Who made the 2009 copy that Dworkin used for his testimony? Was it him? When was it made? Wouldn't he have known that the DT had turned on the computer? Was he there that day?

I'm not sure who made it, but it was made after the June 2009 meeting when the defense team asked to turn on the computer. It doesn't matter if he knew about that meeting or not (and he probably didn't). What matters is that the defense team knew about it.

Going to the jury not caring, I think we have to view this testimony through the very narrow window the jury is right now. This seems much bigger to us because of its relation to prosecutorial misconduct, Brady violations and all that. But this is the first time the jury is hearing about this. They probably view this as just regular old testimony and evidence, along the same lines as the defense questioning of Horn and Flores in the first trial. In the end, it amounted to nothing. Even the first jury might have found this a little more relevant. This jury knows it's here to decide her fate and there's a good chance this isn't going to do much to help or hurt her. It just makes the DT feel like they've scored some brownie points. They're waiting for the meat.

Thanks AZL. I know the defense didn't ask for the 2008 image until December. But Beth insisted they didn't have to ask. It was the "duty" of the prosecution to turn it over to them at the beginning, therefore creating an appeal issue. I will be so glad when this is over. The legal wrangling wears me down. JA is guilty nd should have been sentenced in 2008. But our system doesn't work that way. Thanks for your answer. Oh and Beth also said Nurmi was one hundred percent correct, that Jodi will never be executed because of the hard drive issue on appeal.

Thanks AZL as you have cleared up a lot. The part I am still a little concerned about regarding the 2 copies is that is a whole year difference. 2008 vs 2009
I always though when prosecution is supposed to turn over "discovery" that they turn over everything. So is it possible that the issue maybe more of the fact they didnt turn it over in 2008 at all? It almost sounds like they werent even going to give the DT a copy of it until they were asked specifically for the computer.
So wondering maybe the issue is more why wasnt it provided during normal discovery turnover?

It is good to know it really doesnt have much difference in contents as far as we know.
I sure hope this Smith fellow isnt going to generate something, but have a bad feeling about what he is going to claim. Misleading or otherwise.

Ryan testified that Jodi told him how she broke into his phone, pretended to be him and sent texts to other girls posing as Travis, she slashed his tires, all four, two nights in a row, and Lisa's tires, she pretended to Travis she had a stalker, hoping he would ask her to move to Arizona. There is no way it would be beyond her to put a virus on his computer on purpose. Her little brother Joey posted on his facebook that Jodi admitted to him the reason she recorded the sex call on May 10th was to send to any future girlfriend of Travis. Think of that, May 10 and she was still at that late date holding out hope she'd wind up with him!

So a little thing slipped by us today, the DT filed another motion to preclude a state's witness and that witness is dr.lovely I mean demarte. That has jodi all over it. She had a real disdain for demarte in the original trial. It is also rumored demarte has had additional time to prepare and is going to really pull no punches this time. If I have it right, the prosecution most likely turned over in written form the email exchanges and other pertinent texts that was on the computer that the prosecution was planning on using in the trial. Nothing else much was important to the prosecutioin case that they found on the computer at the time in 2008. So they only turned over hard copies of the email exchanges, etc.

The prosecution did not give the defense the hard drive because they had already researched it and gave the DT what they were planning to use in trial in text form. And the DT did not request the hard drive image because they did not think they needed anything more either off of the hard drive since the Prosecution was only going to use the texts they had given them.

Enter 2009 and Nurmi coming up with a plan to look for *advertiser censored* on computer. The DT requests to see hard drive and prosecution obliges. They then request image and was provided a 2009 image.
Important Point here: Neither the DT nor the Prosecution thought about the possibility of the images being different. Who woulda thunk.
Plus like was mentioned, the DT knew the existance of the original image if it was in a LE report.

So even if a mistake done at time of image giving, it was a mutual mistake and more importantly, no exculpary evidence hidden anyway between the 2 copies.

So unless Mr. Smith comes up with something he claims is exculpary on the 2008 image , this hopefully will go the way of the child *advertiser censored* has gone. Nowhere.

I throw my 2-cents in, too ... MeeBee, as I understand it, you are correct. Melendez turned over his report (and was subject to a DT interview) about the 2008 image. That report/interview PROBABLY indicated the evidence number of the source drive; a description of the drive; information re: when the image was made; and what type of image (E01) was studied. The DT knew about an image made in 2008, without question.

When the Dworkin image was made in 2009, neither Mesa PD nor the DT expert had any reason to believe an image pulled in 2009 would be different than one made in 2008. The newly minted image was checked against the source drive, and it was a match to the drive as it existed in 2009 (according to Dworkin).

So, was it prosecutorial misconduct that files on the actual drive in evidence were modified during the DT's examination in the summer of 2009? Doesn't sound like it is. Was it prosecutorial misconduct that the PT did not turn over the 2008 image? Probably not. The DT knew it existed; if they wanted to work with the same image Melendez used, they could have asked for it. Now, if they asked for the 2008 image and received, instead, a 2009 image? That’s maybe a bad thing, but only if the Mesa PD or the PT knew the hard drive in evidence had been altered between Image #1 in 2008 and Image #2 in 2009.

But I ask: What conceivable advantage would befall the PT by making a switcheroo? Remember, in 2009 JA was still talking ninja’s, wasn’t she? And didn’t Sue D. Smith-o-nym say the modifications in 2009 did not make substantive changes, or at least none affecting the DT’s *advertiser censored* claims?

I don’t subscribe to BK’s site, so I’m not sure why she (reportedly) says “with holding” the 2008 drive is a big deal. AZL I am not. (Although, when I grow up, I want to BE her … hum … Too late!) But, IMO, this entire Porngate mess is a case of “no intentional harm, no actual harm, and no foul.”

Travis Alexander is not the first man to have sex with a girl from the wrong side of the tracks while he searches for a good girl to marry. After six and a half years, and searching the world over Jodi Arias cannot find ONE person to come into court to say he abused them, OR HER. Jodi was obsessed with Travis. This is HER history. They used each other for sex. Jodi knew he was looking ELSEWHERE for a wife. No secret. It is a tale as old as time, if she couldn't have him, no one else would. She planned and brutally murdered him with no remorse.

#JodiArias no more had PTSD than she was abused, Mormon, a blonde or the least bit sorry.
