Boswell sought to fire attorney Brad Sproles at a hearing last month, complaining he was refusing to summon witnesses she believed would help her case. Sproles countered that most of the witnesses she cited would not, in fact, be helpful to her defense, but he stopped short of saying the relationship between him and Boswell was “irretrievably broken” — the legal standard required for a judge to allow a defendant to part ways with an attorney.

But Sproles told Goodwin on Friday that his relationship with Boswell has continued to deteriorate since last month’s hearing.

“We have spoken several times since that hearing,” Sproles said.

Goodwin responded, “Do you feel the attorney-client relationship is irretrievably broken and beyond repair?”

“Yes,” Sproles responded.

“I think I have no choice but to allow you to withdraw as counsel,” the judge said.

Goodwin appointed Jonesborough attorney Gene Scott Jr. to replace Sproles. The judge and Sullivan County District Attorney General Barry Staubus acknowledged the change in legal counsel would delay Boswell’s upcoming trial. Goodwin set a Dec. 14 status hearing at which a new trial date likely will be set.

Sullivan County Criminal Court Judge James F. Goodwin granted the motion by Boswell’s attorney, Brad Sproles, to withdraw from the case after he and Boswell had an apparent falling out. Sproles told Goodwin during Friday’s brief hearing he felt the attorney-client relationship was broken beyond repair.

Sproles was subsequently dismissed from the case.

In September, Boswell herself spoke up and requested that Goodwin appoint her a new lawyer over “differences of opinion” with Sproles, who stated that their relationship had deteriorated to the point where it impeded their ability to prepare.

Nov. 21 marks what would have been Evelyn Boswell’s 4th birthday

On Monday, Nov. 21, Evelyn Boswell would have turned 4 years old. The Blountville girl was the center of an AMBER Alert that came to a devastating end weeks later when her remains were found on a family member’s property.

Evelyn was born on Nov. 21, 2018. She was just 15 months old when she was reported missing in February of 2020.

Last month, Boswell’s attorney filed a motion to withdraw from the case and she was appointed new counsel. She’s set to appear in court for a status hearing on Dec. 13, but that along with the scheduled February 2023 trial will likely be stalled due to the change in attorneys.

Defense files motion to allow Megan Boswell to wear civilian dress clothes during hearings

The request was made "because of the extraordinary publicity and media attention her case is receiving," according to the motion.

"If she is not allowed to wear civilian clothes, thousands of people - some of whom may be potential jurors - will continue to see her dressed in her jail jumpsuit and the danger of unfair negative inferences being made will be ever-present," the motion also stated.

Megan Boswell had been set to face a jury trial in February 2023; however, in a court hearing Wednesday, her trial was delayed and set to Feb. 3, 2025.

A News Channel 11 crew was in the courtroom as Boswell appeared with her new legal counsel, who recently requested she be allowed to wear civilian clothes while in court. Her attorney, Gene Scott requested the trial date change on Wednesday.

“Delay is generally not good for the state in that we’ve got lots of witnesses that [we] are now going to have to…keep tabs on and keep them kind of on the hook for several years now until it does go to trial,” said Sullivan County Deputy DA William Harper.

“We understand that the new attorney has just been appointed to the case, but obviously, it’s a lot of work, and we’re ready to get it underway,” Harper said. “We had a trial date set in next year, and the state was prepared and ready to go.”

Scott continues to familiarize himself with the case and said that work includes digging up any and every document the defense can find, including past hearings and expert testimony.

“The discovery in this case is just very voluminous,” Scott said. “There’s a lot of experts that will be needed for both sides of the case, and we need to follow up on those things.”

The defense attorney said Boswell has been cooperative, but he’s “not going to get into the ins and outs of [his] relationship with Megan.”

“I think there’s some questions about Megan’s mental health that we want to explore, and I don’t really feel comfortable talking about our relationship,” Scott said.

Megan Boswell's trial moved to February 2025

“We wouldn’t have asked if we didn’t think it was absolutely necessary," said Scott. "Obviously Megan is in jail and can't make bond so we didn’t want to put if off any longer than we have to, but at the same time the case is so complex and there’s a lot that needs to be done...so essentially it’s a 24 month continuance from where the trial is set right now.”

In the meantime Scott said he plans to file new motions, including a recent motion to allow Boswell to wear civilian clothes inside the courtroom, instead of her inmate jumpsuit. He said they also plan to ask for a change of venue.

Judge rejects Boswell motion to wear street clothes in court

A judge Friday rejected a motion to allow Megan Boswell to wear street clothes in court.

"He [Goodwin] filed a written order denying our motion. I don't agree with that decision. There is no other case I can remember in Sullivan County that has had this kind of media attention," Scott said after the hearing. "We'll explore our options whether we can appeal that order."

In the order the judged noted no jury has been selected, Boswell shouldn't be treated differently than any other jail inmate and the defense failed to cite any case or statute regarding the request.

After the hearing Scott, said the amount of information in this case is substantial.

"In this day and age there is so much with cell phone downloads and social media that you have to go through. Twenty years ago, if you tried a murder case, you might have some autopsy photos and a few witness statements and that was it," Scott said. "Now you have hundreds and hundreds of pages of cell phone downloads and social media information. It's just a lot to go through."

Judge denies Boswell’s request to wear street clothes, next appearance set

On Friday, Judge James Goodwin listed the following reasons to deny the previous request by Boswell’s legal team for her to wear civilian clothes.
  • “The state points out correctly that no jury has been selected to hear this case at this time and any prejudice that might arise can be fleshed out during voir dire.”
  • “This Court does not find that this defendant [Boswell] should be treated any differently than any other inmate in the Sullivan County Jail.”
  • “The defense has not provided any case or statute that specifically requires the relief [request] sought.”

Staubus agreed with Goodwin’s ruling on Boswell’s clothing.

“We had opposed that motion ...” Staubus said. “We also anticipate the judge is going to make a ruling on the earlier motion to sever the other charges from the murder charges and the child abuse cases. The judge said he’s going to rule on that shortly so we expect that he will release a ruling probably in the next week or two.”

No motions were heard at Friday’s status hearing, and Boswell’s next appearance is set for Nov. 3.

“Today was really just about status,” said Gene Scott, Boswell’s defense attorney. “We’re really just continuing to ask for certain discovery documents and going through the discovery, which was quite large in the case. It was really just more about the court making sure everything is kept on track so we can make that trial date in February 2025.”

Sullivan County District Attorney General Barry Staubus told News Channel 11 they’re in the process of making sure the defense attorney, Scott, gets all the materials Boswell’s previous attorney had.

“We think we have a good defense to put forward. I’m not comfortable discussing the details of that right now. We think once everything is told, it will put this case in a totally different light,” said Scott.
