Durst Set for California Murder Trial After Sentencing

“With the plea agreement, Durst avoided financial crimes charges in New York, firearms charges in Texas. A Louisiana district attorney agreed to forgo prosecuting Durst on a local gun charge. Durst ended up with a longer term than the 12 to 18 months suggested by federal sentencing guidelines.

"We cleared the decks, at a cost,” said Durst’s lawyer Dick DeGuerin. He added it means Durst can get to California "and that’s what this is all about."

Durst could be in California “within a couple of weeks, if not sooner,” prosecutor Michael McMahon said. “He’ll be out of here pretty expeditiously.”

The Federal Bureau of Prisons has to formally accept the judge’s recommendation for Durst to go to California.”​
 

Durst, 73, was due to be transferred by Aug. 18 to a federal prison in Southern California after he agreed to plead guilty to a weapons charge in New Orleans.


But Durst has remained in a Louisiana jail. His legal team learned Friday that he was to be relocated to a federal prison with a specialized medical facility in Terre Haute, Ind.

DeGuerin said the assignment may have been made because the Terre Haute prison has one of two "level 3" medical facilities in the federal system.

It seems like some major court hearing today if I am reading this right.

I think it is an important hearing to see whether there will be a new murder trial.

the Susan Berman is a long shot case........from what I understand there is not much evidence at all....I don't see how he can even be charged

I doubt he'll be missed. It's a shame it took so long to bring him to justice, but kudos to the investigators and prosecutors who took him on. If only they had been able to stop him after his first murder.

He'll go down in history as one of the first killers to casually admit his guilt in an HBO documentary.

I hope Kathleen's family and friends can find some measure of peace now that he's gone. She seemed like such a kind, brilliant woman.

At least, we may learn more about his wife's death.

Durst was indicted last November in New York with the death of his former wife, Kathie Durst, who vanished in 1982. The Westchester County District Attorney's Office said it would hold a news conference in "the coming days" to release more information about the case against Durst, given his death.
