Penalty Phase #12

Most of her immediate family are in court today, yet none of them are going to speak on her behalf? I don't get it....

This is one of the few days the majority of her family is there, yes? I only recall seeing her brother a couple of other times, along with her dad.

I find this highly suspect.

IMO.

Uh oh, if you won't let us off the case, we're taking our bat, and our ball and we're going home! (ie, won't call witnesses)

This might be grounds later for incompetent counsel on appeal?
In a fair world it would be cause for CONTEMPT OF COURT. Brewer was still a witness. If he in fact wasn't there today, it certainly is becoming a very stinky bucket of red herrings the DT is tossing at the court.

They are doing this to deliberately give her ineffective counsel so she will get a new trial on appeal, right?

That's what I think. If not for their legal status (jobs), they would have picked up their briefcases and walked out. However, the judge would have held them in contempt I believe for abandoning their client.

I really won't be surprised if JSS will adjourn for the day because KN says his client isn't ready/willing to take the stand and needs more time. Just another stall because he didn't get the mistrial he so desperately wanted.

In the thread "Sidebar #4," someone asked, "What is the role of the mitigation specialist?" From http://www.arizonamitigation.com/what-is-a-mitigation-specialist/

"The Role of a Mitigation Specialist

A mitigation specialist is an expert qualified by knowledge, skill, experience, and training as a criminal justice, mental health, or sociology professional. The role of a mitigation specialist is to present mitigating circumstances and factors to all players within the criminal justice system (prosecutors/probation officers/judges/jurors) in an effort to persuade all relevant parties that this particular individual’s case merits special consideration."

I hope this helps answer the posters question from the above noted thread.

Can someone explain this to me?

Now the Defense is saying (at least that's what it sounded like to me) because the Court does not grant our motion to mistrial, we're not going to call any witnesses.
But there were supposed to be more witnesses than just that one woman who withdrew from testifying, right?

So won't they hurt their client's case if they don't call anyone else now? Or does that mean the other witnesses withdrew, as well?

I'm confused, because while I didn't always agree with their tactics, to me it always seemed like the Defense was trying to get the most out of it for their client, working with what little they had, and this move now seems like a child stomping their foot to me - like, you know, you didn't do what we wanted, so now we're not going to proceed accordingly. Which I don't even think this actually is, I'm just stumped as to what else it could be.

I'm sure I'm simply missing the legal/ trial-related background to this, so if someone could give me a quick explanation, that would be great.

Because they couldn't call Womack since she was all part of this GREAT puzzle of Jodi's life, they are saying that there is no reason to call any witnesses at all. They are taking their ball and going home.

Denied..
Move to withdraw
Denied

Defense will not call witnesses

Will Jodi be testifying?
Approch?

I wonder if Nurmi and Wilmontt will stage a Walk OUT!

MAYBE Jodi doesn't want anyone to speak for her? I can't think of anything else that will keep the defense team from calling witnesses. WTH is going on?

YUP, our KCL is in there....

That has been my suspicion for quite some time now. Create a self-fulfilling prophesy. The DT does things on purpose so they can later claim it was wrong to do that.

I think the #jodiarias defense strategy is to just keep stalling until #jodiarias dies of natural causes.
