Perhaps waiting to apply this - because it was already a capital crime since she kidnapped the baby, but maybe because there's evidence that HB "willingly" entered the car, the capital circumstance of murder in the commission of the felony of kidnapping would be more difficult to get a conviction on. Good work, if so.

Magen Fieramusca charged with capital murder over Heidi Broussard's death
Magen Fieramusca was indicted on a charge of capital murder by terror threat on Tuesday in connection with the death of Austin woman Heidi Broussard.

Fieramusca was also indicted on a charge of kidnapping in relation to the alleged abduction of Broussard’s newborn baby.

According to the indictment, on or about the day of Dec. 12, 2019, in the course of kidnapping Broussard and Margot, Fieramusca asphyxiated Broussard, intentionally causing her death.
