GUILTY WI - Apple River multiple stabbing; one teen dead, 4 other people hurt; 52 year old man arrested, July 2022

So far his defense seems to be the same as Kyle Rettenhouse. He remembers nothing except being pushed And knocked down. Problem with self defense is he threw the first punch & hit a girl. Thats when the rest of them stepped in. Will be a good trial to follow. The judge is a no nonsense Judge.
 
Nick claimed he had been drinking heavily all day. The girl also said she was drinking.

I live about 5 miles from where it happened. So very sad!!! I was a few blocks away as they were searching for Miu. Somerset is a very small town, alot of Revenue is made from tubers.
That is very sad and I’m sorry this happened at such a popular recreation area. I hope they will be able to sort out what happened, or if Miu just suddenly went off the deep end. Is there much known about the teen who was murdered or the girl who was stabbed?
 

Circuit Court Judge Michael Waterman found probable cause that a felony was committed and set Miu’s arraignment for next Thursday, Sept. 8, where the defendant will be asked to enter a plea of guilty, not guilty or no contest.
 

5 EYEWITNESS NEWS Reporter Eric Chaloux reports that during the hearing, Miu entered a “not guilty” plea to all charges.

Chaloux reports the judge has set a Nov. 1 status hearing to learn how both sides plan to progress with their cases.

During the status conference today, the District Attorney for St. Croix County requested more time to allow the state crime lab to finish testing the suspected murder weapon for DNA. Prosecutors requested 30-60 days for the request, as it takes that long for the results to get delivered.

Miu is currently being held at the St. Croix County Jail on a $1 million cash bond.

Miu will next be in court on Dec. 13 for a status conference.

just an update...
Following an extension to receive testing information from the crime lab granted on Nov. 1, the defense filed a motion to suppress.

Judge Waterman is scheduled to rule on the motion to suppress on Feb. 9.

A judge set Nicolae Miu's trial to begin April 1, 2024. It's expected to last two weeks. The judge also heard testimony on Miu's efforts to suppress statements he made to law enforcement the day of the incident. No decision was made on those motions.
 
Apple River stabbing suspect asks judge to toss out evidence

Nicolae Miu's attorneys are arguing for evidence in the high-profile case to be tossed out.

Miu's motion hearing took place in a packed courtroom as several of the people he's charged with stabbing looked on.

Miu's attorney wants the judge to toss out his police interrogation and other comments made to police because he had asked for an attorney first.

"Nick was transported to another St. Croix County Deputy's squad car," Sheriff Scott Knudson read from a report while testifying. "While being placed in the squad car, Nic asked if there would be an attorney at the jail."

The evidence is important to the state's case, because according to prior testimony, in that interrogation, Miu claimed he didn't bring a knife when he went tubing on the river. That contradicts what his family said, as they told police he brought a knife.

Miu told police he had taken the knife from one of the individuals and waived it at the group before he was attacked.

"I feel good about having a factual and legal basis to make a motion here," Miu's attorney Aaron Nelson said.

Miu is claiming self-defense and Nelson believes the trial will largely come down to how the jury interprets bystander video of the incident.

"There's a video. There may be some contested facts about what happened to begin with. We'll just have to let the video speak for itself," Nelson said.

The judge will decide later whether to toss out this evidence. But he did set a date for the trial. April 1, 2024.

That evidence is important but they have video, wife's statement and all the victim's statement.
