WH Criminal Background

And it's a class 6 felony. Which means:
"Another statutory definition (§ 18.2-92) of burglary in Virginia is breaking and entering into a home while someone is inside, either during the day or at night, while also intending to commit a misdemeanor offense other than assault and battery or trespass. This offense is considered less served than the others listed and is classified as a Class 6 Felony. "

So it appears that new charge has same statute as orig 18.2-92. **iirc, Judge threw out because didn't show intent

Wording on "charge" is different. Orig>break and enter of the dwelling house of R.S. while it was occupied with the intent to commit a misc other than assault and battery or trespass https://drive.google.com/file/d/0B6QHkjbC3op6UWJyTDVrdnJfSzg/view?pli=1

No. Last one was a B&E. This one is a statutory burglary charge.

Door was unlocked.

Also states "while also intending to commit a misdemeanor offense other than assault and battery or trespass."

Planting "evidence" maybe? Someone is spilling the the beans.

Same statute number as orig. just wording diff in the Charge field

Except, it wasn't occupied. So, color me completely confused on the new burglary charge.

The dog was there. I guess that counts? Or maybe it means occupied since someone lives there vs being vacant.

I believe I read it meant occupied vs vacant. Actually, I am sure I read that, I just don't remember where.

FYI - This burglary charge was a "direct indictment".

What's the difference between an indictment and a "direct" indictment? (The legalese aspect of these cases is not at all my thang.)

An indictment is an official written instrument submitted by a grand jury to a court, charging a person with the commission of an offense. A direct indictment is one in which the case goes straight to trial, before an inquiry is completed, circumventing the preliminary hearing. These indictments are extraordinary, powerful, and are rarely used.

And more info detailing what circumstances might warrant a direct indictment: http://www.justice.gov.sk.ca/pp-DirectIndictments

Hmm... seems to give legs to my theory that there may be at least one sworn affidavit of personal knowledge of the crime, being the reason for the Capias warrant. If this is the case, I'm going to assume there is likely several of them that all say the same thing. Corroborating statements all pointing to one person.

JMO.

Norfolk Police say the Delaware County, Ohio Prosecuting Attorney’s Office informed them that on July 20, a Grand Jury in Delaware County indicted Wesley Hadsell on two counts of Rape, one count of Kidnapping and one count of Felonious Assault.

These indictments stem from an incident that occurred in Ohio in 2005.

Whatever they can do to keep him locked up!

Still not enough to what he did to that poor girl but I'll take it. I found these items interesting:

Judge Allen sided with Bosse, who declined to comment on the case or Allen’s sentence. She listed 12 crimes Hadsell has been convicted of, which forced him to spend eight years behind bars. Then she noted 16 other times he’d been arrested over the last two decades on charges ranging from arson, rape, obstructing justice and maiming or killing an animal. She noted he wasn’t convicted in those because charges were dropped, dismissed or he was found not guilty.

I don't recall that in all the digging we all did on him. Anyone else?

Hadsell pleaded guilty to the ammunition charge in November 2015 and faces a state charge related to heroin found in his hotel room the following September. Police found it because Hadsell suggested his sister find and get rid of it during a jail phone call. His attorney argued the drugs were found months later in a police search after roughly 20 people had rented the room.

Hmm... I guess the sister did have some curious things to share, after all.

Just punching the dog, that I recall.
