Auchincloss didn't cooperate with sex-offender treatment, therapist says

"A therapist has testified the half brother of Jacqueline Kennedy Onassis was evading questions about his use of child *advertiser censored* and not cooperating during an evaluation for court-ordered sex offender treatment in southern Oregon, where he lives. A judge in Medford is deciding whether to terminate probation and send 63-year-old James Auchincloss to prison for up to a year and a half. He was convicted last year of two counts of encouraging child sexual abuse...."

Being that I've done a lot of research lately into foreign made "boylover" naturist films which skate on the edge of legality, I'd be willing to bet that many of the photos and videos that Auchincloss was allowed to keep (even though they were provocative), were of that ilk. Talk about yucky. The way the treatment works is that you must write frequent sexual contact and masturbatory practice disclosures. They must be turned in on time and must be extensively detailed. They are intended to inform the polygrapher as to what questions would be most appropriate. If you fool around and fail to do this and disclose something just prior to the polygraph, that's considered a parole violation. That's what happened here. You can agree to go straight to prison or you have the right to ask for a hearing. Auchincloss has requested a hearing. We'll see how that goes.

I know a certain young Ashland man who failed to comply and ended up spending the next 10 years locked up. The rules are quite simple but strict.
 
Am I close to this situation? Yes I am. A bit hyper-focused? Yes, that too. But it's just downright creepy to know that this man lives so close to my sons and grandsons and still has the right to photograph children!! The more I learn about the reality of "little boy erotica" (those three words should NEVER be linked), the sicker I get.

Bottom line is that Jamie doesn't truly believe what he did was wrong. I wonder where all his supporters are now? I'm confused by just what was shrink-wrapped and put in storage. Those must be the images/videos that LE determined to be provocative but not pornographic. Just like any other trader/collector, he's obsessed with collection--plain and simple. If he's reading here, I hope he realizes that his PO and this judge will not fool around. I have first hand experience with these men. They've been mighty patient so far but when they say "prison-time", there's no going back.
 
Wow I never knew that, and I thought he lived in Rhode Island, or he used to?
 
Auchincloss has lived in the hills above downtown Ashland since 1995, as far as I know. He might have other homes but he's well known in our town and used to be very active on boards and in theatre related endeavors. When the child *advertiser censored* was reported by an assistant and made the news, he resigned his positions. Now, I think he's simply hanging out at home. At least, he better be.

It's interesting that I haven't heard a word about the other two men who were involved--Vickoren and Clay--concerning any problems with compliance with their court ordered treatment and probation. Just Auchincloss.
 
Now that's a new one for me. Auchincloss suffers from "confabulation", thus should be allowed personalized therapy and apparently avoid some of the discomfort of group therapy. I'll be interested to see what the judge says:

"...[Dr. Robert] Stanulis testified by telephone that he felt Auchincloss suffered from a brain injury or brain dysfunction that may be related to a history of dementia in his family. As a result he exhibited a condition known as confabulation, where he adds details to his memories in a way that is logical, but not factual, and without recognizing he is doing something wrong. "Group therapy is not appropriate for him," Stanulis said. "Rather than a willful refusal to cooperate, this is a failure to be able to cooperate."

Stanulis said when he examined Auchincloss, he appeared nervous, sweated profusely, and had a hard time answering yes-or-no questions, but was happy to relate memories of his half-sister. "He described himself as a trust-fund baby with an avocation for following political trends," Stanulis said. Under cross examination, Stanulis refused to agree with Deputy District Attorney David Hoppe's characterization of Auchincloss as a narcissistic personality who felt he was entitled to special treatment..."

Does this mean that he gets off task when others are describing their sexual abuse of children? Personally, I feel that there's a number of "bad signs". What does shooting oneself in the foot have to do with a collection of child *advertiser censored*, for heaven's sake?
 
I'm very unclear as to what the "*advertiser censored* collection" sent to storage actually includes. I believe that anyone in SO treatment is not allowed any *advertiser censored*. Possibly, the *advertiser censored* that Auchincloss bundled up is strictly adult *advertiser censored*. Could be. That would still be a red flag as I'm quite sure that SOs are not supposed to be viewing any *advertiser censored* as it objectifies the person in the image. But I have to wonder where all the returned photos are of local little boys. Are those still in his home?

Being that I have a special needs adult son who is a RSO and who has absconded from treatment twice and the same PO, I fully understand about the difficulty which some people present when confronted with the realities of treatment. My son thinks very "uniquely" and has a low IQ. He often admits to things he didn't do. He's very confused sexually, often cross dressing. But there were no alternatives permitted for him, even though he's a rape victim himself. It's essentially a one-size fits all program. Kind of like prison, where I'm sure my son will soon find himself again. He and Auchincloss have crossed paths more than once in the system.

ETA: Concerning a neuro issue for Mr. Auchincloss, it needs to be remembered that the man successfully and recently served on a number of boards in our town. He's a bright man and I don't recall a single person stating that he suffered from "confabulation".
 
I'm not happy. I'm pleased that the judge didn't buy the dementia/confabulation defense but how in the world can the man NOT be considered a danger to the community when there is NO possible way that LE has interviewed all the local children photographed in the last 15 or so years--the photos presumably stored away for future "use"??? So, concurrent sentences, credit for time served (including home detention), and jail rather than prison. With the good behavior clause, he'll probably only serve about 2/3 of the remaining time which comes to about 6 weeks, if that. Hmmmph.

Auchincloss headed back to jail

"Jackson County Circuit Court Judge Tim Gerking sentenced James Auchincloss to eight months in jail for each of two felony counts of encouraging child sexual abuse...."

"...The two eight-month sentences will run concurrently and Gerking gave Auchincloss credit for five and a half months already served, including his original 30-day sentence and time in jail and on home detention for failing to comply with his probation conditions. Gerking said Auchincloss' failure to meet such requirements didn't seem to match up with symptoms of brain injury or illness, which defense experts said might be the reasons. Gerking concluded, however, that Auchincloss didn't pose a danger to the community as there was no evidence of additional victims. Therefore, the judge sentenced Auchincloss to less than the 18 months in prison he could have faced....."

How many times does a man have to be "unclear on the concept" of community based treatment before he gets sent away? Jamie seems to be refusing to participate appropriately. He still doesn't believe the rules apply to one of his station. They do....

The man still doesn't see his actions as the crimes they truly are.

Auchincloss back in jail

"Ashland resident James Auchincloss is back in Jackson County Jail over alleged probation violations related to his felony child sex abuse convictions. Auchincloss, 64, pleaded guilty in August 2010 to the two felony counts for having images on his computer of naked boys...."

But he added Auchincloss had violated his supervision conditions and "so we took some action...."
