Utah judge to weigh forced medication in murder trial

A March hearing has been set to argue whether a Utah man accused of kidnapping, raping and killing a 6-year-old West Jordan girl four years ago should be forcibly medicated to make him competent to stand trial.

But a motion filed by prosecutors in October claims that forcing Black to take anti-psychotic medication is necessary for restoring him to competency, is unlikely to have adverse side affects, and that it is improbable that less intrusive alternatives would achieve the same results.

The prosecution's motion quotes a Utah State Hospital doctor, who said that of the patients admitted to the treatment unit of the hospital over the last 16 years, only four have been restored to competency without the use of anti-psychotic medication, and one of those was later returned to the hospital for being incompetent.

A defense attorney Wednesday withdrew his objection in 3rd District Court to the state's motion to forcibly medicate Terry Lee Black. Judge Douglas Hogan is expected to issue an order allowing the Utah State Hospital to administer medication to the 45-year-old man. Hogan earlier found Black incapable of facing the charges against him.

"We have reached an accommodation with the state that if all the parties comply with what needs to be complied with, they will agree not to seek the death penalty should Mr. Black ever be found competent," defense attorney Patrick Corum said after the hearing.

Salt Lake County deputy district attorney Blake Hills told the judge the state would not seek the death penalty if the compromise proceeds as both parties assume it will.

Black has been diagnosed in a mental evaluation with borderline intellectual functioning, as well as a learning disorder, cognitive disorder and psychotic disorder, according to court filings. He has been housed at the state hospital since last June.

"He is incompetent. The state hospital believes that medication will help restore him to competency, and that's where we are," Corum said.

The judge scheduled a review hearing for July 11.

Corum said the case would move quickly to plea negotiations or trial should Black be found competent. A trial date has not been set.

A mentally ill man accused of kidnapping, raping and murdering a 6-year-old girl five years ago is making "reasonable progress" toward being capable of facing the charges in court, according to a report given Tuesday.

While Black could now potentially remain in custody at the state hospital for 18 months before additional action would need to be taken, attorneys on both sides agreed that the case should be reviewed again on Jan. 23, 2018.

At a Thursday review hearing in 3rd District Court, attorneys set another review date for Aug. 21. Judge Douglas Hogan ordered that the defendant remain in the state hospital as officials continue to work to restore his competency.
