Put simply, a computer or personal electronic device can no longer be viewed as a “thing,” Mr. Justice Thomas Heeney ruled, in rejecting the Crown’s bid to have the laptop’s contents admitted as evidence.
Rather, he said, recent case law holds that because a computer can contain huge amounts of personal information – e-mails, bank records, memos, documents, photos – it should be regarded as a “place,” akin to a house.
In this instance, the warrants targeted two homes and two cars and all were in order as far as they went, the judge found. Nor was anything amiss about how the searches were conducted – up to the point where the various computers were seized.
At that stage, a secondary warrant was needed and, if requested, would likely have been granted, Judge Heeney wrote.
Yet none was obtained, despite the omission being flagged both by the Justice of the Peace who issued the warrants and later by an Ontario Provincial Police forensic detective.

The more I read, the more I think the judge was out of line in a number of his rulings. A lot of these things are about WAY more than his "character" they speak directly to intent.

Also, why wasn't his interrogation part of the trial? TLM's interviews were, and she wasn't even on trial.

matou, I was just thinking the exact same thing. MR's childhood and life leading up to this is still very much a mystery. Will be quite revealing when all of the details come out. Also, just so beyond scary to me that he has gone under the radar all of these years. Makes me feel really creeped out. I think of all of the women he has been with over the years, their children and so forth....well, can't really bring myself to consider what went on, at this point. I am having a hard time believing that Victoria was the first child victim of sexual assault. JMO I am not going to sleep well tonight.

Rafferty jury didn't hear how bad it really was

But among his episodes of Young and Restless, Rafferty left a computer record of frighteningly unhealthy appetites the jury would never know. He liked to visit ogrish.com, a web site with gruesome photos of terrible injuries and death. He Google searched "children for sale"; and looked for images of "naked girl hanged" and "girl beat up."
Between Jan. 25 and April 7, 2009, he was doing Internet searches on "underage rape" and "real underage rape pictures" as well as "necrophilia videos" and "epileptic naked attack" and "real gang rape."
Using the file-sharing LimeWire software, he had downloaded nine movies depicting child *advertiser censored*. One was downloaded just a month before the abduction. It was called, "rape lolita real snuff."
"Based upon the totality of the findings," wrote Det-Sgt K.J. Falconer of the OPP Technological Crime Unit, "the writer is of the opinion that Rafferty had an interest in child *advertiser censored* and utilized the exhibits seized from him to search and download multimedia depicting child *advertiser censored* to those devices ... over a time span of four and a half years,"

This is ridiculous. I am so mad that i can't think straight and all names escape me, but several years ago a little girl in Toronto was kidnapped raped and murdered after she walked her friend home. It was found that the who did that had been watching child *advertiser censored*, was excited, and went outside to grab the first girl he saw.

I'm sure i've read studies that indicate viewing hard core *advertiser censored* is correlated to sexual assaults, too.

So how the <modsnip> is this judge claiming that all this vile, illegal pedophilic activity is simply evidence of MR's character. He doesn't want the jury to think badly of MR? GMAB.

Yes that was Holly Jones, and the same thing in the Somer Thompson case, her murderer had child *advertiser censored* on his computer and he videoed his own neice.

He wrote: “Hey, I’m Mike from Canada, I’m looking for a girl who really wants to move to Canada but needs to get married to do so ... I have a good job and a place of my own ... I am willing to marry someone just so they can move here and obtain a green card.”
At the end of the email, he wrote, “all for a price of course.”
Investigators say he received many replies.
