Elisa Baker’s federal drug trial is being postponed until January.
Baker, 43, was indicted by a federal grand jury on May 18 on seven drug charges. According to the indictment, Baker’s illegal drug activity dated from May 2006 to October 2010, and involves Hydrocodone, Oxycodone and Alprazolam. Oxycodone and Hydrocodone are prescription medications used to treat moderate pain. Alprazolam, also known as Xanax, is primarily used for anxiety.

According to the federal court judge, Baker is facing a maximum penalty of 115 years in prison and a $4.2 million fine if convicted on all charges.

Baker’s trial has been continued to Jan. 9, 2012, at 10 a.m., said Carolyn Bouchard, docket clerk for the US Clerk of Court, Statesville district.

She speaks publicly for first time since pleading guilty to killing stepdaughter Zahra.


Elisa Baker, in her first public interview, insisted from jail Friday that she was innocent despite pleading guilty last month to murdering her stepdaughter Zahra.

Baker portrayed herself as a loving stepmother and an unwilling participant in covering up the 10-year-old's mysterious death.

In the jail, Elisa Baker looked down and began to tear up as she recounted her version of events.

The morning after she found Zahra, Baker said Adam Baker took several white trash bags and a small saw from the kitchen.

"Don't come back here," she said he told her. "Stay in the kitchen. Don't pay attention to nothing."
He went into Zahra's bedroom and shut the door, she said. Later, she said, he put filled trash bags in the back of their SUV.

She said she confronted him:
"You need to tell me what you've done with her."

"I had to do what is going to save us both."

Father donates $25,000 to Zahra's playground in honor of daughter

The resemblance between Zahra Clare Baker and Josephine Baker Shuford is uncanny. That’s one of the reasons Josie’s father decided to give $25,000 to the Zahra Baker All-Children’s Playground.

“This gift is in honor of my daughter Josie, and I know the playground will be an extraordinary place where children of all abilities can play, but it is also a reminder to adults how precious all children are and that it is our responsibility to ensure their safety,” Shuford said.

"This is my Christmas project,” Shuford said. “I am glad to do it. I was led to do it. Every child should be happy and safe. Zahra’s story touched my heart.” And he gives thanks for Josie and her two sisters.

Josie is 11 years old and will be 12 next June. Her favorite colors are blue and purple. Purple was one of Zahra's favorite colors, too. Purple is one of the main colors in the playground.

"It is so nice of my dad to do that for me and pretty cool to be a part of a special playground for all kids," said Josie

"Baker pleaded not guilty to the charges in hearing in June. Baker’s trial was postponed in October, following a filing by the attorneys requesting additional time to prepare for trial and interview witnesses.

Baker’s attorney filed documents in December that indicated a deal had been worked out with prosecutors."

Attorney files notice of appeal for sentence; Baker not taken into custody.
