame Kilpatrick after 14 days of deliberations.

Lawyers for Kilpatrick, his father Bernard and city contractor Bobby Ferguson were summoned to Detroit federal court. The verdict was to be read Monday morning, court spokesman Rod Hansen said in an email.

Kilpatrick is charged with turning the mayor's office into a cash machine by collecting kickbacks and bribes from people who wanted city business. He's also charged with looting a nonprofit fund that he created to help distressed Detroiters...

Well, isn't this good news. Thanks so much for keeping us all updated!

I hope that the 1:30 hearing to determine whether Kilpatrick and/or Ferguson will be taken into custody immediately is livestream or carried live by local media. I don't know about Ferguson, but I strongly believe that KK will flee unless he is incarcerated. He has repeatedly demonstrated that he does not think that laws apply to him and has violated the terms of his current probation several times. When Kwame asked to be allowed to go home to Texas last week, I think that he knew that a verdict was imminent and that he would most likely be convicted on some charges. I think that he would have made arrangements to flee from Texas and might not have even returned to Detroit for the verdict. Kilpatrick cannot be trusted and should be taken into Federal custody immediately. :moo:

11:51

11:52

Reporter Jim Kiertzner addressing the jurors now. What did you decide on first? One of his questions to the jury.
11:53

Juror 6--"We took each and every charge very seriously. We tried to evaluate every charge based on the evidence. Some were easier than others based on the evidence."
11:53

How important to you were the text messages? Question to jury.

11:58

How tempting was it to glance at a headline? Question from reporter.

12:00

Juror 7 indicates she is a social media geek and it was hard for her. She just had to give up social media.
12:03

Juror 12-- "We are a nice group of people, we respect each other."

12:07

Reporter asks if they were hoping to hear from the defendants...
12:10

Juror 7 answered in regards to the defendants' family presence.

"For me, his family life is not our business."

She said whether they showed up or didn't--that's between him and his family.
12:11

Juror 6-- "We talked about our job of being the voice of the community and taking that very seriously. These charges were not victimless crimes."
12:12

Juror 6 continues to speak about the responsibility of rendering a verdict on the charges and the effect it would have on the defendants.
12:14

Juror 11 speaks of her disappointment after she herself voted for the mayor twice. "Sitting on this trial, I saw a lot that turned my stomach--I couldn't believe this was going on."
12:15

Did anyone feel bad for them? Question asked to jury.
12:16

Juror 11-- "You feel really bad for the families. I don't feel bad for the defendants because I feel you go into things knowing what you're doing. I feel bad for the families, especially the children. "
12:16

Reporter asks jury to talk about sacrifices...
12:17

"I don't think you have time for that," joked one juror.
12:17

"All of us have sacrificed quite a bit." --Juror 8
12:20

What predicates did you use to decide RICO charges? Question asked to jury.
12:21

Juror 6 indicates they were provided with instructions with the elements for RICO and they went through that meticulously.
12:23

Reporter asks if anyone feels there should have been additional charges...
12:23

Juror 12-- "Sorry, but that's not our call."
12:25

Question for the alternates: Do you agree with this decision?
Juror 15 indicates that it wouldn't be fair to make that call since they weren't part of the deliberation process.
12:29

If any one of you could sit face to face with Kwame Kilpatrick, what would you tell him? Question to jury.

No one in the jury answered that question.
12:30

The judge says she felt confident the entire time that the jury would reach a verdict on a majority of the charges.

Detroit corruption trial

Kilpatrick judge deciding if he will go right to priso

Hearing right now will determine whether ex-mayor, Ferguson are released on bond or locked up immediately

By Robert Snell and Jim Lynch
The Detroit News

Detroit - Former Detroit Mayor Kwame Kilpatrick doesn't have a large stash of cash and can't afford to flee before being sentenced in the City Hall corruption case, his lawyer said.

Kilpatrick's lawyer is fighting a prosecution request to have Kilpatrick locked up immediately.

"His risk of flight is, I think, illusory," defense lawyer James C. Thomas said during a detention hearing today. "He doesn't have cash reserves with which to flee. Being convicted doesn't make it more or less of a reason to flee. He was facing those charges from the very beginning."

Kilpatrick will learn shortly whether he is headed directly to prison today after being found guilty on 24 counts in his corruption trial earlier Monday morning...

From The Detroit News: http://www.detroitnews.com/article/20130311/METRO01/303110403#ixzz2NG3gA4cN

ETA: Both Kilpatrick and Ferguson are going to be incarcerated immediately.
