GUILTY TN - Micah Pate, 26, Bartlett, 30 April 2009

BARTLETT, Tenn. - Shelby County Attorney General Bill Gibbons says A Bartlett judge's decision to allow accused murderer Thomas Pate to bond out and live in Atlanta until trial is not a surprise.

Thomas Pate is free on $250,000 bond after being charged with second degree murder in the shooting death of his wife Micah Pate last week.

It's a case that's been made even more baffling because of the lack of information provided by police and prosecutors surrounding the murder of Micah Pate

The Pate trial is set to begin Aug 2. Micah was shot at close range in back of head. Interesting to note was that she was in her sock feet, her shoes were not found at the crime scene, and the bottom of her socks were clean. In the confession Thomas said she walked in front of the gun and after she fell he asked her if she was okay, she didn't answer so he got scared and threw the gun in the river and drove home.

Defense wants the confession thrown out because they say Thomas's father was acting as an agent of the law. The detective was also in the interview room with dad and Thomas during the confession. A hearing was held on this back in May but nothing about the ruling has been published- yet.

In the interview his dad asked if Micah found out about his girlfriend. And also about his drug use and alcohol use. Thomas said he'd gotten off drugs and alcohol a couple years earlier but he had recently started drinking again. Who this alleged girlfriend is, I do not know.
 
Thomas's trial in the death of his wife, Micah, has been postponed. The defense is appealing the Judge's decision to allow jurors to hear his taped confession. The defense is contending Thomas's dad was acting as an agent of the law when he questioned Thomas. The State is saying he wasn't and that Thomas had been read his miranda rights. An investigator was in the room with the accused and his dad when Thomas confessed.

I pray the appeal fails- the confession is a vital part of the States case. T
 
Who is this guy who gets to live out of state before a murder trial?? Working from home equals=wife paying bills and keeping health insurance. He is home drinking and drugging and having affairs. What a worthless piece of humanity!! But as a nurse, I know we often pick fixer-uppers that cannot be fixed.

Because Thomas accepted a deal that kept him from testifying, the evidence against him was never presented in court...

"On the night that she disappeared, there were several text and phone calls to another woman in New York that was on Thomas' phone," said Blackstone. "So his arguments about this being an accident kind of start to ring hollow."

That other woman, who is a school teacher and dance instructor, told Bartlett police she and Thomas were having an affair. In fact, the two spent Easter weekend together in Tunica just before Micah died.
