GUILTY NY - Aasiya Zubair Hassan, 37, found decapitated, Orchard Park, 12 Feb 2009

Mr. Schwartz is now questioning whether or not he can go forward, under these circumstances. His comments came after Mr. Hassan pleaded with the Judge saying, "You are playing with my life." "It's my life. I am taking the risk."

Prosecutor Colleen Curtin Gable is now talking, asking the court not to grant Hassan's request, calling into question the timing of this.

Hassan now says he has respect for Mr. Schwartz, and doesn't blame him for his lack of time. Hassan says he has the time, in jail, with "room service meals", to pour over 5000 pages of notes. He claims he's been ready since September to go forward with this case.

On a side, Mr. Hassan stands with his hands grasped behind his back, talking more heated now than I've seen him. Again he says "It's my life. No one else's life gets hurt, only mine" The judge fired back, "That's debatable."

The Judge asked him to stay, actively participate in defense...but Mr. Hassan has now asked to leave the courtroom. He's being cuffed. -Lorey Schultz
 
OK, that was interesting. Hassan escorted from the courtroom, placed in a room where he can hear what is going on, if he wants, but the court will not be able to hear him.
 
good thing Mr. Hassan has no access to his sword or his attorney may well be the next head to roll. Afterall, according to the much put upon and misunderstood Mr. Hassan this attorney is not doing a good job of selling his laughable defense.
 
Defense attorney has asked to be let go, but he will still advise his client if the court allows him to represent himself. This is just one big clusterf***, imo. He has fired attorneys and know is trying to upend this trial. How many times will he be allowed to do this? They need to just go ahead with the trial, even if he represents himself, and let the appeal issues be addressed later. He can't continually be allowed to delay justice.
That's just me talking, by the way.

Jeremy Schwartz is now talking to the judge, saying that, after a lengthy discussion with his client on Friday, it's his opinion that, "the differences are too great" for him to go forward as his attorney. He is asking the judge to let Mr. Hassan go forward and represent himself. He'll standby as an assistant. He doesn't feel he can represent his best interests.
 
JUdge has agreed to let him represent himself. I am just glad that his children have already testified. Hopefully, he won't be allowed to recall them and interrogate them himself, that would be too awful for them, imo.
 
His opening statement to the jury is denied. He says he will call any witnesses that are in the building.
 
classic abuser remorse and when she wasn't responsive this time as she had been in the past to his apologies, he beheaded her.

Chilling to read his final texts begging for a return to the status quo, knowing that moments later, he would resort to such a brutal act.
 
He's still trying to force psychiatrist Dr. Ana Natasha Cervantes to testify FOR him (to justify his claims of being abused by Aasiya) even though she is unwilling to do so and is fighting his subpoena, which was not signed by a court clerk. Today he asked the judge to COMPEL her to testify, if not about his case in particular, then about spousal abuse in general. After all, he paid her for a 10-hour exam. I guess he wants his money's worth. Two other psychiatrists have stated that they are unwilling to testify on his behalf. Hassan blames it on bad publicity. It probably has nothing to do with the likelihood that he tried to tell them exactly what to say, including providing them with questions and the answers he expects.

I say go ahead and make Dr. Cervantes come in (well, not really, for HER sake, but it WOULD make things more interesting). I'm sure she'd have some choice things to say about her observations of him. He doesn't seem to realize that she cannot say he was abused, only that he TOLD her that he was abused. If he wants her to come to some conclusions about him, I suspect that he's in for a surprise.

Hassan also had an acquaintance from graduate school (in 1994) testify to the fact that he's a nice guy. She had been to dinner at their house on several occasions over the years and everything seemed normal to her. The judge had warned Hassan that by having her testify as to his good character, the prosecution could now bring in witnesses to testify as as to his BAD character. Hassan, ever the know-it-all narcissist, ignored the warning. Sweet. Hopefully the prosecution will bring on some witnesses to tell about some not-so-normal incidents.

This case just has me INCENSED! Thank goodness there is NO WAY he'll walk on this. I cannot imagine the jury would believe him about being abused, and it would not justify his actions, in any case. I seriously doubt that that his case is going to have any effect on the sentencing, either, other than to underscore how dangerous he is. If he were to get out, you just KNOW the first thing he'd do is woo (or just mail-order) another woman, marry her and keep her under his thumb (not to mention his a$$ when he frequently sits on her. Then he'd claim spousal abuse again if the wife attempts to fight him off while he's sitting on her).

He seems to have a filter on his brain so that anything a woman does to defy him in ANY way, or to defend herself against his violence is a personal, grievous and unprovoked attack on HIM.

People like him make me want to VOMIT.
