When WIS went to the Darlington County courthouse last month – two years and seven months after Locklair said he promised charges in the case – to look for an arrest warrant for Boyer, it didn't exist. WIS searched every file from 2011 in the county's file room and found nothing on Boyer. Locklair did not keep his promise made to Haggadone's family in 2011.

WIS went back to Locklair two weeks ago to find out what happened. Locklair admitted that Boyer has not been indicted in Darlington County.
"The accused killer is charged," Locklair said. "It's just not a formal charge."

The investigator was telling the truth, but he did something one week before WIS' interview that no one knew about. The next business day after Locklair found out WIS interviewed Applegate, he went to a county judge and swore out a murder warrant on Boyer. Locklair told the judge he had new information in the case and was ready to charge the man.

Last week, Locklair resigned after the sheriff found out WIS was investigating what Locklair did to get the warrant. Darlington County Sheriff Wayne Byrd wrote in a statement that Locklair "failed to follow procedure" and was "attempting to cover up that fact."

The solicitor reopened the file and assigned an assistant solicitor to the case. Rogers said he plans to make a decision on whether they'll charge Boyer once prosecutors finish reviewing the file. An answer could come by the end of the week.

Praying they have enough evidence. Hopefully nothing was messed up or lost from the original investigation.

The children have spoken out.

'Sunday marked 14 years since the body of 32-year-old Michelle Haggadone was found and still no one has been charged with killing her, even though in 2011 investigators named a man who they say did it.'

'Memories of their mother haven't faded, even though they were just 4 and 10 when she disappeared.

"She was tall and skinny, had long nails. That was a big deal because that's what I was kinda like, tall and skinny," said Gabrielle Wilson, Haggadone's daughter.'

'Haggadone's mother tells WIS that her daughter lost custody of her children and started working as a prostitute to feed her drug habit.'

In 2011, the Darlington County Sheriff's Office announced suspected serial killer and long-haul truck driver John Wayne Boyer, but Boyer was never charged for Haggadone's murder....Solicitor Will Rogers is currently reviewing the evidence in Haggadone's case.'

This perp is going to spend his life in jail anyway, but that's not the point. These kids need justice, so does their dead mom. Hope they get it.

It has been 14 years since an unknown woman was found dead; four years after investigators declared they had a suspect; and one year after questions about the case rocked the Darlington County Sheriff's Office. Now, Rogers formally revealed he does not have a criminal case to make.

“It may be a situation where we can't ever move forward because of the strength of the case,” Rogers said... The case against Boyer has rested almost entirely on one jailhouse interview and his apparent confession....

Boyer is due to finish his prison sentence in North Carolina for the 2003 death of Scarlett Wood in July. From there, prosecutors in Tennessee plan to put him on trial for the 2005 murder of Jennifer Smith. That still leaves the 14-year-old cold case of Michelle Haggadone with no one facing charges.
 
Old but good info. I cannot believe Boyer is already getting out from his 1st murder sentence! Pray that Tennessee is ready for him.

The investigator was chilled by the hatred toward women from a man who had never been married and lived with his mother near Augusta, Ga.
Darlington County, S.C., Sheriff's Capt. Andy Locklair immediately got the same impression when he stepped into an interview room to question Boyer about a killing in that state. The first thing Boyer said to him was: "What b---- are you here about?"
Boyer's attorney in the North Carolina case said he felt uneasy around his client. "It wouldn't surprise me if there's other stuff out there," said H. Lawrence Shotwell. "I have absolutely nothing other than a gut instinct on that."
"We have a lot of unsolved missing persons in the general area where Mr. Boyer was known to frequent, live, and be. So, to me that alone warrants a second look," Caison said.
