WAVERLY, Ohio (WXIX) - George Wagner IV will serve life in prison, without the possibility of parole, for the eight aggravated murder charges he was convicted of for the 2016 Pike County massacre.

The eight life sentences will run consecutively.

Judge Randy Deering also sentenced him to 121 years in prison for other charges.

Gov. Mike DeWine said Monday’s sentence is another step towards getting justice for the victims and their families.

It was not clear if Pike County Common Pleas Court Judge Randy Deering was going to give Wagner IV, 31, the chance of parole. In the end, Judge Deering ruled that Wagner IV would not be eligible for parole.

The death penalty was taken off the table after Wagner IV’s brother and mother testified against him for the state.

FOX19 NOW Legal Analyst Mike Allen, Hamilton County’s former prosecutor, is doubtful George Wagner will get a new trial: “There doesn’t appear to be any significant errors that Judge Deering made so he will deny the motion for a new trial.”

In graphic detail, Jake Wagner calmly described how his older brother helped him and their father, Billy Wagner, shoot and kill the eight victims.

Jake Wagner said he personally shot and killed five of the eight victims: Dana Rhoden, 37, and her three children Hanna May Rhoden, 19, Chris Rhoden Jr. 16, and Frankie Rhoden, 20, as well as Frankie’s fiance, Hanna “Hazel” Gilley, also 20 and shot and wounded a sixth, Christopher Rhoden, Sr., 40.

He said his brother was supposed to shoot Rhoden family patriarch Christopher Rhoden Sr., but froze so Jake Wagner took his brother’s SKS rifle and pulled the trigger.

The other victims are her uncles, Kenneth Rhoden, 44 and Gary Rhoden, 38.
 
Tony Rhoden's wrongful death suit in the #PikeCountyMassacre case must be resolved in 2024, the visiting judge in the case said this morning. Judge Scott W. Nusbaum said he will retire in full by then so wants the Rhoden case against the Wagner family wrapped up by then. 1/12

"I'm an old guy. We're going on a fast schedule," Nusbaum told lawyers in the case. 2/12

Nusbaum directed Rhoden attorney Brian Duncan to complete discovery in the case within six months, after Duncan requested nine to 12 months. The judge told attorneys for two Wagners they had seven months to seek or supplement motions to remove their clients from the suit. 3/12


Family matriarch Fredericka Wagner filed for removal last week. Her grandson, George Wagner IV, will follow suit, his attorney indicated today. Wagner IV was convicted last year for his role in the Rhoden shooting deaths. 4/12

Outside the courthouse, Duncan said he'll next depose and seek evidence against Fredericka Wagner. "Documents and evidence will tell us whether we have tangible claims against her," he said. "We will be dismissing the action against her if we can't prove it." 5/12

Wagner attorney Jim Owen, in court and after the hearing, continued to assert his client had no involvement in committing or covering up the Rhoden killings. "There's no credible evidence from anyone that she was involved in any way, shape or form," Owen said. 6/12


Owen said Wagner would cooperate if deposed. "Fredericka's in her 80s. We need to get closure in this case." Among other Wagners, Owen said he believes his client's other grandson and daughter-in-law -- Jake and Angela Wagner -- would also cooperate if deposed. 7/12

Wagner IV would not cooperate, attorney Richard Nash Jr. indicated today. George "Billy" Wagner III would also not likely cooperate as he prepares for a criminal trial in early 2024 in the case, Owen said. 8/12

Duncan said the Rhodens were unified in their decision to file a wrongful death suit that seeks actual and punitive damages and a jury trial. 9/12

But he acknowledged that members of the Wagner family, outside of Fredericka, have "very limited" ability to pay any award. "We're only going to proceed and go forward if we believe we can obtain a judgment but also collect," he said. 10/12

Pike Co. massacre hearing today in case against George "Billy" Wagner - oral arguments set on defense request to move venue out of county because of publicity surrounding trial of son George last fall.

Just brought Billy Wagner in - so about to get started. Again, visiting judge R. Alan Corbin is presiding since current Pike Co. judge is Rob Junk, the former prosecutor who helped convict George Wagner IV

Judge Corbin says probably not issuing decision from bench - wants to issue a written decision that should come very timely.

Now have a trial date of May 6 as well per the judge and defense lawyer Marc Collins.

Tentatively scheduled for 8 weeks - the trial for Wagner's son George IV took nearly 12.

Kaitlyn Stephens handling argument for defense: Says this is the rare limited case that meets U.S. Supreme Court exception to move before voire dire is tried. Says presumed prejudice can be found

Stephens: Needs to look not just at quantity of pretrial publicity but quality. Says everything out so far blatantly prejudicial - talking about prosecutors saying "we've got one more to go" and calling Billy Wagner "an evil monster”

Now moving on to size of community argument - only 17,000 registered voters in Pike Co. Says Columbus Crew stadium is bigger than that.

Only 300 responded to summons for jury duty v. 1000 sent out for the Wagner trial. Stephens motions to the media in the courtroom and refers to the media room packed downstairs.

Closes by saying US Supreme Court case is much more recent (2010) v. what the prosecution cites from 1972

Now special prosecutor Angela Canepa points out that US court case was the Enron case, and presumed prejudice was not found.

