Trial started 3/18/14, jurors reached a verdict on 4/2/14. Took them 45 minutes to reach guilty verdict; received the death sentence in May, 2014.

9/7/18 Update: Louisiana Supreme Court overturns 1st degree murder conviction & death sentence; his rights were violated when his lawyer conceded at the 2014 trial that Horn killed Justin. In the ruling, the court cited a recent U.S. Supreme Court case McCoy v. Louisiana, overturning a death penalty conviction in Bossier Parish, because defense lawyers infringed their client’s Sixth Amendment right to effective counsel, by admitting their client committed murder and seeking leniency from the jury, when their client objected to the strategy of admitting guilt. Similar to that case, Horn told his lawyers he did not want to concede guilt and admit killing Bloxom at trial. He even filed motions objecting to the legal strategy when his lawyers nonetheless admitted guilt, asking the jury to spare Horn’s life and not sentence him to death.
12/6/18 Update: DeSoto Parish ADA Lee Hall asked the court to immediately appoint Horn’s new counsel over the objection of the State Public Defender’s Board, which claims no qualified attorneys are currently available, due to a lack of funding and a shortage of certified death penalty counsel in the state. According to newly filed court records, Horn is now third on the state’s list of death penalty defendants to be assigned counsel. 42nd Judicial Circuit Judge Amy Burford-McCartney declined to appoint Horn new representation during Thursday’s proceeding. A new hearing has been set for Friday, January 11 at 9:30 a.m., to take up the matter further.
 
Can someone tell me what this article says - maybe give a 10% synopsis on it. All I can read is:

"For example, (appellate attorneys) completely re-investigate everything. If the cops take an audio/videotape statement from a witness, they can't look at it and go, 'Oh crap. This is what that witness says,'” Holland said. “They have to go and re-interview the witness. If we do DNA testing, it doesn't matter what the state police crime lab does. They're going to get stuff and retest it."

An example of that is in DeSoto Parish, where Brian Horn was convicted five years ago of killing 12-year-old Justin Bloxom. Horn is now getting a new trial, for which the judge gave Horn’s CDP attorneys two years to prepare. The attorneys plan to start from scratch and interview all of the witnesses again.

Holland said it’s causing an unnecessary delay,which just adds to the emotional strain for the Bloxom family.

The guidelines and contracts also set case limits for the attorneys. According to a contract for one of the CDP law firms, an attorney can handle no more than three to five cases at a time. The guidelines further require that each capital case have at least two defense attorneys.

Prosecutors have filed an amended bill of indictment.... still charges ... Horn with first-degree murder. But it states he did so while attempting to carry out a second-degree kidnapping....original indictment included .... aggravated kidnapping.

Horn pleaded not guilty...

.....Prosecutors and defense.... agreed jury ...will come from another jurisdiction.

McCartney ....has...contacted East Baton Rouge Parish and ...other jurisdictions. She gave both sides 15 days to offer other suggestions.

Horn’s defense ... filed a motion seeking to re-litigate the entire case. McCartney....denied their request.....gave....attorneys until July 1 to decide if they will appeal.... .... set an Aug. 1 date .....for the next status hearing.

6/15/19 Update: Pros have filed an amended bill of indictment. Horn with 1st degree murder, while attempting to carry out a 2nd degree kidnapping; original indictment included aggravated kidnapping. Horn plead not guilty. Pros & defense agree jury will come from another jurisdiction. Judge McCartney gave both sides 15 days to offer suggestions. Defense filed a motion seeking to re-litigate the entire case. Judge McCartney denied their request. Gave attorneys until 7/1 to decide if they will appeal. Set Aug. 1 date for next status hearing.
