GUILTY SC - Stewart Floyd, 41, disabled, shot to death at wife's wake, 22 Aug 2007

It's the defense used by the killer of a gay councilman and Mayor George Moscone (San Francisco) a number of years ago. The killer (can't remember his name) used that he ate lots of carbs and that caused him to go beserk and kill 2 people. It's since been called the "twinkie defense."

It sparked rioting in San Francisco the so-called White Night Riots and ultimately led to the state of California abolishing the diminished capacity criminal defense.

A man charged with shooting and killing his son-in-law following his daughter’s wake will serve a life sentence with no possibility of parole...

A jury found Herman Donald McKnight, 61, of 1614 Cockley Point Road in Coward guilty of murder in the Aug. 22 death of his son-in-law, 41-year-old Stewart Floyd of Turbeville.

Jurors took 35 minutes Friday to find McKnight also guilty of assault and battery of a high and aggravated nature, discharging a firearm into a dwelling and possession of a weapon during the commission of a violent crime, Clements said.
