But during Wednesday's pretrial proceedings there was no agreement reached on either side. "Jury trials have no guarantees on outcomes," says Braun, "We are ready to take this to trial on October 22nd." Meyers is facing the death penaltyy for the April 2015 murder of single mother Heather Bogle. Social media accounts reportedly linking the two who worked together at the Whirlpool facility in Clyde.

It was the morning of April 9th in 2015 that Heather's family reported her missing. One day later Bogles badly beaten body was found found in the trunk of a car with two gunshots to the back. Bogle's sister Jennifer says she's not stopping until they achieve justice for her sister.

"FREMONT - The trial scheduled to begin Monday for Daniel Myers, charged in the murder of Heather Bogle, has been postponed and a gag order has been issued by Sandusky County Common Pleas Court Judge John Dewey.

While no explanation was given for the delay, Sandusky County Sheriff Chief Deputy Ed Hastings said Myers had been taken to ProMedica Memorial Hospital Monday for treatment after becoming ill.

"He was woozy and incoherent and was transported to the hospital, but he was released and is back in the jail," Hastings said on Wednesday.

Hastings said he was not told whether Myers was ill or had attempted to harm himself at the Sandusky County Jail....
A scheduled hearing with 157 prospective jurors was canceled Wednesday as Myers' attorneys, Merle Dech and Jane Roman, filed a sealed motion Tuesday....

Braun said the next hearing in the case will be scheduled in six weeks...."

"FREMONT — Daniel Myers’ capital murder trial in the 2015 death of Heather Bogle was delayed indefinitely Wednesday morning by Sandusky County Common Pleas Court Judge John Dewey.

Dewey’s ruling means the trial, delayed twice already, won’t start next week as previously scheduled.

The judge gave no explanation for the latest delay. He also issued a secret gag order on prosecutors and defense attorneys, and sealed records explaining why he took that action....

Judge Dewey’s rulings on Wednesday will keep the public in the dark as the trial goes forward, if it goes forward. David Marburger, a Cleveland lawyer and expert in First Amendment law said he was astonished when he learned the court has issued a secret order and has concealed the grounds for that order.

“We do not know what the gag order prohibits. That is extraordinary,” Marburger said. “The order sealing it prevents the public from even knowing what the gag order says. It prohibits the public from knowing the grounds for sealing the record.”...

Sandusky County Prosecutor Tim Braun said, per the gag order, he couldn’t comment on why the trial was delayed or the order issued. Braun did say another court hearing is tentatively scheduled for late November....

Dewey’s decision to block public access to trial proceedings led to speculation about what might be transpiring. Prior to a court hearing Oct. 3, prosecutors thought Myers was ready to accept a plea deal that would have taken the death penalty off the table. That hearing was delayed for more than an hour while defense attorneys met with Myers in a holding cell outside the courtroom, and later met with Braun and Dewey in the judge’s chambers twice before it became clear there would be no plea deal.

"FREMONT - With a delay in Daniel Myers' capital murder trial, and the pending holidays, it is unlikely the trial will begin before the end of the year, according to Sandusky County Common Pleas Court Administrator Brock Kimmet.

Myers had been scheduled to stand trial starting Oct. 22 in the 2015 homicide of Heather Bogle, but the proceedings were delayed the week before, putting another snag in the process as Kimmet said he will now have to assemble a new pool of potential jurors....

One change will be to stop media members covering the hearing from live-streaming or video recording the court proceedings, which could result in the names of potential jurors being released.

Kimmet said many media outlets covering the Oct. 3 hearing were either live-streaming the hearing as it happened, or recorded it for playback on websites.

Because names of potential jurors being released could taint a jury or lead to a mistrial, Kimmet said decisions will be made by attorneys and Dewey about how the media will be able to report on future jury hearings. "

Judge cancels gag order in Bogle homicide case

"FREMONT — A gag order prohibiting participants in the Daniel Myers capital murder trial from all public comment about the proceedings has been lifted.

Judge John Dewey rescinded the order Wednesday, and acknowledged the court didn’t hold a hearing to show evidence of how publicity would hinder Myers’ “right to a fair trial,” as claimed in the gag order.

“It is in the interest of both the state of Ohio and and the defendant to have these proceedings conducted both openly to a free press, with consideration of the constitutional protections afforded (to) all defendants,” Dewey wrote in the judgement entry rescinding the gag order....

Myers’ trial has yet to be rescheduled."

"FREMONT - Despite the judge's decision to lift his gag order on the Daniel Myers' murder trial, Sandusky County officials on Tuesday refused to release a public record of an incident at the Sandusky County Jail that delayed the trial of Heather Bogle's homicide suspect...

No trial date has been set and it is not expected to commence until 2019.

Sandusky County Sheriff Chris Hilton told The News-Messenger on Tuesday that all reports have been given to Sandusky County Prosecutor Tim Braun for review and potential release.

Braun told The News-Messenger that he will not release the jail incident report, citing the document's protection under public records law.

"It's part of an ongoing case, and we are dealing with medical and behavioral issues that could come up as a factor in hearings," Braun said. "The law is pretty clear."

David Yonke, editor of The News-Messenger and News Herald, said the courts have routinely ruled that police incident reports are public record. "We respect the court's right to ensure a fair trial but we believe the jail report has nothing to do with the ongoing murder investigation."

In another legal move to obtain the public records in the case, The News-Messenger has filed a motion in the Ohio Court of Claims against the Sandusky County Sheriff's Office seeking the release of the jail incident report...."

Bogle homicide suspect Daniel Myers was on suicide watch in jail, records show

"FREMONT - A week before he was to stand trial on charges he murdered Heather Bogle, Daniel Myers was alleged by other jail inmates to be "giving up" and was "depressed" because his sister would not let him talk to his son, according to records obtained by The News-Messenger.

Attorneys on behalf of The News-Messenger met with Assistant Sandusky County Prosecutor Mark Mulligan in mediation on records that the Fremont news outlet believed to be public records.

News-Messenger attorney Jack Greiner said three out of four requests were accepted by the prosecutor's office, including the release of three incident reports, eight witness statements and surveillance footage from the jail on Oct. 15, the morning Myers was found face down in his cell....

The jail incident put a stop to Myers' trial, which had been scheduled to start Oct. 22....

Following the October trial delay, a two- to three-week trial is expected to begin March 4.

If convicted, Myers could face the death penalty."
