NV - Duran Bailey, 44, murdered, mutilated, Las Vegas, 8 July 2001

Her conviction was upheld by the Supreme Court. But now defense attorneys are arguing there is new evidence to show she is innocent and another woman may have committed the killing.

Lobato maintains she was sexually attacked by a man and she used a butterfly knife to stab him but denies she sliced off his sexual parts. She says the attacker was alive and crying when she escaped from him. Her lawyers maintain her DNA was not found at the crime. The blood at the killing did not match hers and her fingerprints were never discovered.

The Clark County District Attorney’s Office says this evidence was available at the time of trial and should have been introduced then. And its legal brief says there was sufficient evidence to convict Lobato, who at the time lived in Panaca, about 165 miles from Las Vegas. The prosecution maintains she had driven to Las Vegas to buy methamphetamine.

I can't find that they've made any ruling yet.
 
the premise that she drove a 165 miles to buy meth off of bailey is ridiculous in its own right. bailey, while a drug user, was neither a dealer nor did he even use meth.
also, because blaise believed because of meth induced paranoia that she was being poisoned, during this time period she was being tested daily. never once during that period did she test positive for meth, despite prosecution claims she was 'on a 3 day meth binge' at the time.

bailey raped a woman a week before the murder. the police knew about it. neither bailey or the woman or the womans roomate nor the womans mexican friends had any connection to blaise.
police have never even attempted to prove thru witnesses that blaise even KNEW bailey, let alone where he lived (behind a dumpster in an alley)
the rape victim, her roomate and the mexican friends knew where he lived.

while CSI technicians were processing the crime scene, detective thowsen (the lead detective) told them to stop. when the coroner found a bunch of phone numbers in bailey's pockets, all thowsen did was call them, ask them 'if they knew bailey' and when they said 'no' didnt investigate any further knew from the rape victim and her roomate that their 'friends' were illeagal immigrants, he claims he didnt want to 'get them in trouble'. settled on blaise as the murderer from the outset......i firmly believe the killer or killers are police informants they dont want to give up, even at the expense of an innocent woman rotting in prison for the last 15 years.

her defense teams
1st trial: two public defenders, one who had never had a murder case before and who didnt have the brains to disclose to the prosecution witnessess in time. mostly cause he was still hoping blaise would go for a 'self defense' defense. this resulted in a key defense forensic experts testimony being limited to talking about how fingerprints are left (which is not really relevent at all to this case)
2nd trial: a much better public defender and two high priced big ego lawyers from california. strangely the 2 lawyers being paid sit back and let the PD do most of the work (admittedly he did a pretty good job on his own) then throw him under the bus when she is convicted again.
innocence project: how is it they have been on this case for years and nothing has been accomplished yet? :(

This is the first post I'm making outside the WM3 thread, probably because of the way LE seem intent on not clearing this case up. The last post was from 2015 so I thought I would point out new developments. A decision was promised by mid-November, I can't find anything up to now. Anyone heard anything new ?
 
New trial granted for woman convicted of killing man, cutting off penis

A Las Vegas woman convicted in 2006 of killing a homeless man and cutting off his penis will have her case tried anew.

The 34-year-old woman, incarcerated at Florence McClure Women’s Correctional Center since early 2007, filed a petition in May 2010 to challenge the legality of her detention, alleging 79 grounds for relief. The Supreme Court ordered an evidentiary hearing late last year on 25 of the claims.

The order called for a hearing on her counsel’s decision not to hire an expert witness to pinpoint the time of death. Time of death is important because there is uncontested evidence that Lobato was in Panaca at midday and early evening on July 8, 2001.

If true, Lobato’s allegations suggest a reasonable probability that had counsel presented expert evidence narrowing the time of death, the jury would have had a reasonable doubt about her guilt, the Supreme Court order said.
