GUILTY UT - Kimberly Hain, 33, murdered in her West Valley home, 22 May 2009

Ok, the mystery of Marty's school transfer is solved. He was enrolled at Provo Canyon School. It is a residential treatment center for troubled kids....very troubled kids. I know two kids sent there and one is now in prison for murder and I have no doubt the other will end up in prison as well as he already has a good rap sheet. We are talking the type of kids that cause their parent's to lock their bedroom doors at night and constantly look over their shoulders. Many former resident's make the news. A mere drug problem wouldn't cause your parent's to send you there. There are too many other cheaper, more convenient and available programs for that. The Provo Canyon School is usually sought by parents who have tried everything else. I'm not buying his school principal's statement that there was never a disciplinary problem with this kid. I bet there is a juvi record as well.

(snips)
Vuksinick was a student at Cyprus High School until January, according to Granite District spokesman Ben Horsley. Records indicate he transferred to another district within Utah, school officials said. They later received a request for his transcripts from Provo Canyon School, which describes itself on its Web site as a "residential treatment center for troubled teens." It provides mental health care, substance abuse treatment, recreation therapy and other services.

Cyprus High School principal John Welburn said Vuksinick had never come before him for disciplinary action. He said Vuksinick, whose mother works for the Salt Lake Bees baseball team, played on the Cyprus High baseball team his sophomore year.

From the Provo Canyon School Wikipedia page: "Provo Canyon claims a high success rate with behavioral problems "where all else failed." A number of graduates and their families report it helped them. However, a number of former Provo Canyon Students feel they have voiced complaints of inhumane treatment, including physical and psychological abuse."

And from a separate website: "In 1995 David Taylor filed suit and won against Provo Canyon School. Provo Canyon School was found guilty of: “fraud, medical negligence, false imprisonment, breach of fiduciary duty, and gross negligence.” In 1982, Timothy Milonas, Jr. and Kenneth Rice sued Provo Canyon School. Provo Canyon School was found guilty of: “cruel and unusual punishment, antitherapeutic and inhumane treatment, and denial of due process of law.” In each of these cases Robert Crist was listed as a defendant."

I've seen that place, and wondered what it was. Sounds like a wonderful place to be!

DomCasual, Sounds like they are guilty of commiting acts they are supposed treat. I've never heard anything good about that place.

"However, the Salt Lake County Sheriff's Office said Wednesday that the school resource deputy had numerous dealings with Vuksinick, although none of those encounters rose to the level of criminal charges being filed.

A spokeswoman for the Matheson Courthouse said Vuksinick had no criminal history in Utah's 3rd District Juvenile Court." No criminal history.....

That really surprises me.

Husband calls wife's beating death 'senseless'

Updated: 05/28/2009 06:46:05 PM MDT

Fighting tears, the husband of Kimberly Hain on Thursday briefly spoke with reporters about what he called the "senseless" beating death of his wife -- a crime police say was committed by the Hains' 18-year-old neighbor.

Pat Hain thanked police for their investigation and told a crowd his 8-year-old son and 6-year-old daughter are "doing pretty well. What can you expect?"

He spent most of his brief statement addressing his late wife. "Kim, may your light shine down on us always. Protect us on our journeys. Smile on us often so we may see in the fog of our sorrow and direct us back to the light again," he said.

Kimberly Hain, 33, grew up in West Jordan and married her high school sweetheart, who became a nurse. His wife was a certified nursing assistant and working toward a nursing degree at Salt Lake Community College.

Police say Martin Vuksinick entered Hain's home Thursday night through an unlocked door to steal something but ran into Hain and attacked her. In jail documents, police state Vuksinick hit her in the head with his fist, then struck her in the head multiple times with a bat.

Hain's children found her body Friday morning. They waited for their father to come home from a night shift working as a nurse. He called 911, according to police.

Vuksinick allegedly told police he acted alone and led them to the bat, which was in a field near 6000 West and 2700 South. He also claimed to have used cocaine the night of Hain's murder, said West Valley City police Capt. Tom McLachlan.

West Valley City police plan to file their case with prosecutors on Monday, McLachlan said.

Meanwhile, friends of Vuksinick are reflecting on the once-promising athlete whose future crumbled under drug addiction.

"He was a good kid until last year, when he didn't make grades for baseball, and then he started getting into drugs," Bryce Swanson, Vuksinick's former baseball teammate at Cyprus High School, wrote in an e-mail. "He has a lot of potential as a pitcher."

Neighbor Angie Larsen said that Vuksinick was barely the same person as the teen who now claims to have bludgeoned his neighbor to death.
"That's not the kid he was," Larsen said. "He was such an amazing baseball player. He would have had college scholarships."

Larsen said the "neighborhood family" tried to "help him through the drugs." He underwent in-patient treatment for 45 days and was in day treatment after that -- at an expense of thousands of dollars, she said.
"And this is what happened," she said.

Larsen said she has been in regular contact with the Hains and with the Vuksinicks.

"I think if there's anything the [Vuksinicks] would want to get out, it's to make sure kids know [drugs are] not just something you can try," she said.

What a heartbreaking story for all involved.
It certainly is. And now this man has lost his wife and their two special needs children have lost their mother ~ all for what??? Totally senseless and unexcusable. :furious: MOO

They have charged him with murder now....

With an aggravated murder charge, prosecutors have the option of seeking the death penalty if convicted. The district attorney's office has 60 days after arraignment to decide whether they will pursue that sentence. A conviction for aggravated murder also carries a possible sentence of life in prison without the possibility of parole.

"He found Kimberly Hain in her bedroom and struck her several times with the bat," the charges state.

..... ok where would she be during the night?? In her bedroom.....he didn't "run into her"...she didn't "stumble" into him robbing the house. He went into her bedroom with a bat to kill her and maybe rape, ect. MOO

The man who admitted to entering his neighbor's home and bludgoning a woman, Kim Hain, to death with a baseball bat had charges filed against him on Wednesday by the 3rd District Court. Martin Vuksinick, 19, received two first degree felonies and a second degree felony filed by the Salt Lake County District Attorney's office. Vuksinick was charged with Aggravated Murder, Aggravated Burglary, and Obstructing Justice.

If convicted, Vuksinick can face life in prison. The heaviest charge, Aggravated Burglary, can carry a life sentence in itself. Watch FOX 13 News and fox13now.com for the latest on this story.

Has anyone heard anything else about this?

I am still perplexed about the "Why?"

Yes, he was high on coke and we all know that people freaked out on coke can go ballistic with no reason behind it.

But don't you all feel there is more to this story? He has been high on coke before ( so I assume) and he didn't do anything big that was illegal. Why this time?

Why did he go into his mother's best friend's house, while she was in bed, and beat her with a baseball bat?

This story is so tragic. OMG, those poor kids.

One of the worst thing to happen to you is to lose a loved one to murder. One of the second worst things to happen is when you loved on is the killer.

His parents seem responsible. In addition to Kimberly's family this family will be devastated for the rest of their lives.

When people are abusing drugs like cocaine there may not even be an answer to "why" ~ but some little thing we will never figure out could've sent him into a rage, like maybe her waking up while he was in the house to steal money or something to support his habit. :furious: MOO

Thanks Panthera.

You could be right. In this kid's mind he could have been angry at her for something that happened a long time ago and maybe it was nothing to begin with.

Such a waste.
