Ron Cummings Arrested 2009.08.06 RE: Battery involving brother-in-law #3

What does the notice of discovery mean? I know i should know this after the CA case but, could a get a refresher? TIA

I hope I am not misunderstanding your question.

The discovery request means that Ron's attorney is requesting discovery from the prosecutor. The prosecutor will have to turn over any and all evidence that will be used at trial against Ron. The police reports, witness statements, etc. Anything that is in their possession that can and may be used against Ron at trial. That gives the defense a chance to prepare trial strategy. It's typical for the prosecutor to ask for reciprocal discovery. The defense has to turn over a witness list, and any documents, exhibits, etc that they may use.

It looks like Terry J S. is no longer a public defender. The link you provided was from 2007-2008. He is now a criminal defense attorney. Guess where his office is located? St.Augustine's!!. That day trip he took was very productive.

Ron only used a public defender on the first appearance, which is clearly noted on the docket.

He is licensed by the Putnum County Bar Association and can practice there. The link I provided shows that the Seventh Judicial Circuit serves Volusia, Flagler, St. Johns and Putnam counties. This means their draw list includes Terry Shoemaker while being in St. Augustine, imo.

In Ron's other cases, he generally either waved counsel or filed an Insolvency Affadavit and was assigned a PD. In this case, he filed the affadavit and was assigned a PD for the 1st Appearance Hearing. An attorney's Notice of Appearance (see bolded line below) was not included in the other cases where he had a PD. Not sure what that means, but maybe someone with court experience in FL will chime in.

If I am reading it correctly, he was on the list as St. John's County SA (numeral 4, surrounded by a square). The St. John's County PDs are listed with a numeral 4, surrounded by a circle.

Battery can be a felony so he would be stupid not to get a lawyer.
 
My parents beat me. My Step-Father broke my nose on more than one occasion and I watched him beat my Mother year after year, sending her to the hospital with such frequency that they knew my voice when I called before I stated it. I can say with confidence that I have never, ever committed an act of physical violence against another person....not even in self defense. I have never thrown anything in my home or slammed a door. I do not spank my children, though I probably should have...I made a choice not to. I do not consider verbal statements acts of violence unless they are terrorstic threats or threats of bodily harm with intent. I have said a cuss word at a driver who cut me off, but no...I have not threatened their life. I know what violence does...so I do not tolerate it...from myself or others.

Good job, dude! I was raised in a tough family. I broke the chain too!

I'm just interested in knowing if he is related in anyway to any of the Cummings?

Of course I don't live in Florida but attorneys here donate their time and services for people that can't afford attorneys. My niece and her ex were supposed to go to court for one of their divorce hearings and it was postponed because the attorney got a call from the court and he had to do a pro bono case in the next county.

Yes, Misty did. And, IMO, that is a ridiculous statement.

There are many reasons people need attorneys. In addition to needing an attorney when you are going to court - for any number of reasons - such as facing criminal charges, or a family law case - an attorney can also protect a person's CIVIL RIGHTS that are guaranteed to each and every one of us under the United States Constitution.

Misty should have had an attorney since HaLeigh went missing during the 30 plus hours LE questioned her. Misty was the last person to see HaLeigh. Perhaps if she had had an attorney, LE would have the answers they need from her.

Since this is RON'S THREAD --
Let's be clear - Ron having an attorney to go to Court has nothing to do with his guilt or innocence. It has to do with his right to a FAIR TRIAL.

IMO an inocent and nieve 17 year old said that without truely understanding the ugly truth that you are guilty till you PROVE yourself innocent.(no matter if you are asleep the 4 1/2 hours in question.)
