No special treatment for kids in Huckaby trial

A judge rejected a motion Friday by the Tracy Sunday school teacher accused of raping and murdering her daughter's 8-year-old playmate to have child witnesses undergo questioning before the trial.

STOCKTON, CA - A trial date for the Tracy woman charged with kidnapping, raping and killing an 8-year-old girl last March may not be set until December.

Thanks, Harmony2, for the links. The SFChronicle article goes into some detail. Before everyone gets all up in arms about the judge, please note that it was the defense who wanted to tape the child witnesses. Not only is this normally reserved for dependent or ill adults, it is also not permissible in death penalty cases, as noted by the judge. The prosecution did not like it, either.

The case People of the State of California v. Melissa Huckaby (case number SF112495A) has been scheduled for Friday, October 30, 2009 at 12:00 p.m. (in camera hearing) and 1:00 p.m. (public hearing) in Department 14 of the main Stockton Courthouse located at 222 E. Weber Avenue, Stockton, CA 95202.
All media requests for photography, video recording and sound recording in the courtroom have been denied for this hearing. Please see the order made on April 22, 2009 by the Hon. Linda L. Lofthus, which shall continue for all future hearings until modified.
Because of the high public interest and our limited seating capacity, all media personnel may not be able to get into the courtroom.
NOTICE TO THE PUBLIC:
Due to limited courtroom seating, there will be a drawing held at the courthouse for the remaining audience seats.
  1. Members of the public are to check-in on Friday, October 30th at 12:00 p.m. at Department 14 (First Floor).
  2. At the time of check-in, one ticket per person present will be issued.
  3. The drawing will take place at 12:15 p.m. in front of Department 14 (First Floor).
  4. Tickets must be presented prior to entering the courtroom and ticket numbers will be checked against the master list.

Sam Behar, Melissa Huckaby's public defender, has enlisted the help of San Francisco attorney Michael Burt, who has been involved in defending suspects in high profile death penalty cases, including Richard Ramirez, Charles Ng and Lyle Menendez. Burt did not appear during a hearing for Huckaby in San Joaquin County Superior Court today, but will be at the defense table with Behar and Huckaby at the next court date Dec. 4, when a trial date could be set.
