I believe that FW got about 900k in life insurance and the 260 Peterson Rd property sold for 200K from the research I did back then. Either way its a very good article.

We only know of that life insurance because it had to go through probate, there may be more that did not have to go through probate.

Good article by Patty Newberry. She's now quite the expert on this tragic case and the parties involved. I hope Tony and the others are successful in getting as much as they need. There's no price tag on the loss of parents and loved ones, its invaluable.

PIKE COUNTY — The matriarch for the Wagner family, whose members have been convicted or are facing charges in the 2016 Pike County murders, has filed a new claim trying to have her name removed from a separate wrongful death lawsuit.

Is anyone else planning on attending? I know most are too far from the area but I am going... probably a huge waste of time but oh well, we'll see. I look for Owen's to get FW's thrown out when it's all said and done. JMO

Defense lawyer James Owen says go ahead and depose Angela and Jake Wagner to determine whether Fredericka had anything to do with it. "She's in her 80s and we want to bring closure to this." Wagner is Billy Wagner's mother, and grandmother to Jake and George IV.

Judge says he's retired visiting judge - and calling it quits completely at end of 2024. Wants to know difference between making discovery impossible and "darn hard" for plaintiffs.

Judge asks for motion from plaintiffs in 30 days to ask to stay summary judgement motion already filed by defense. Not saying he would grant it. Says he believes discovery process "needs to begin and it needs to begin now."

Getting underway. Retired Ross Co judge Scott Nusbaum presiding as current Pike Co. Judge Rob Junk recused himself as he's former prosecutor who tried the Wagner case.

Original complaint filed in 2020 - this is the first hearing in more than 2 years ... especially given the length of the criminal trial of George Wagner IV

Plaintiffs include at least two Jane/John Doe minors ... presumably the two kids at the heart of the dispute between the Rhodens and Wagners - including daughter of Jake Wagner and victim Hanna Rhoden.

Plaintiff lawyer Brian Duncan says discovery all but impossible given how locked up the criminal prosecution and documentation is right now.

Judge points out civil cases should be underway within two years with at least deposition, but we're 3.5 years into it without anything. Fredericka Wagner's lawyer also expected to argue she be dropped as no criminal charges against her.

"hard to defend a case when you don't know what evidence the plaintiffs might have" - defense argues needs more time to get the records from BCI ... lower standards in civil case than criminal court.

Defense waited to depose Fredericka and Rita Newcomb until they had all information so know what questions to ask.

George IV's lawyer Richard Nash points out it's hard to say when end of last trial is - given appeals are underway and will continue.

Nash also raises issues about security in courtroom given the large number of defendants.

Judge says case began nearly 3 years ago - gives defense another month after that to supplement their motions for summary judgement.

Tony Rhoden's wrongful death suit in the #PikeCountyMassacre case must be resolved in 2024, the visiting judge in the case said this morning. Judge Scott W. Nusbaum said he will retire in full by then so wants the Rhoden case against the Wagner family wrapped up by then. 1/12

"I'm an old guy. We're going on a fast schedule," Nusbaum told lawyers in the case. 2/12

Nusbaum directed Rhoden attorney Brian Duncan to complete discovery in the case within six months, after Duncan requested nine to 12 months. The judge told attorneys for two Wagners they had seven months to seek or supplement motions to remove their clients from the suit. 3/12


Family matriarch Fredericka Wagner filed for removal last week. Her grandson, George Wagner IV, will follow suit, his attorney indicated today. Wagner IV was convicted last year for his role in the Rhoden shooting deaths. 4/12

Outside the courthouse, Duncan said he'll next depose and seek evidence against Fredericka Wagner. "Documents and evidence will tell us whether we have tangible claims against her," he said. "We will be dismissing the action against her if we can't prove it." 5/12

Wagner attorney Jim Owen, in court and after the hearing, continued to assert his client had no involvement in committing or covering up the Rhoden killings. "There's no credible evidence from anyone that she was involved in any way, shape or form," Owen said. 6/12


Owen said Wagner would cooperate if deposed. "Fredericka's in her 80s. We need to get closure in this case." Among other Wagners, Owen said he believes his client's other grandson and daughter-in-law -- Jake and Angela Wagner -- would also cooperate if deposed. 7/12

Wagner IV would not cooperate, attorney Richard Nash Jr. indicated today. George "Billy" Wagner III would also not likely cooperate as he prepares for a criminal trial in early 2024 in the case, Owen said. 8/12

Duncan said the Rhodens were unified in their decision to file a wrongful death suit that seeks actual and punitive damages and a jury trial. 9/12

But he acknowledged that members of the Wagner family, outside of Fredericka, have "very limited" ability to pay any award. "We're only going to proceed and go forward if we believe we can obtain a judgment but also collect," he said. 10/12

Fredericka Wagner owns property and land in Pike County worth at least $5 million, per my earlier
@enquirer coverage. 11/12

Alrighty' then.... happy and "somewhat" surprised to see Scott Nusbaum on the bench. He is a good Judge and very fair in his decision making MOO.

He has his stern, commanding side, and then he has his ornery side which almost got his butt in hot water a few years back. LOL. Long story, :D:eek:

OUCH !!! I would think the "evidence" would have been sought before FW was named as a party to this case. o_O:oops:
