Zandstra arrives in Delaware County, is arraigned and gets court date

Story by Alex Rose, Daily Times

Sep. 28— "An 83-year-old retired Marple Township minister was returned to Delaware County Thursday afternoon to answer to charges in the 1975 murder of 8-year-old Gretchen Harrington in 1975.

David Zandstra, of Marietta, Georgia, is charged with criminal homicide, murder in the first-, second- and third-degree, kidnapping and possessing an instrument of crime for Gretchen's abduction and beating death on Aug. 16, 1975."

Zandstra was charged following his confession and was taken into custody without bail in Cobb County, Georgia. He eventually waived extradition on Sept. 14.

Defense attorney Mark Much said in a statement Wednesday that his client is presumed innocent. He noted Zandstra has no prior criminal history and challenged whether his confession was truly "knowing, intelligent and voluntary."

"False confessions occur more than most people think, and result from a variety of factors, including the use of coercive and deceptive police tactics of a frail 83-year-old, among other factors," Much said. "This case will be contested and decided in our courts, not in our newspapers or press conferences. I am looking forward to challenging the commonwealth's evidence, or expose the lack thereof."

Zandstra was preliminarily arraigned via video later Thursday at the State Police Media station and remanded to the county jail in Concord without bail.

He is scheduled for a preliminary hearing Oct. 11 before Magisterial District Judge Walter A. Strohl.

Suspect charged in Gretchen Harrington’s 1975 murder in Delaware County
The 83-year-old arrived back in Delaware County Thursday afternoon charged with first, second and third degree murder, criminal homicide, kidnapping of a minor, and possession of an instrument of crime.

Yeah, right.

MOO
How the heck he gave it and they knew it and have evidence right enough to find him basically guilty

Has anyone seen his confession? Because if not, we need to take what LE says with a grain of salt, especially because the court documents in Richrd's post #127 from about appears to show he has yet to be advised of his right to counsel:

Same as with Richard Allen's alleged confession to his wife and mother in the Delphi Murders. We should be careful to accept LE's assertions of a confession. IMO

Yeah, right.

MOO

Well, the guy is 83 years old. Could he possibly have dementia? That would be a problem with a confession given while he was not represented by counsel.

I am not saying the guy is not guilty, he may well be, but the guy is elderly and the crime is from what? 50 years ago? Best to tread carefully. IMO.

Zandstra confessed to the killing Gretchen and burying her body in a nearby state park during an interview with Pennsylvania State Police detectives. They had elicited that confession, they later said, by confronting him with new evidence that he had molested another girl not long before Gretchen went missing, according to the affidavit of probable cause filed for his arrest.

Most of the original detectives who handled her disappearance have since retired or died. But the catalyst for Zandstra’s arrest came in 2021, when two Marple Township residents, Mike Mathis and Joanna Sullivan, contacted current Police Chief Brandon Graeff and asked for the original case files for a book they were writing about Gretchen’s disappearance, investigators said.

After the book published in 2022, a woman approached the authors and said she had new information. The woman, who has not been identified by police, provided police with her childhood diary, in which she detailed Zandstra molesting her during two sleepovers at his home just days before Gretchen vanished, the affidavit said.

She also wrote that shortly after Gretchen’s abduction, another girl she was friends with was nearly kidnapped. In the diary, the woman, who was close friends with Zandstra’s daughters, wrote she believed that the attempted kidnapper was “Mr. Z,” the same person who had taken Gretchen, according to the affidavit.

Armed with that evidence, detectives traveled to Georgia to speak with the former minister. After some initial hesitance, Zandstra confessed to killing Gretchen, police said. He told the detectives he had lured her into his vehicle, and then drove to Ridley Creek State Park. In a secluded area, he demanded she undress. When she refused, he struck her in the head with a rock and covered her half-naked body with leaves and other debris.

“We asked and he spoke,” said Trooper Eugene Tray, one of the detectives who interviewed Zandstra. “He was presented with things I don’t think he expected to be presented with. Then, I think he started to think more on it. I think he just wanted his sick, twisted version of redemption, and to come clean.”

David Zandstra was held for court on murder, criminal homicide and kidnapping charges related to the 1975 killing of Gretchen Harrington in Delaware County. The 83-year-old is being held without bail.
Delaware County District Attorney Jack Stollsteimer announced Zandstra's arrest back in July.

The lawyer for a former Broomall pastor accused of killing an 8-year-old girl in a cold-case murder that roiled a corner of Delaware County for decades said Wednesday that state troopers browbeat his client into admitting to a crime he did not commit.

David Zandstra, 83, confessed in July that he lured Gretchen Harrington into a secluded corner of Ridley Creek State Park in 1975, forced her to undress, beat her to death and hid her body under leaves and dirt, according to investigators. But at Zandstra’s preliminary hearing on first-degree murder, kidnapping, and related charges, his attorney, Mark Much, disputed that admission, saying Pennsylvania State Police troopers wore down a confused, vulnerable man who confessed under duress.

“This is an 83-year-old man that was subjected to a four-hour interview, and was manipulated, coerced, tricked, lied to, and they believe he admitted to something that I submit he didn’t do,” Much said.

From December 13, 2023...

"Accused child killer David Zandstra was formally arraigned on first-degree murder and related charges Wednesday for the 1975 beating death of 8-year-old Gretchen Harrington.

Zandstra, 83, a retired Marple Township minister extradited from Marietta, Georgia, is also charged with criminal homicide, murder in the second- and third-degree, kidnapping and possessing an instrument of crime."

and

"Deputy District Attorney Geoff Paine said last month that Zandstra’s alleged admission came not because he was tricked or confused into providing one, but after he was accused of molesting another victim.

He added that the investigation is ongoing and that other victims of a sexual assault nature have come forward since Zandstra was charged in Gretchen’s murder, including those inside and outside of Delaware County.

No additional charges have been filed as yet. Zandstra is scheduled for a pretrial conference Feb. 15 before Common Pleas Court Judge Anthony Scanlon. He remains in custody at the county jail in Concord without bail."
