FREEHOLD Cutting-edge technology purports to link Paul Caneiro to four murders - that of his brother, sister-in-law and their two young children - yet the state has asked that a key witness be allowed to testify about the scientific reliability of that technology from 9,000 miles away.

Caneiro's attorney on Tuesday objected to the prospect of allowing the state's expert to testify virtually from his home in New Zealand, saying Caneiro has a constitutional right to confront the witness, face-to-face, in court.

Superior Court Judge Joseph W. Oxley will decide Thursday whether to allow that expert to testify virtually at an upcoming pretrial hearing that he said will have statewide implications for the future of a computer program designed to analyze small quantities and complicated mixtures of DNA evidence.

Christopher Decker, assistant Monmouth County prosecutor, told the judge Tuesday he wants John Buckleton, the creator of the STRmix computer software, to testify about the reliability of the technology at the upcoming pretrial hearing. But, Decker said, Buckleton is not comfortable taking a 16-hour or longer flight from New Zealand to New Jersey because of a medical condition he suffers from, for fear he could have an episode aboard the flight with no medical assistance available.

Judge nixes testimony from New Zealand in Caneiro Colts Neck murders case​

FREEHOLD As a judge prepares to schedule an important hearing on the reliability of a new method of evaluating DNA evidence used in the Colts Neck quadruple homicide case against Paul Caneiro, he ruled Thursday that the state's key expert on the technology will not be allowed to testify remotely from New Zealand.

Prosecutors asked that John Buckleton, a New Zealand scientist who created a computer program to analyze small quantities and complicated mixtures of DNA in the case against Caneiro, be allowed to testify via videoconference from his homeland because he is uncomfortable taking a 16-hour or longer flight to New Jersey due to a heart condition he suffers from.

Superior Court Judge Joseph W. Oxley ruled he will not allow the witness to testify remotely.

Oxley noted he has not received any of Buckleton's medical records or any certifications from his physicians about what affect the journey to New Jersey could have on his health.
Prosecutors said Buckleton would be their key witness to testify at an upcoming hearing about the reliability of the computer program he created, which was used to generate the DNA evidence against Caneiro, an Ocean township man accused in the 2018 murders of his brother, sister-in-law, niece and nephew.

Oxley said Buckleton had a co-author of the report he wrote in Caneiro's case, who could be called to testify in-person in Buckleton's place.

The judge noted that Caneiro has a constitutional right to confront the witnesses against him, which is of the utmost importance in the case of a quadruple homicide for which he could potentially face four, consecutive life prison terms.

Despite speedy trial provisions in New Jersey's Criminal Justice Reform Act, the defendant's trial has been held up by the COVID-19 pandemic, the need to make arrangements for him to review voluminous amounts of evidence against him and some lengthy legal wrangling over a cutting-edge method of evaluating DNA evidence collected in the investigation.

With much of that legal wrangling now in the past, the only thing that stands in the way of Caneiro's trial is a hearing on the admissibility of that DNA evidence. Oxley has scheduled the pretrial hearing for the weeks of Feb. 26 and March 4. DNA experts from as far away as New Zealand will be testifying at that hearing.

Oxley said he will need time after the hearing to render his decision on the admissibility of the DNA evidence, but once that is done, the trial can get underway.

Yeah - I can not access the court site. Just wait on articles. And I see in the article there was a hearing last week or so... oh well... I put him on 2/26/24. :)

Oh wow, this case hasn't gone to court yet! I followed it closely at the time, because it was so horrific and unbelievably heinous and cruel - words can't even describe it, that somebody could do that to their brother and his family.

I hope the brothers parents were not alive to witness this horrific crime. I can't imagine their devastation.

I hope justice is served SOON. 5 years is way too long.

6/5/23 Update: Superior Court Judge Joseph W. Oxley, who is presiding over the case, in July ordered the company that owns the proprietary technology to turn over its source code to Caneiro's defense expert to facilitate the evaluation. But, almost a year later, that expert still has not submitted a report on his evaluation to defense attorney W. Michael Wicke of the Public Defender's Office. Appearing in court on Monday, 6/5/23 Wicke told Oxley he still has not been informed of the date by which the expert plans to give him the report. The judge ordered that the defense expert either turn over the report to Wicke by June 26 or provide a certain date when that will be done. Otherwise, Oxley said the expert will have to appear in court in-person before him that day to explain why he can't. Once the report is submitted, Oxley said he still has to schedule the hearing to determine the reliability of the scientific evidence and its admissibility at trial. That hearing is likely to take up to five days, he said.

FREEHOLD - Paul J. Caneiro's trial in the Colts Neck mansion murders of his brother's family was scheduled to begin in June, but because of delays in a crucial, pretrial hearing, the start of the trial is expected to be pushed back into the summer.

Caneiro, 57, of Ocean Township, has been in jail five years, four months and seven days awaiting trial in the November 2018 murders of his brother, sister-in-law, and the couple's two young children, Superior Court Judge Joseph W. Oxley said at a conference in the case on Tuesday.

Despite that, Deputy Assistant Public Defender Michael Wicke told the judge at the conference that Caneiro's June 3 trial date is not a realistic one.

The only thing standing in the way of a trial is a pretrial hearing on the admissibility of DNA evidence that was analyzed using cutting edge technology that has not yet been declared scientifically reliable in a New Jersey court.

A hearing on the scientific reliability of the technology was scheduled to take place during the weeks of Feb. 26 and March 4, but the hearing has not yet happened because the defense sought to expand the proceeding to consider additional DNA samples beyond those that were originally analyzed with the new technology.