Canepa: Many of the comments defense referred to were made 6 years ago ... and crimes occurred seven years ago. Also says Billy's defense lawyers routinely talk to the press.

Only tapped about 1 percent of registered voters in last trial per Canepa. Also points out neither Jake or Angela Wagner's testimony was televised or streamed live.

Canepa: the court can take mitigating steps to handle the concern ... also pointed out voire dire took 12 days v. just a few hours or days for George IV.

Court stops for a second for nationwide alert. Then Canepa points out that court able to seat a jury in previous trial.

Canepa: Lots of pretrial publicity does not necessarily mean prejudice by potential jurors.

Canepa not opposed to renew motion after jury selection starts if there are problems ... but standard has not been met yet.

Stephens rebuttal: Passage of time is not a factor like Canepa says it should be. And size of county for Pike is much different than Enron case in US Supreme Court precedent.

Also states even without TV coverage, Jake and Angela testimony still reported out from courtroom. Also, there has now been a trial and comparing to this situation.

Marc Collins defends his statements to the media in previous hearings as procedural and not fact based.

Judge Corbin says he heard a few more issues in court - and will issue a written statement soon. And we're done.

A trial for the final defendant in the 2016 #PikeCountyMassacre case will be May 6, 2024. The venue for the case against #BillyWagner is not yet known, as a court today heard arguments for and against moving the trial out of Pike County. 1/9

The judge in the case, R. Alan Corbin, said he'd issue a written decision on Wagner's change of venue request "in timely fashion." Corbin said: "I will give this No. 1 priority." 2/9

Corbin announced the trial date from the bench in the Pike County Common Pleas Courthouse in Waverly, Ohio, after meeting with attorneys for both sides in chambers. Corbin said he'd hold eight weeks for the trial, noting that might be longer than needed. 3/9

Wagner's trial should be moved because of "presumed prejudice," defense attorney Kaitlyn Stephens said at the hearing. Pretrial publicity and continued media attention to Wagner's case make seating undecided jurors -- from the county's small jury pool -- difficult, she said. 4/9

Prosecuting attorney Angela Canepa said the passage of time will dampen potential jurors' memory of news coverage. Co-defendant George Wagner IV, son to Billy, was found guilty in November 2022, and Billy's wife and younger son entered guilty pleas in 2021. 5/9

Canepa also said she believes she can seat an unbiased jury in Pike County, despite having summoned 1,000 local citizens and putting 330 through the jury selection process in the Wagner IV trial. "We only went through 1% of the registered voters," she said. 6/9

Six Rhoden supporters appeared in the courtroom for today's hearing. Among them were Geneva Rhoden, Tony Rhoden and Wilma McCoy -- mother, brother and sister to victims Chris and Kenneth Rhoden. 7/9

Other victims in the 2016 shooting rampage were a cousin to the brothers, Gary Rhoden; Chris Rhoden's wife, Dana Manley Rhoden, and their three children, Frankie, Hanna and Chris Jr.; and Frankie's future wife, Hannah Hazel Gilley. 8/9

WAVERLY, Ohio (WXIX) - The judge assigned to the final Wagner family member’s case in the 2016 Pike County massacre has not made a decision regarding a change of venue for the 2024 trial.

Wednesday’s hearing consisted of oral arguments from both the prosecution and the defense as to why they believe George “Billy” Wagner’s trial should stay in Pike County or move somewhere else.

It is one of the most expensive, such that if the citizens of this county had to [pay] the bill for these trials and these trials alone, this county would potentially go bankrupt, your Honor,” the defense argued. “This case is happening in a county that has already heard and already decided [Mr. Wagner’s] case.” [...]

Brown County Common Pleas Court Judge R. Alan Corbin says he is going to review the court cases cited, along with the oral arguments, before rendering his decision.

Judge R. Alan Corbin also set a new trial date of May 6, 2024.

Currently, Billy still faces the death penalty. His wife, Angela and son, Jake have both entered plea bargains with the prosecution that would lift those specifications in exchange for their testimony in trial; the same deal was struck for George's trial.

Wagner's lawyer Collins states his co-counsel recovering from knee surgery and another co-counsel just had a baby. Collins also has a death penalty case. Wanted to get to court in advance. Can't be ready for May 6 - especially going through 12K pages of transcriptions @local12


Creates problems with prosecution witnesses as well.


Special prosecutor Canepa - says victims' family dealing with this and wanting justice since 2016. Formally objects to continuance.


Asks if continuance is granted, another one not be given - and also accomodations given to prosecution witnesses.


Judge Corbin - says good reasons for continuance. Relunctantly grants request for continuance of May 6 trial date. Discussed possible dates in chambers - earliest date get everyone in court Jan 6 2025.

Visiting Judge R. Alan Corbin delayed the trial at the request of Wagner's attorneys, who said they would not be ready by May. Two of his lawyers have medical issues -- a knee replacement for one, pregnancy for another. 3/5


Additionally, Wagner's team is stilling working their way through 15K-16K pages of the transcript from the fall 2022 trial of George Wagner IV, Billy's son. The younger Wagner was found guilty on all 22 charges against him in the April 2016 crimes. 4/5
