5/7/24 Tuesday, Trial Day 9: *State witnesses: Sally Franklin. Franklin works as a senior vice president at the publishing company Penguin Random House, where she has been an employee for 26 years. She is expected to allow prosecutors to enter into evidence copies of some of Trump's previous books. Stephanie Clifford, who goes by the name Stormy Daniels. Will continue on stand for cross exam on Thursday.
*Trump's lawyer Todd Blanche said the defense team moves for a mistrial based on the testimony from Daniels this morning. He said that her testimony has nothing to do with the case & argued that the only reason prosecutors asked about the encounter aside from embarrassing Trump was to inflame the jury. Judge Merchan has denied the motion for a mistrial that was brought by Trump's defense team. “As a threshold matter, Mr. Blanche, I agree that there were things that would have been better left unsaid," the judge said. “I think the witness was a little difficult to control.” “I don’t believe we’re at the point where a mistrial is warranted," he added. “I’m also surprised that there were not more objections."

It’s Day 14 of Trump’s NY election interference trial. The Cross-Examination of Stormy Daniels by defense attorney, Susan Necheles, will resume at 9:30 am when the jury returns. When we recessed Tuesday, Necheles was in the midst of questioning Daniels about the 2011 incident in the parking lot in Las Vegas when Daniels (who was with her infant daughter) was threatened to “leave Trump alone.”

NEW: Judge Merchan is no longer allowing photography in the courtroom for the rest of the trial. It appears someone in the pool violated the court order by taking a photo of Trump from the aisle, while walking into the well

Well that is a plus IMO. Yet I also wish that the daily defendant ‘pleadings’ in the halls of the courthouse were not allowed. Why are those cameras allowed in the hallways? Seems the outside of court and court house steps are available for the former president defendant to make ‘statements’, that would not violate the gag order. MOO

I'm guessing that cameras are allowed in the halls of the courthouse, or they would have moved them outside by now. I look forward to hearing directly from President Trump after his day in court, whether he is discussing the day's court proceedings on the so-called "hush money" case, or other issues related to what is going on across the country at this time.

I think the cameras are allowed because it is a public building and Trump has freedom of speech. He can say whatever he wants but all the jury is listening to is the trial and it isn't going very well for Trump.

We won't see any more photos from inside court - for now

Every morning of this trial, before proceedings begin, photographers have briefly been allowed to go inside the courtroom and take some pictures of Trump and his legal team preparing for the day.

But we won't see any more photos like this for a while, because on Tuesday afternoon, one of the photojournalists broke "an established rule" in court photography.

In a statement from the court spokesman, Al Baker said:

"A still photojournalist who was being led with colleagues into courtroom 1530 on Tuesday morning to take the daily photograph broke an established rule in photographing from outside the well.

"Judge Merchan was consulted and has determined that for now no photography from the courtroom will be permitted.”

Trial is at the halfway point

Before the break, we also found out that this trial is "on schedule" and maybe even going faster than Justice Juan Merchan thought it would.

Donald Trump's hush-money trial was predicted to last 6-8 weeks.

We're currently into the third week of testimony, after jury selection took up the first week of the trial.

So we are about halfway through.

Trump's lawyers say they will file for a mistrial again
Kayla Epstein
Reporting from court

Just before lunch, Donald Trump's lawyer Todd Blanche told Justice Merchan he would be filing again for a mistrial.

We'll take this matter and others up later this afternoon, the judge replied.
Trump, for once, seems like he might be in a good mood.

After he stood up, he turned to face the press - or perhaps his entourage sitting behind him - and offered a closed-mouth smile and a pump of his fist.

He walked out of the courtroom, and it seemed to me he was better spirits than he had been during his previous exits.

Trump smiles at response from new witness

Madeline Halpert
Reporting from court

Donald Trump appears to briefly smile, one of the few times today, after prosecutors ask Rebecca Manochio why Trump left New York in 2017.

He left to be “the President of the United States”, Manochio says, prompting the grin from Trump.

Todd Blanche is asking Judge Merchan to let Donald Trump respond to Stormy Daniels and her testimony in court. "She's no longer a witness," he argues.

The judge says no, he won't modify the gag order, citing how witnesses who have not testified will see how witnesses who have testified have been treated afterward. "Your client's track record speaks for itself."

Trump attacks judge in hush money trial after leaving court

From CNN's Elise Hammond

Former President Donald Trump attacked the judge presiding over his hush money trial in New York after court adjourned on Thursday.

In the hallway, he called Judge Juan Merchan “totally corrupt” and “conflicted.”

“Take a look at his conflict, it’s a disgrace to the city of New York, to the state of New York and to the country,” Trump said.

It comes after Stormy Daniels finished her testimony. She was on the stand for more than 6 hours over two days, describing her first meeting with Trump and their sexual encounter in 2006.

Remember: The former president is not allowed to talk about Daniels because of a gag order that has been imposed. However, it does not prevent Trump from attacking Merchan or Manhattan District Attorney Alvin Bragg.

Either he doesn't know the meaning of conflicted, or he just wants to get that word "conflict" repeatedly out to the J6 attack type people.
