Owner of the Infamous Purple Truck - Dr. Roy Heilbron

I say excellent detective work. It very well Could be!

Dr. Smiley's new photo is much more serious, and frankly the "serious look" is less creepy. (Sorry if that sounds snide, but it is my gut reaction.) He looks much better in his multi-flagged ski cap.

His comments are more up lifting and not hocking snake oil cures. Perhaps his current debacle has changed his outlook. I actually enjoyed a lot of his links to positive stories. Even the references and links to a doctor who was diagnosing
patients with prostate cancer, even after his license was suspended.... self reflection or deja vu??? In any case, I felt he was more in touch with the realities of every day life.

From 3rd Feb:

ALBUQUERQUE, N.M. (AP) — A Santa Fe cardiologist accused of trying to impede his sentencing for health care fraud with a fake cancer diagnosis is pleading guilty to obstructing justice.

Federal prosecutors said Friday that Roy G. Heilbron agreed to the plea in an Albuquerque court. They say he could face as much as 30 years in prison.

[...]

He will remain in federal custody pending sentencing hearings, which have not been scheduled.

http://krqe.com/2018/02/03/doctor-who-faked-cancer-to-avoid-sentencing-enters-plea/

The 54-year-old used phony medical documents indicating he needed prostate cancer treatment in Costa Rica to support a request to defer his August 2017 sentencing.

He was indicted last September on false statement and obstruction of justice charges.

Heilbron has already pleaded guilty to a health care fraud charge in exchange for a two-year prison sentence.

During today’s proceedings, Heilbron entered a guilty plea to the obstruction of justice charge of the indictment. According to the plea agreement, Heilbron acknowledged that he previously pled guilty to a health care fraud charge on Feb. 17, 2017, and had a sentencing hearing on Aug. 28, 2017. In entering his guilty plea, Heilbron admitted that on Aug. 4, 2017, he sent his Probation Officer an email requesting to postpone his sentencing hearing based on the representation that he was scheduled to begin chemotherapy treatments in Costa Rica on Aug. 14, 2017. In support of his request, Heilbron attached a clinical summary and treatment protocol purportedly authored by Heilbron’s physician. Heilbron further admitted that the email was false and created for the purpose of delaying or avoiding the sentencing hearing on his health care fraud plea, and at the time he made the request for the postponement, he was on vacation in Europe with no intention of beginning chemotherapy treatments in Costa Rica beginning on Aug. 14, 2017.

I am surprised he was allowed to leave th US to begin with. Surprised he returned to the US after he was in Europe....why did he not stay away? Was Costa Rica a haven for criminals?
I was surprised he was allowed to leave the US too.

I'm not sure how long it takes for sentencing in Federal cases, but 4 months seems quite a while.

And he's been free since September 2017 (I may need to check that).

I'm starting to think Dr Roy has done a runner.

I'm certain someone on here has a 'pacer' account (I can't remember who, sorry), if they read this I'd really appreciate if they could have a check for updates at a time of their own convenience.

Hey guys, long time. This new thread is interesting, as I was unaware of a guy with a purple truck, but I stopped paying attention to this case several months ago, just awaiting the arrest.

But a couple of things in this thread that I would like to comment on:

1) Regarding HIPAA rules - the use of computers documenting any and all things that transpire at a doctor's office, is not cool, IMHO. I had a runin with this last year. My primary doctor had just the prior month given me an Rx and I then went to my yearly Retina doctor for exam, and the nurse is going over with me all the Rx I still take, and mentions the one I had just gotten a month earlier. I said to her, "How do you know about that? I never told you about it. I have not been here in a year!" She says it is in the system that is used by doctors, etc. (BBM)

As soon as I got home I called Blue Cross/Blue Shield to complain and threaten legal action. I told BC/BS "Any medical person with a clearance, totally unrelated to me, even out of state, a low-level nurse's aid, can gain access to mine or anybody's medical records because it is now in a medical system!?!? How can this be allowed? I never gave permission to my primary doctor to share anything with anybody, and yet my information is in an accessible, nationwide computer medical system!"

This is a severe problem that is being ignored and not being addressed, with all the talk about advancements in care. The only benefit from this new system is that if I get in a car accident and am unconscious, taken to a trauma center's ER, they will be able to know my medical history and not have to wait in making decisions on how to treat me.

Personally, I would rather run the risk, and not have my information in the system.
......SNIPPED......

Relative to your understandable, upsetting experience when you found that your Retina doctor had Rx info just recently prescribed to you by your Primary Care doctor (without your prior knowledge and/or authorization), I thought it important to share that this exchange was not HIPPA but part of respective STATE LAW LEGISLATION that provides for a "STATEWIDE PRESCRIPTION DATABASE."

Such State legislation allows for the "tracking" (and sharing) of patient use of ALL prescription drugs, and was passed under the guise of preventing patients from the practice known as "pill shopping" (i.e., soliciting multiple Rx from doctors unknown to each other).

I too was oblivious to such legislation enacted in my home State, and only learned about it when I was denied menial, employer paid life insurance (citing the Rx database for denial). Today, this legislation exits in nearly all States except for a couple where its been filed but not yet enacted. (In protest, I was quick to point out how an illegal drug user and/or addict not purchasing drugs from a legal "Pharmacy" could easily receive policy approval over me)....

So, does anyone have any idea why Dr. Roy came himself in the purple pickup truck to pick up the electronics? If he only wanted/needed the information contained on the hard drives ETC wouldn't they have saved that to a flash drive or something? BBM Or was he using the equipment to set up his new practice in Aventura? It's beginning to seem to me that Dr Roy, MS and whoever is involved in this convoluted scheme were and are targeting an extremely vulnerable portion of our population, including the elderly, by appealing to patients who are looking to improve their energy, health and longevity. Reading about one member's identity theft pains me and concerns me that more of this could go on in the future.
I also believe that we will learn of more fraud, drug use/selling, and other nefarious things before justice is handed down. This case is really what scary dreams are made of and although I know some of you have expressed disbelief that TS could be manipulated this way, believe me when I say it could happen to anyone. She was obviously a very bright, well educated and caring woman who loved her family, patients and pets. She was a victim of a perfect storm of greed and manipulation. How deep that storm grew to be remains to be seen. Thank heaven her girls are safe now.

Recognizing this is old post so please ignore if answered. My experience is that most medical practices use proprietary, patient record software programs probably downloaded on stand alone if not server. Typically needs the nontransferable software license on machine to access discernible data. (Today's Cloud program access not as prevalent in 2015)..

Santa Fe Cardiologist Sentenced to 51 Months in Federal Prison for Health Care Fraud and Obstruction of Justice Convictions

Santa Fe Cardiologist Sentenced to 51 Months in Federal Prison for Health Care Fraud and Obstruction of Justice Convictions
Roy G. Heilbron Also Ordered to Pay $623,477.25 in Restitution

[...]
Heilbron, 54, a cardiologist residing in Santa Fe, N.M., was sentenced to 24 months for his conviction on a health care fraud charge, and 27 months for his conviction on an obstruction of justice charge arising out of his attempt to obstruct and impede sentencing proceedings on the health care fraud case. Heilbron was ordered to serve the two sentences consecutively for an aggregate of 51 months of imprisonment. Heilbron will be on supervised release for three years after completing his prison sentence. Heilbron also was ordered to pay $623,477.25 in restitution to the victims of his health care fraud crimes.
[...]

There are a few more docket entries since I last reviewed the case, but nothing to indicate a reduced sentence. Perhaps there is a calculation for 'time served' while he was incarcerated pending the plea and sentencing? Or, perhaps BOP website Release Date 04/29/2020 is an error? I haven't done the math, but 2021 sounds more accurate.
