Support For Badger Family Remains Strong As Stamford Authorities Consider Charges

He may announce his decision within days, but some close to the case expect him to take months."

I guess we will find out what this means one of this days. I don't doubt they could charge him with something if they wanted to. The question is-do they want to?
 
Lawyer: Officials destroyed fire evidence

A lawyer for the father of three young girls killed in a Shippan Avenue house fire in December plans to accuse city officials of intentionally destroying evidence when they demolished the home a day after the fatal inferno.

According to a notice of intent filed with the Stamford town clerk Friday, Matthew Badger's attorney said he plans to sue the city and officials for negligence by ordering the demolition of the 3,350-square-foot house, in addition to a litany of other allegations.

The attorney said city officials allowed the home to become a "plain fire hazard" prior to the blaze by failing to properly inspect ongoing renovations at the house, by issuing the wrong permits for the renovations and by failing to require the proper licenses from Michael Borcina, the contractor overseeing work at the house.

Cohen said there was no proof to arrest anyone on arson, criminally negligent homicide or reckless burning charges.

He added that "there is insufficient evidence to establish that either Mrs. Badger or Mr. Borcina were aware of and consciously disregarded a risk that there was a possible live ember in the ash that could result in a catastrophic fire."

Probably didn't help the case that the house was completely demolished so soon after the fire, however, I disagree that Mr. Borcina was unaware of the risks of his actions causing a fire.

Well I am not surprised. They rarely charge people in this type of cases. Although I am not sure how difficult it is to figure out that ashes can start fire if not properly discarded. And it was a very bad move to demolish the house before any proper investigation of the fire could be carried out. We all knew that at the time.
 
I am not so sure the city had anything to do with this fire . I could see the father suing the contractor that emptied hot ashes in a bag. So sad.
 
I read the Hartford Courant article on her Today Show appearance. It was the first I learned that she witnessed her boyfriend stick his hands in the bag of ashes and pat down to make sure the ashes were actually out. Such a heartbreaking tragedy. I do think she has grounds for the suit against the city of Stamford if she is correct that they didn't notify her in advance of the house being demolished.

There are rules for proper ash disposal. Ashes should be in a metal container with a lid, and for optimal safety water should be put onto the ashes. Ashes should not be emptied into a bag (whether hand was stuck into this bag or not).

"Keep in mind that fires are still started this way, but too often it's an accidental fire. Never empty ashes into a paper or plastic bag, cardboard box, or other similar container. The only suitable means for ash storage is a metal container with a tight fitting lid; this helps keep air from blowing through and disturbing ashes which can leave hot coals exposed for reignition. Many home fires begin from improperly stored ashes while the home's occupants are asleep, as the evening breeze intensifies."

While I am sure you are trying to be helpful, I never said I agreed or approved of her boyfriend's ash removal method so please don't imply that I did so. I mentioned a detail I hadn't read before - that is all.

I didn't imply anything. I wanted to point out that sticking a hand in a bag of ashes is not a proper method of ash disposal. The mother appears to be going through a denial stage since she doesn't appear to think that this method of ash disposal actually caused this fire.
I have no idea why the house was demolished so quickly but what I don't understand is why that is grounds for lawsuit, since the deed was already done by then.
