Yes, I think that could apply ... if, for example, a person furnished an alibi for someone and knew full well that the someone was not with them at the time when and where they said they were.

The charge brought against [the accused] is that [he/she] assisted [the principal offender] after [he/she] committed the crime of [nature of crime] and gave that assistance with knowledge that [the principal offender] had committed that crime.

I guess the kicker would be whether the alibi-provider knew that the someone had committed the crime. Or if the alibi-provider was covering because the someone had said "I didn't do it, but I can't prove where I was and they will come after me because of that".

Then maybe the alibi-provider might visit a clairvoyant, just to be sure that the someone did not do the crime. Then the alibi-provider could convince his/herself that he/she was not acting as an accessory. :rolleyes:

Gary Jubelin on Ch7 Sunrise again right now. Speaking from the search site, where they are just resuming their work.

"I want to prove conclusively to a court that William's disappearance was not the result of misadventure."

To me, that is a very clear statement. Preparing to charge someone, or haul them before an inquest.

He was asked about the toy. It will be forensically tested.

Brendan Collins has searched in vain. Digging in bushland with a shovel since his release from Silverwater prison 2 weeks ago.

I tried to run away with William when he was 9 months old. We were happy, just him and me until docs took him.

Brendan is living at Marylands Newcastle with his mother Natalie.

I’m clean and off ice - I don’t even smoke cigarettes when I’m stressed anymore. Jail was self inflicted.

William was removed around the age of eight months and placed with the foster care family with whom he was living when he was abducted from a quiet cul-de-sac in the NSW mid north coast town of Kendall, at his foster grandmother’s home.

So Brendan says he was with William for 7 weeks on his own when he was 9 months.
So that kind of clears up - William must have been taken from the foster parents a month after placement.

Hi all. I haven't posted in ages, but have been reading all the great posts. I read an article this morning about the toy being found in bushland, and agree with many previous posts about Jubelin seeming to send some type of message.

"Based on the original search and from our investigation its reasonable to draw conclusion that William's disappearance was result of human intervention and not misadventure," said Detective Jubelin.

"[But] I don't want this interpreted that the investigation is coming to an end," Detective Jubelin said. "We are very mindful that it's over 3.5 years since William disappeared and we haven't solved this matter.

"We are going to continue on until we do."

Someone watching this will be uncomfortable

Under section 316, anyone who knows or believes that a serious indictable offence has been committed and has material information that could assist with the apprehension or prosecution or conviction of the offender must bring that information to the attention of police or another appropriate body.

A serious indictable offence is one that comes with a maximum penalty of 5 years or more ....

The failure to report such an offence, without a reasonable excuse, comes with a maximum penalty of 2 years’ imprisonment."

Thanks for the above info. What about pervert the cause of justice even ? It has long sentence. It also mentions omission ?
ETA - just throwing out option ideas for charges. And curious on thoughts

"It will also make the person police suspect abducted William very, very uncomfortable, Insp Jubelin told A Current Affair on Wednesday night.

He believes William’s abductor has already come under the investigation’s radar, and the new search, combined with the million dollar reward on offer and the intense media interest would mean “the person involved in this, I am certain” would be feeling “a great deal of pressure”.

“And I think the people around that person would be suspicious of their behaviour under pressure.” Insp Jubelin added.

“And we make no excuse for it. I want that person to feel under pressure.”

About 50 specialised officers marched into the scrub about 8am on Thursday, joined by SES and Rural Fire Service members.

Over the next four weeks, police will comb 16 sections of bushland, going sector by sector.

Residents in the quiet Kendall street, where a large police presence and media contingency has set up, are keeping an eye on activity from the verandahs of their homes while getting on with day-to-day life.
Many are reluctant to talk to media.

If William had a toy with him when he was taken would it not have leaked by now? I guess the kidnapper could have used a toy to lure him. I’m trying not to get my hopes raised with the toy it could be unrelated. I wonder where it was located.

William may have had a toy with him at the time of his disappearance but police did not release that information for operational reasons.

What turned up in the first search for a little boy lost. That may not have seemed significant at the time?
Wasn't it said a camp site was found in the bush. Wonder what came of that?
