“Once they have charged them, they are going to have to, under discovery rules, provide what evidence they have to the defense. What evidence they have that indicates that he committed this murder, months before he ever reported his son missing. I take it that that’s something very powerful and convincing. New court paperwork that was filed earlier this month alleges that Bigsby killed Codi around June 18, 2021, seven months before Bigsby reported Codi missing to police.

But family members say that date doesn’t add up, because they say Codi was alive for months afterward.

“(He was at) my house, I want to say September. I know for a fact that in December, A relative was at his house, and Codi was very well alive,’ said Tandaleyia Butler, Codi’s aunt.

Another relative, Glenn Hinnance says “we can show photos,” but was not able to produce those photos when asked by reporters.

Circuit Court Judge James Hawks granted a competency hearing but the date is pending because schedules for mental health professionals who’ve evaluated Cory Bigsby will have to be coordinated. Hawks said it will likely be in late August.

Commonwealth’s Attorney Anton Bell said that Bigsby purposely defrauded the court by giving the mental health evaluators incorrect information.

Codi Bigsby’s aunt contended Wednesday that her then 3-year-old nephew attended a family gathering at her home months after prosecutors assert the boy was dead.

After a hearing on her brother’s mental competency in Hampton Circuit Court, Cory Bigsby’s sister, Tandaleyia Nicole Butler, told reporters the prosecution’s murder case against her brother — including that Codi was killed in June 2021 — doesn’t add up.

“I know for a fact that’s not possible,” she said of the time frame. “That’s a bald-faced lie.”

Butler, 48, said her brother’s four young sons — including Codi, who was then 3 — attended a gathering “at my house” in the D.C. area in September or October of 2021. The celebration, she said, marked the birthday of her and Cory’s late mother — Codi’s grandmother.

“We have a trampoline, and they were doing what all the kids do, playing,” Butler said of the boys. “And in December, a relative was at his house, and Codi was very much alive.”

Butler said she was looking for pictures of the party at her home that she would send to the Daily Press and The Virginian-Pilot.

Wednesday morning was Bigbsy's first court appearance since he was sent to Eastern State Hospital for mental health treatment. During court, it was decided that another competency hearing will take place after his attorneys challenged a mental evaluation that shows he is competent to stand trial.

Following the hearing for Bigsby's over 30 child neglect and abuse charges, the Hampton father was arraigned on two charges related to Codi's alleged death.

Butler and fellow family members also claimed to have seen photographs of Codi from that time period, but said they could not share the photos with us.

"I'm not able to share them with anyone," said Glenn Hinnant, Cory's uncle.

While they wouldn't share the contents of the letter, they do believe he was coerced by officers to write it.

"They did what they could to coerce a statement from him," said Matheny-Willard.

Bigsby will appear back in court on Wednesday, June 21 for a bond hearing regarding his new murder charges. A date has not yet been set for the mental competency hearing.

Cory Bigsby heads to court for bond hearing, seventh bond request​



Cory Bigsby is charged with the murder of his son Codi. This is the seventh time Bigsby has requested bond after being denied six times since February of last year. His defense claims he is not competent to stand trial.

"We don't believe Codi is dead until we see a dead body," said Cory's uncle, Glenn Hinnant. "That's our belief."

"And my plan as our defense attorney is to find Codi before trial, that's my goal," added Matheny-Willard

Matheny-Willard says Cory will essentially be on house arrest while he stays with his eldest daughter who lives in Norfolk. The judge set the following conditions: Cory cannot leave the City of Norfolk (or the state), he will have electronic monitoring, he has a curfew of 6 p.m. to 8 a.m. and he cannot leave the house except for meetings with doctors and his attorney.

Bigsby will appear back in court on Aug. 25 for a mental competency hearing where the doctors that treated him are expected to testify. If declared competent, Bigsby is expected to stand trial for Codi's murder sometime in October.

What's a 'no body' trial and how does it play a role in Cory Bigsby's case?

"They're not very common, but there are 10 known such cases in the state of Virginia," said Harvey Bryant, former Virginia Beach Commonwealth's Attorney.

Bryant, who previously served as a U.S. Attorney, said because there's no physical body to prove Bigsby is somehow involved in Codi's disappearance, prosecutors will have to rely on circumstantial evidence.

"Well, people ask, circumstantial evidence, what is that? It can be just as powerful as direct evidence," Bryant said. "We base our lives on our actions on circumstantial evidence. We get up in the morning and the streets are wet and our cars are wet. Even though we didn't see it rain, circumstantially, we know it rained."

Here's where it could get more complicated. Depending on the evidence, Bryant said the judge and jury would have to determine what degree of murder Bigsby could face.

"It could be that an accident happened and they have evidence that Cory Bigsby covered it up. That would be involuntary manslaughter. It could have also happened in a fit of rage, which would lead to a more serious murder charge," Bryant explained as he explored all possibilities of what could have happened.

He went on to say, "That's going to be a challenge for the prosecution and for the jury in determining what level of homicide it was. I believe the judge will let the jury have all of those options depending on what the evidence is."

The group, “We are Codi’s Voices,” is hosting a Ride For Justice event for the young boy on July 30 at 11 a.m. The event will begin at the Williamsburg Premium Outlets Mall and will end at the Hampton Soccer Complex, where a fence is dedicated to Codi.

The group organizer, Nancy Strickland, says more than 300 people are scheduled to attend with police escort. She says the ride is about 40 minutes long, but the group says effort is needed to find little Codi.

“We will ride to Codi fence in Hampton. And we will have tents set up we will be serving food. There will be music and just for us to all gather in, say a prayer for Cody. And everybody can get this get this word out that he’s still missing,” Strickland says.

Cory Bigsby could face two separate trials

In a letter to the judge presiding over the case, Bigsby’s lawyer asked the judge to separate the child abuse and neglect charges from the murder charges. She stated that these charges “are two separate cases, and they should be treated as such.”

Bigsby is due back in court on Aug. 25 for another competency hearing. His lawyer stated in the letter she hopes to start the abuse and neglect trial by the end of October and asks for the murder trial to take place early 2024.

Along the ride, the group will stop at the well-known 'Codi fence' located outside of Codi's old home in Hampton off of Old Buckroe Road. That is where Strickland invites community members to come out and support the riders.

"Codi is our baby and we will never give up on him," she said. "And the riders need to be supported as well. So if [people] could come out and have signs and whatnot, that would be wonderful."

The ride will conclude with a cookout at the Retired Armed Forced Club at 398 Union St in Hampton.

"We're doing a big cookout. We're having a slideshow of Codi. We're doing certificates of appreciation," explained Strickland.

The group will also sell t-shirts and collect donations in Codi's name. Strickland says all donations will go directly to the National Center For Missing and Exploited Children and will not go through her.
