New delay for trial of women in missing baby case

The trial, which was scheduled to begin Aug. 8, likely will not begin until October, according to information from Maricopa County Superior Court. The Maricopa County prosecutor assigned to the matter is working on an older ongoing case that takes precedence.

For months, bloggers, social-network contributors, lawyers and the media have drawn comparisons between two single women who didn't want to be mothers in the first place and whose children mysteriously disappeared.

One of them, Elizabeth Johnson of Tempe, 25, mother of the missing Baby Gabriel, will be in Maricopa County Superior Court today for a hearing to determine whether she is competent to stand trial.

...Competency issues will be addressed Tuesday morning in court and it will be a big day for Johnson. Her future could be determined.

A judge will rule if she's mentally competent to stand trial. If she is, the trial will start soon. If not, her case could be thrown out and the mother could be ordered to a psychiatric facility.

A judge who postponed Elizabeth Johnson's competency hearing until Aug. 11 said Tuesday he is concerned that four of five doctors who have examined Baby Gabriel's mother have found her incompetent to stand trial.

Maricopa County Superior Court Judge Paul McMurdie said he hopes the attorneys' discussions with the evaluating physicians include plans for restoring Johnson to competency.

"I want to make sure there is a plan to make her restorable," McMurdie said.

Two doctors recently found Johnson incompetent and one found her competent. One of the two who said she incompetent said she restorable, the other said she is not, said defense attorney Marci Kratter. Previously, two other doctors found her incompetent to stand trial.

"I think there is a real issue on whether she is restorable," Attorney Dan Raynak said. "We will be focusing on whether or not she is restorable. "

PHOENIX - A judge has postponed a competency hearing for the jailed mother of an Arizona boy missing since December 2009.Maricopa County Superior Court Judge Paul McMurdie on Tuesday set an Aug. 11 competency hearing for 25-year-old Elizabeth Johnson who refused to attend the hearing.

...“She decided she didn’t want to come,” said Johnson’s attorney Dan Raynak.

....“I’ll tell her that she needs to appear. Anytime the judge has made it clear that she must appear, she has appeared,” said Raynak while sitting in his Phoenix office.

...When asked if Johnson would testify, Raynak responded, “Anything is possible. We haven’t crossed that bridge yet.”

...“I won’t discuss what she talks about, but she has never refused to speak to me, so her and I do have discussions,” said Raynak.

...“Not only as an attorney, but as a father of three myself, I’m also concerned about Gabriel and certainly that’s something I’ve kept a priority and made it a priority," he said.

Elizabeth Johnson, 25, has been found incompetent to stand trial by four of five doctors, Maricopa County Judge Paul McMurdie said in court Tuesday.

Of the four, three said she could be restored to competency with counseling, medication and therapy, said Jerry Cobb, spokesman for Maricopa County Attorney Bill Montgomery.

The judge said that attorneys can interview the three doctors who evaluated Johnson most recently.

Defense attorney Dan Raynak said he intends to use the hearing to press the doctors on whether Johnson can ever cooperate with her attorneys.

PHOENIX (KPHO) - Attorneys for Elizabeth Johnson were back in a Phoenix courtroom this morning and hinted they could soon ask for all the charges against her to be tossed out.

Her legal team claims that prosecutors got a hold of a letter she wrote from jail that was supposed to go to an investigator working for her defense team.

They say that violates her rights, so they could soon ask for the kidnapping charges against her to be thrown out and for the judge to reprimand the prosecutors...

PHOENIX - The mother of a missing baby Gabriel appeared in court Friday as a judge heard testimony on whether she is fit to stand trial.

Elizabeth Johnson did not testify. Instead, she heard attorneys on both sides read letters she has written from jail and sent to family and friends.

The judge also revealed Johnson has even sent him several letters.

At issue is whether Johnson is competent to stand trial in connection with the disappearance of her then 9-month-old son, Gabriel.

He has still never been found and it's not clear what happened to him.

Investigators have said Johnson has changed her stories and, at one point, said she killed her son. She has also said she gave him away.

The key issue at Friday’s hearing was whether she can assist her attorneys in her defense.

Her lawyer said she doesn't trust him and isn't cooperating.

Prosecutors argue she likes her attorneys and has bragged about them.

The next hearing is set for Sept. 30.

"What can anyone say I did wrong? Really? They don't know. I know," Elizabeth wrote.

But the most compelling part of her letters is when, for the first time, she talks about missing Baby Gabriel and gives a glimpse of what may have happened to her baby.

She stated in her letters: "I love my son more than anything, and I've missed him being in my arms or on my hip more than anything. The hardest, most selfless thing to do is to give your child away. In the end, I knew it wasn't fair to Gabriel to live a life with me. I am a train wreck. I don't owe anyone an explanation."

In the letters, Johnson repeatedly asks to have her lawyers removed from her case and to allow her to be under house arrest. Last month, the judge denied both of those requests.

Too bad they can't just beat the truth out of her.

Today Marks 2 Years Since Baby Gabriel's Disappearance

PHOENIX (KPHO) - A 9-year-old Indiana girl who disappeared Friday was found dead Monday and her babysitter has been arrested on murder charges.

One father who knows just how hard it is to lose a child around Christmas is Logan McQueary.

Today marks the second anniversary of his son's disappearance...

As much as it pains him, he tells CBS 5 that he's accepted that his son is likely dead.

"I always knew the evidence was there in the things that police and the FBI told me and listening to the interviews and stuff that Elizabeth said, but I guess I never really wanted to believe it and I guess just over time I came to the realization that this might be exactly what Elizabeth did," McQueary said...

..."I still hold hope that he's still out there and I wish and I pray that someday he'll pop up somewhere and I can meet my son as a grown man or a teenager or even a year from now," McQueary said.

"I'd probably have a smile on my face but I'd be crying at the same time."

Johnson said she conspired to give her boy up for adoption with the help of another Valley woman, Tammi Smith...

Smith said her plan was to adopt the boy without his father's knowledge but once Johnson drove across the state lines, the boy was never seen again.

"It's in her nature to feel compelled to help, because of her religious beliefs, again because of her family background. She feels compelled to help, particularly when she perceives a woman in trouble or child in trouble," said Smith's attorney, Anne Phillips.

Tammi Smith, the Scottsdale woman who wanted to adopt Baby Gabriel, is headed for trial on charges connected to the December 2009 disappearance of the 8-month-old child, whose plight remains a mystery.

Jury selection began Monday and opening arguments are scheduled for next Tuesday in the case of Smith, 40, who is charged with forgery and conspiracy to commit custodial interference in her alleged role in Gabriel's unknown fate.
