A judge Friday rejected a motion to allow Megan Boswell to wear street clothes in court.

"He [Goodwin] filed a written order denying our motion. I don't agree with that decision. There is no other case I can remember in Sullivan County that has had this kind of media attention," Scott said after the hearing. "We'll explore our options whether we can appeal that order."

In the order the judged noted no jury has been selected, Boswell shouldn't be treated differently than any other jail inmate and the defense failed to cite any case or statute regarding the request.

"In this day and age there is so much with cell phone downloads and social media that you have to go through. Twenty years ago, if you tried a murder case, you might have some autopsy photos and a few witness statements and that was it," Scott said. "Now you have hundreds and hundreds of pages of cell phone downloads and social media information. It's just a lot to go through."

  • “The state points out correctly that no jury has been selected to hear this case at this time and any prejudice that might arise can be fleshed out during voir dire.”

  • “The defense has not provided any case or statute that specifically requires the relief [request] sought.”

12/14/22 Update: Defense attorney Gene Scott said he plans to file new motions, including a recent motion to allow Boswell to wear civilian clothes inside the courtroom, instead of her inmate jumpsuit. He said they also plan to ask for a change of venue. Motions hearing on 12/16/22 was cancelled. Next status hearing on 4/21/23. And since she received a new attorney, trial has been moved to 2/3/25.

On April 21, Judge James Goodwin denied a request by Boswell’s legal team for her to wear civilian clothes.

In a September 2022 hearing, Goodwin denied Boswell’s request for a new attorney citing a “difference of opinions” with her court-appointed attorney, Brad Sproles. In that same appearance, a pathologist testified that Evelyn died of asphyxiation.

The trial is set to begin in February 2025.

No motions were heard at Friday’s status hearing, and Boswell’s next appearance is set for Nov. 3.

“Today was really just about status,” said Gene Scott, Boswell’s defense attorney. “We’re really just continuing to ask for certain discovery documents and going through the discovery, which was quite large in the case. It was really just more about the court making sure everything is kept on track so we can make that trial date in February 2025.”

Sullivan County District Attorney General Barry Staubus told News Channel 11 they’re in the process of making sure the defense attorney, Scott, gets all the materials Boswell’s previous attorney had.

8/4/23 Update: Boswell made a brief court appearance in Sullivan County Friday morning. No motions were heard at Friday’s status hearing. Next status hearing on 11/3/23 @ 9am.

Justice appears to be on the slow train, Turtle Express.

For some reason whenever notified of an update on this case, I always think of Taylor Rose Williams, partial remains located in rural Alabama, which area was near the hometown of Mother. Her Mother, Brianna Williams, a Navy Petty Officer NAS Jax (Jacksonville, FL) at the time eventually plead Guilty for the death of Taylor Rose. That decision left lots of unanswered questions, which in my opinion was the driving force behind the Guilty plea. The Prosecution had strong case including cell data and DNA evidence and the Defense really had no case for reasonable doubt. I personally don’t think BW wanted a trial for the facts to be disclosed to the public. I somewhat think that the similar might, just might occur with Megan Boswell except I suspect MB may attempt to once again claim her Mother is responsible or possibly someone else even sadly her Dad.

JMO, MB appears to be a massive manipulator and lacks the ability to tell the truth, similar to Brianna Williams.

Two sweet babies selfishly gone too soon by the people who were responsible for ensuring their care and protection. These mothers were blessed to have these innocent children but the little girls were failed by their mothers.

Just my opinion.
