MANITOWOC (WLUK) - The appeal of a teenager convicted of causing the death of his 7-year-old cousin by beating him and stuffing him in a snowbank is now in the hands of the state appeals court.

Damian Hauschultz is appealing his conviction, arguing that due to his age - 14 at the time - he could not voluntarily waive his Miranda rights, and he felt unduly pressured by police to confess.

Prosecutors have opposed the motions. Juvenile justice advocate groups from across the country have joined in Hauschultz's defense.

The latest move in the case came Thursday, when Hauschultz's attorney filed their final reply brief with the appeals court.

The 17-page argument contends the trial court erred in allowing his statements to be used.

His defense team plans to call Damian as a witness, to testify in support of an expected argument that Tim's punishment order did not include causing Ethan's death. However, Damian's attorney will not let him testify while his case remains pending.

At a hearing last week, Manitowoc County Judge Jerilyn Dietz said she anticipates setting a trial date at an Aug. 17 hearing. She noted concerns the case is already five years old, and finding the needed time on the court’s calendar means a trial date may not be available until 2024.

MANITOWOC (WLUK) – Damian Hauschultz’s conviction for the death of his 7-year-old cousin stands, an appeals court ruled Wednesday. The decision clears the way for Tim Hauschultz, Damian’s father, to be tried on felony murder charges for allegedly ordering the punishment which led to the death of Ethan Hauschultz.

Damian Hauschultz, now 20, pleaded guilty to reckless homicide and was sentenced to 20 years in prison, plus 10 years of extended supervision.

Damian Hauschultz's appeal argued because the teen did not feel free to end the questioning by police, his self-incriminatory statements were not voluntarily made, and should not have been allowed as evidence.

In a 28-page decision, the appeals court rejected his arguments.

While Damian Hauschultz’s appeal has been pending for more than two years, his attorneys have said he would not be available to testify at Timothy Hauschultz’s trial, leading to repeated delays in setting a trial date for his father. Currently, Tim Hauschultz is scheduled to stand trial June 18.

So - to keep my notes straight - I shall go ahead & post this for yesterday....

Monday, May 13th:
*Status Conference Hearing (@ 11:45am ET) – WI – Ethan J. Hauschultz (7) (April 20, 2018, Manitowoc; burned & buried in “coffin of snow”) – *Timothy Scott Hauschultz (48/now 53) (great uncle) charged (2/4/19) & arraigned (3/20/19) with first-degree reckless homicide, 3 counts of substantial battery & 3 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-death as a party to a crime, 2 counts of physical abuse of child — intentionally cause bodily harm, intentionally contributing to the delinquency of a child-felony & a misdemeanor battery. Plead not guilty. $100K cash bond. Reduction in bond denied (12/6/21). Bond reduced (3/16/22) to $75K cash. Posted $75K cash bond (6/15/22) with conditions.
Trial was set to begin on 6/18/24 was cancelled with no further dates. There will be 5 alternate jurors.

1/22/24 Update: Motion to modify conditions of bond. Motion hearing on 2/15/24 @ 11am. Change of address notification for Hauschultz.
2/15/24 Update: Video conferencing. Bail/bond hearing with Judge Jerilyn M. Dietz presiding. Defendant Hauschultz appeared by video. Attorney Jacalyn Christie Labre appeared by video for State of Wisconsin. Defense counsel argues bond motion, which would modify bond allowing defendant to have contact with co-defendant Tina Hauschultz. State objects to modification. Court denies modification but would re-visit if provided additional information from the agent in support of this modification. State to draft order.
2/16/24 Docket update: Proposed Order-denying defendant's bond modification. Ordered defendant's motion to modify bond is denied for the reasons stated on the record on 2/15/24 by Judge Jerilyn M. Dietz. Next pretrial conference hearing on 5/30/24 @ 3pm. 3/18/24 Docket update: Letter from attorney Megan Sanders to Judge Dietz. Pretrial hearing on 5/30/24 was cancelled.
4/11/24 Docket update: State's 3rd amended witness list filed. State's Notice of intent of expert testimony. 4/23/24 Update: Status conference hearing on 5/13/24 @ 11:45am & status conference hearing on 6/24/24 @ 11:30am. Looks like trial date of 6/18/24 has been cancelled with no further dates.
Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.
*Tina McKeever-Hauschultz (35/now 41) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision.
*Damian L. Hauschultz
(14/now 20) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). #2022AP000161
