Death Penalty Possible For Man Charged With Murdering 13-Year-Old Hania Aguilar
A North Carolina prosecutor says he will seek the death penalty against the man accused in the kidnapping, rape and murder of a teenager last year.

News sources report Robeson County District Attorney Matt Scott voiced his intentions at a hearing Thursday in the case of Michael McLellan, who is charged with first-degree murder and other offenses.

Scott said the crimes fit the criteria for the state to seek the death penalty, noting that the aggravating circumstances included McLellan's criminal record which consists of violent crimes and the "extremely atrocious, heinous and cruel" murder of 13-year-old Hania Aguilar.

Kidnapping, murder case of Hania Aguilar to be discussed in court this week

The case of 13-year-old Hania Aguilar who was authorities said was kidnapped and murdered will be discussed in court this week.

The man accused in the case, Michael McLellan was on the superior court docket for Monday, Oct. 7. WMBF News was told by court officials that administrative hearings will be held in the case this week, but McLellan is not expected to appear for those hearings.

Just administrative stuff, IMO.

Man accused of killing Lumberton teen appointed second attorney
Michael McLellan, 34, has been appointed a second attorney in the killing of 13-year-old Hania Aguilar last November in Lumberton.

McLellan was listed on the Robeson County Court docket for this week, but Robeson County District Attorney Matthew Scott said the case won’t be heard. Scott said McLellan’s attorneys have been given his case file to prepare for his defense.

A year later, legal wrangling continues in Hania Aguilar murder case
Wednesday marks one year since 13-year-old Hania Aguilar's body was found in Robeson County.

Despite multiple court dates for Michael Ray McLellan, there are few recent developments in his case.

According to court documents in March, defense attorney Butch Pope filed a motion demanding Robeson County DSS give him all the records regarding McLellan and his parents' background, mental health, abuse, everything in his DSS file.

A judge granted that request in April, just one month before McLellan was indicted by a grand jury.

In June, District Attorney Matthew Scott announced the state's intention to seek the death penalty.

Then in August, his new attorney filed a bombshell motion demanding his client's right to a speedy trial.

Sources speculate that if this case drags out, it could very well be an appealable issue for McLellan's defense.

One year ago: Michael McLellan charged in Hania Aguilar murder, kidnapping
A year has gone by since Michael McLellan was charged in the death of Hania Aguilar.

McLellan was arrested on 10 felony charges related to the death of Hania Aguilar on Dec. 8, 2018.

  • First-degree forcible rape
  • Statutory rape of a person under 15 years of age or younger
  • First-degree sexual offense
  • Statutory sex offense with a person 15 years or younger

McLellan made his first court appearance following the arrest on Dec. 10, where he was denied bond.

Her poor family -- Christmas time is so sad for families still going through mourning and missing someone they loved dearly and who brought beauty and innocent happiness into their lives. I'm sure their house seems too, too quiet and empty at times.
 
One year later, Hania Aguilar murder case proceeds slowly in Robeson County

Neither Hosford nor Pope nor Robeson County District Attorney Matt Scott responded to requests for interviews as to the status of the case.

The file shows the defense lawyers have requested discovery — copies of all documents and other records and information that outline the case against him. They are entitled to this information to help them prepare McLellan’s case.

Two sealed envelopes are in the file. There is no indication on the exterior of the envelopes of what they contain. They are to be opened only by a judge.

In August, Hosford filed a motion that demands McLellan’ right to a speedy trial as guaranteed under both the North Carolina Constitution and the United States Constitution.

It’s unclear what effect this can have. In 2003, the N.C. Supreme Court ruled 5-2 in a Robeson County case that the state did not violate the speedy-trial rights for a Robeson County murder defendant who waited in jail for four-and-half years for his day in court.

The majority said “the delay was caused by neutral factors,” including a heavy backlog of murder cases.

McLellan’ next court hearing is scheduled for Dec. 9, a year and a day since the thousands of people gathered in the gym at Lumberton High School for Hania’s funeral.

Thirteen-year-old Hania Aguilar certainly did not deserve the troubling fate that befell her roughly 13 months ago.

The Lumberton teenager went missing on the morning of Nov. 5, 2018, and would remain so for a stretch of 22 days before her naked body was found, face-down, in about 4 1/2 feet of water off Wire Grass Road in Robeson County.

Her case continued to make headlines in 2019.

I just hit the jackpot on Michael McLellan's court docket. There's something going on, and the events are slated for Superior Court, so this could indeed be something. I haven't had time to check the details yet, but here's what I saw.

Notice the Court Date of 12/07/2020 -- I bolded the first one. You can click on the blue Case Number to see the offense.

I am gonna do a bit more digging, but dinner calls, so if I find something of note, I'll let y'all know. I haven't seen anything new in MSM in many months about this case, so far.

Well, no details on the other Docket panels at this time.
No detail on McLellan's Courtroom Number 002A.
When there is, it would say "Trial" if it indeed were a trial. So far no details for that specific courtroom -- although the 7th is Monday. Dunno.

Maybe it'll get updated later??? In these Covid daze, who knoze?
