Impact mark and damage consistent with possible uncontrolled impact
Observing damage in 5.1 to 5.10 I matched the A and B and found the breakage pattern of A physically matched the breakage of B
Piece of breakage marked A was sealed by me in an evidence bag and kept on my person
I physically matched painted cement marked C into the impact mark onD and couldnt determine if C was/wasnt part of structure above
stair case railing. Piece of painted cement marked C sealed in evidence bag by me

In February 2015 she compiled a report.

She observed one piece of painted cement laying on the floor at front door entrance; one impact mark with damage caused by adjacent to front entrance area.

One piece of painted cement on staircase; an impact mark consistent with sharp edged movement above staircase rail; powder particles, like cement powered particles on staircase rail.

A piece of tile fragment on staircase with same appearance of tile on staircase floor; impact damage and particles consistent with breakage damage on the 17th stair; impact damage consistent with a sharp edged tool movement in the tile area in the first bedroom.

Piece of tile fragment on staircase floor lying in debris ; one impact mark in bedroom.

Brown physically matched D and E and couldn't find if D had once been part of E
Brown: she made casts of the areas which had pieces of cement removed from them
Brown physically checked the tile fragment marked G to the damage on the tile marked F- couldn't confirm once part of G

The last day of sittings for this trial is today week. On 19 June the trial will then be adjourned to the next available period when the court, the judge, and counsel are available. I’m speculating here but I think the State will try and wrap up its case by 19 June and the Defence will commence when it resumes, starting with Henri.

I'm prepared for a delay of perhaps a couple of months. Some courts (maybe all) go into recess for the whole of July. I've made an enquiry about the Western Cape High Court and if I hear back I'll let you know.

Just by way of example, the Panayiotou trial ran for 8 weeks until 6 December. The court was in recess during January. The trial within a trial lasted for 2 weeks in April/May. It resumes today and will continue for the whole of June. The defence hasn't even started.

We still have a long way to go.

Thank you JJ! :tyou:

Wow, how frustrating to have it put off like that. Even worse, how galling to know HvB will continue to enjoy his freedom in that time. :notgood:

B Represet is a specially formulated fast curing 2 part silicone rubber we use to make flexible high resolution replicas of marks
Brown: it is a rubbery substance I place into the tool mark which then takes on the format of the impact mark
Brown: I did not have the supposed weapons when I visited the scene, I didnt see them before I drew up my first report
We made casts so that once I receive the tools I could microscopically compare the tools and the marks
Brown the drafted second report when she received the weapons

Brown: used silicone substance to make replicas of the marks, which makes a cast of the impact mark
Brown: didn't have sights of the weapons when she drew up her first report
Brown: went back to the scene to examine tools with marks

Brown when I visited house on 28.01 I didnt have the tools that were mentioned on the phone which is why I did 2nd report
Brown: I went back to the scene when I had the tools. I examined the actual tools

We make replicas of marks using a rubbery substance in liquid format which is smeared into the area and substance takes on the format of the impact mark you are trying to cast, Brown says.

She drafted her first report without the axe; the second she had had access to it.

Captain Brown has the axe in her hand.

The area one would use as the handle was 34cm in length; the axe eye (butt) was 4.8cm; from butt to the top edge 15cm; sharp edge 3.4cm.

Green area is the axe head; from sharp edge to where the handle starts is 8.5cm.

Brown: axe- the area one would use as a handle was 34cm in length @CapeTownEtc#vanbreda The axe eye was 4.8cm in length
Brown the area from the butt of the axe (blunt edge of blade) to the top sharp edge was 15cm in length
brown- the painted area to the same sharp edge is 3.4cm

Brown: The area at the blunt edge was 2cm at the butt of the Axe
From the top edge of the butt to the bottom of the butt (blunt side) was 6.1cm
Bottom of the blunt side inwards toward where handle starts was 1.6cm
Where the handle is placed into the blade of the axe was 4.9cm

Brown: Front part of the handle to bottom of the sharp edge 8.1cm the axe weighed 1.17kg

Brown also examined the knife
The weight of the knife was 0.0824kgs

Brown- length of the blade is what is called a 19cm blade but the exposed part from tip to handle is 18.3cm

Bottom part of butt up to the handle is 1.6cm.

The axe weighed 1.17kg.

She also examined the knife. Exhibit 2 handed to her.

The blade length is 19cm; exposed blade 18.3cm from tip to plastic handle

Impact marks B, D and H were caused by a sharp edged tool. She says she found markings in these impact marks.

When she visited the scene with the tools in her possession, she matched it with the marks.

I suspect Capt. Brown is going to be a very good witness. Botha likes detail, and he's certainly getting plenty of that.

Brown refers to her photos- 1 impact mark with damage consistent with controlled sharp edge at front entrance door way
Brown: fig 1.1 shows the area I am referring to which I marked B
1.1.2 contains pictures depicting figure 1 to figure 31
Fig 2: same picture taken from adjacent wall to entrance area depicting impact mark with damage (same mark)
Fig3. same area taken close up
Fig 4. Same damage and impact mark, I would say close up in the middle of the mark
Fig 5 of the same impact damage mark more to the entrance side of the mark

Fig 8 is depicting wall with same impact and damage mark in this instance I took picture of axe held with top edge
of the axe being held into the sharp edge damage of that particularly impact and damage mark
Fig 9- same impact and damage of B with a close up of the blade of the axe connecting into the damage mark
Fig 10-close up of the top part of the axe held into the sharp edge damage area marked by me

I suspect Capt. Brown is going to be a very good witness. Botha likes detail, and he's certainly getting plenty of that.

I wonder if she's going to be able to estimate the height (or anything else) of the person who swung the axe.

Fig 11- same picture top part of axe head being placed into the damaged area

Fig 12,13, 14, 15 and 16 all photos of the same damage with the axe blade in the picture
Brown Fig 15 - the handle of the axe is pointing in opposite direction

Brown:when I physically matched the axe into the impact and damage mark B I couldnt determine whether axe was definitely thecause
of such marks or not the cause of such marks thus it is possible but also could not be possible
