Found Deceased UT - Dylan Rounds, 19, Lucin, Box Elder Co, May 2022 #2 *Arrest*

One of Dylan's parents' complaints was that JB was not arrested immediately despite having a warrant issued against him, which enabled him to "clean" the grain shed and potentially destroy evidence.

They must have known immediately and intuitively that it was him. I can't imagine what they've been through with all the time it took and how slowly this unfolded, my heart breaks for them.

It's so strange how the most demonic twisted and distorted characters target the young, honest, decent, pure of spirit, time after time we see that on this site. It seems so very unfair and wrong, like a triumph of evil. I hope that DR's family and friends get the justice they deserve.

From the interview -- JB's being held by Feds for the gun charges and was appointed UT public defender once Utah filed the murder charges but the attorney has since withdrawn from the case -- hence JB still not arraigned even though he was charged in March!

Parents not consulted about death penalty but told capital murder or death penalty not being pursued. Parents are not opposed to capital murder charge.

Another delay is the attorney that withdrew from the case advised JB he should have two attorneys assigned to represent him.

Wheels of justice for Dylan moving extremely slow. :(

BRIGHAM CITY, Utah — The man accused of killing Dylan Rounds limped into a Utah courtroom Monday afternoon wearing an orange jumpsuit, handcuffs around his wrists and shackles on his ankles.

James Brenner spoke only one word during the nine-minute hearing in the Box Elder County Courthouse. An EastIdahoNews.com camera was rolling as First District Judge Brandon Maynard asked Brenner if he was okay with the timeline of future hearings and Brenner responded, “Yes.”

The 59-year-old is charged with aggravated murder and abuse or desecration of a human body along with some firearms charges.

SALT LAKE CITY (ABC4) — 371 days have passed since Dylan Rounds was last seen. While authorities have charged a man in his death, Rounds’ family says they are anxiously waiting.

Watching his the man accused of his death, James Brenner, stumble into court on Monday, Rounds’ mother Candice Cooley said she was disgusted.

“I feel like it’s almost like he wants everybody to feel sorry for him,” said Cooley.

The speed of Brenner’s walk is similar to the speed Cooley has watched the wheels of justice turn… slowly.

Brenner has a violent criminal history and was arrested in June 2022 on outstanding warrants. He was booked into the Weber County Jail in Ogden, Utah on federal charges. During Monday’s hearing, Michael Studebaker, Brenner’s attorney, asked Judge Maynard to appoint co-counsel to assist in the defense. Maynard said he would look into the issue of having an additional defense attorney appointed and explained the challenges the court has to deal with as Brenner is facing both state and federal charges.

"Here's the problem that is presented in this case. Mr. Brenner is in federal custody and each time this court acts, it has to get permission from the federal government to bring Mr. Brenner in," Maynard said. Box Elder County Attorney Blair Wardle said the process takes six weeks so Brenner's next court appearance, where a decision will be made on whether to hold a preliminary hearing, won't be held until July 31.

Candice Cooley and Justin Rounds, Rounds' parents, were in the courtroom with some extended family members and explained how they felt seeing Brenner walk into the hearing.

"He's despiacble. His whole act of limping around is a complete act. It's not real," Cooley told EastIdahoNews.com. "I don't know if it is so we think he's going to die or make him some sort of deal but he wants people to feel sorry for him." Rounds added, "He looks for attention to have people feel sorry for him. That's all. I think it's an act."
 
It all but appears to me that UT will not pursue the death penalty for Brenner which I think would only end up being beneficial for Brenner.

For example, there's a good chance he could be housed in Federal Prison (FPO) versus State Dept. of Corrections if the US District Court case (weapons) is prosecuted first.

And inmates on death row get multiple chances for appeal because they can file multiple Petitions for a Writ of Habeas Corpus Under 28 U.S.C. § 2241.

I just learned this with Tx Robert Fratta who was executed in January 2023 after 30 years in prison-- and two trials after abusing the appellate with petitions described above.

IMO, it's hardly worth pursing the death penalty when it takes 30 years before the convicted is executed, and all the while able to clog the court and torture the survivors.

IMHO The fact that it takes 6 weeks the get permission from the federal government to bring someone in disgusts and infuriates me. Dylan’s family has painstakingly waited far too long already for justice to be brought, and Brenner’s abhorrent charade in the courtroom only adds to that pain.

During JB's last court appearance, the Prosecutor provided they were not seeking the DP for the Defendant but the defense still intended to request that JB be appointed dual counsel to represent him.

The Court recently responded to the Defense Motion by saying nothing in the rules or Utah Code prevents the court from appointing co-counsel to assist in representing Defendant in aggravated murder, and granted the motion, subject to approval from the Indigent Defense Funds Board.

Public defender Jonathan Nish to represent JB as co-counsel.
