Arizona escapees, companion charged with murder in New Mexico

ALBUQUERQUE, N.M. (AP) -- Federal prosecutors in New Mexico have filed murder and carjacking charges against two escaped convicts from Arizona and a woman who accompanied them while they were at large.

A federal magistrate on Monday signed arrest warrants for 45-year-old John McCluskey, 42-year-old Tracy Province and their alleged accomplice, 44-year-old Casslyn Welch.

"An arrest warrant says the three were tired of traveling and sleeping in a car they stole in Flagstaff, Ariz., and decided "it would be a good idea to target someone driving a camper or trailer." Prosecutors say McCluskey shot and killed the couple inside their travel trailer. The three fugitives drove the truck and trailer to a remote area of New Mexico's Guadalupe County, where they unhitched, burned and abandoned the trailer, authorities said."

Oh boy, these guys are a real piece of work...they were tired of traveling and sleeping in a car so they decided to target someone driving a camper or trailer. Then they burn the trailer and they abandon the truck 60 miles away in Albuquerque presumably on the same day. So they kill 2 innocent people (and probably their little dog Bear) and they still have to sleep in their car. :waitasec:

OMG, the actual arrest warrants for all three are at:

http://www.kob.com/article/stories/S1708749.shtml?cat=500

If you decide to read them, just a warning, they are very graphic. I am just sick...:furious:

From the arrest warrant, Province mentions 3 dogs at some point.
As much as they were driving around, could "Bear" have gotten away even before the final stop for the trailer where it was burned? Either that, or poor Bear could have run into the trailer when it was on fire trying to get to his owners and burned to death.
It sounds like the other two dogs belonged to the daughter but poor Bear belonged to Gary and Linda?
He might have been more attached to them than the other two dogs?
It's really awful.

Witness says he felt safe around Arizona fugitives

ST JOHNS, AZ - Handcuffed face down on the ground, Hugh Murray quickly realized who he had been hanging out with for two days at a remote campsite as he overheard law enforcement officials say that a man detained near him was the last of the three.

His mind raced back to a week earlier, when he scanned a newspaper article about three men who escaped from a prison in northwest Arizona and the woman who helped them flee.

"I clicked on that," Murray, 67, told The Associated Press in an exclusive interview Monday. "It was unbelievable until then, but then it made sense."

Update:

http://www.krqe.com/dpp/news/crime/judge-tosses-escapee-murder-confession

>>>But McCluskey's confession after his arrest cannot be used now that the judge ruled FBI agents violated his rights by continuing to interrogate McCluskey after he asked for a lawyer. Prosecutors do have other evidence, though, including DNA and fingerprints. Escapee Tracey Province and Casslyn Welch, who aided the jailbreak from the outside, were on the run with McCluskey. Both have pleaded guilty and agreed to testify against him.<<

This was the horrific murder of the nice retired rv couple (Gary and Linda Haas from Oklahoma) killed by the 3 escaped Arizona fugitives near Santa Rosa, NM. As a refresher, the escapees got Linda at gunpoint when she went to walk her dogs at a rest stop. They made Gary drive to a remote area and shot to death Gary and Linda and stole their truck and trailer. When the escapees went to get gas, the thugs noticed Gary and Linda's blood flowing from the trailer door, so the escapees burned the trailer. Two of Gary and Linda's little dogs were found; they never found the third dog Bear.

The other two escapees took a plea deal. Today was the start of the trial against John McCluskey and I hope he rots.

"Three years ago Monday, police arrested Arizona inmate escapee and double-murderer suspect John McCluskey.

Prosecutors say McCluskey was the mastermind behind a carjacking and crime spree after a trio’s escape from an Arizona prison. They said he never intended to let Gary and Linda Haas go. They were killed in August 2010."

Trial expected to last 3 months.

ALBUQUERQUE (KRQE) - Opening statements have begun in the federal murder trial of John McCluskey, the man accused of murdering an Oklahoma couple in New Mexico after he and two others escaped from an Arizona prison.

Federal prosecutors have already started calling witnesses in the trial.

McCluskey is the last remaining defendant to face trial in the deaths of Gary and Linda Haas.

On Monday, prosecutors painted the murders as part of a crime spree that began with McCluskey's escape from prison.

A federal judge sentenced Tracy Province, 46, and Casslyn Welch, 47, for participating in a plot to carjack and murder a retired couple from Oklahoma in Aug. 2010.

U.S. District Judge Judith C. Herrera of the District of New Mexico sentenced Province to five consecutive terms of life imprisonment without the possibility of release as required by his plea agreement. Judge Herrera imposed a 40-year prison sentence on Welch, but delayed imposing a final judgment for two weeks to allow attorneys to submit briefs on a related issue...

The mastermind of the crime, John McCluskey, is scheduled to be sentenced Tuesday, however it’s a formality. When jurors failed to unanimously vote for the death penalty, McCluskey automatically got a life sentence without the possibility of parole.
