UPDATE: DNA becomes focus of Kenneth Roth trial

(Sent from The Repository) https://t.co/zyuY1FNeEA

Testimony has not started yet in the murder trial of Kenneth Roth. The prosecution is expected to call a sheriff's investigator to testify.

Stark County Sheriff's Office Major C.J. Stantz is testifying in the Kenneth Roth aggravated murder trial. https://t.co/CPXMtcXF9U

The prosecution is playing a video of a sheriff's department interview with Kenneth Roth in 2013.

C.J. Stantz of the sheriff's department testified that Roth had been identified in 2009 as a suspect in the death of Linda Smith.

In a 2013 interview with Ken Roth, Sgt. Stantz asks Roth why he killed Linda Smith. Stantz noted technological advances in evidence.

Sheriff's investigator told Roth in 2013 interview that people had seen his vehicle at Linda E. Smith's home on the day she was killed.

CANTON The fate of Kenneth A. Roth will hinge on two primary areas of evidence: DNA linking him to the strangulation death of a 61-year-old Osnaburg Township woman and his whereabouts the day she was killed.

After the Stark County Prosecutor's Office rested its case Wednesday afternoon, Kenneth Frame, an attorney with the Stark County Public Defender's Office, told Judge Kristin Farmer the case against his client was so weak that Farmer should acquit Roth without sending the case to a jury for a verdict. Frame cited a standard rule in Ohio law that is rarely granted.

Frame said the prosecution has only shown it's "possible" that Roth's DNA is present on the underwear that investigators say was used to kill Linda E. Van Voorhis Smith at her Orchard View Drive SE home on Dec. 9, 2009. Roth is charged with aggravated murder.

Farmer denied the request after Dennis Barr, assistant Stark County prosecutor, argued the case should be decided by jurors.

"There is evidence to show that that Mr. Roth was present in the home," he said. "There's evidence to show it could be his DNA; he cannot be excluded as the contributor to the DNA on the underwear.

"There's been evidence presented to this jury from which they can make reasonable and logical inferences that prove this case beyond a reasonable doubt," the assistant prosecutor added.

Barr and the public defender's office will revisit those points in greater detail Thursday during closing arguments. Roth did not testify before the defense rested its case.

The day of the murder

The prosecution and defense each called one witness Wednesday. Stark County Sheriff's Office Major C.J. Stantz testified about a video interview with Roth that was played in court. The interview occurred while Roth was in the Harrison County jail in an unrelated case. Stantz was a sergeant at the time of the interview.

CANTON Kenneth Roth has been found guilty of the 2009 murder of a 61-year-old nurse.

Roth, 67, was a handyman for Linda E. Van Voorhis Smith when he strangled her with her underwear at her house in Osnaburg Township, according to county prosecutors. He was arrested last spring after authorities discovered male-specific DNA evidence, not commonly used in criminal trials.

I'm still alive folks! In fact, for the first time in nearly ten years...I'm not afraid anymore. I've been alternating between periods of crying jags and moments of insane smiling all day. I can breathe. I may be able to sleep tonight. Maybe even the whole night through. I may even be fired from my job for missing this week of work but...somehow, I know I'll figure it out.
Spending this week with Linda's family has been amazing. They are all such wonderful and good people. Each one made sure to hug me, thank me and pray for me and my family. Getting thanks from the prosecutor and arresting officer was surreal. They didn't forget. They are still hoping for a breakthrough in the other cases. We are surely not done fighting for the other victims' families.
He was sentenced to life with no possibility of parole. He will not be getting out. There will be no other women in danger from this man.
Thank you! Thank you for helping. Thank you for your hours of time and thank you for your ears to listen.
The dates given in this thread are very much off as we now know. The first murder did occur in 1985 (Kay Gulosh). The Fulton Rd murder did not occur until 1991. Her name was not Dot as I thought it was. Her daughter has contacted me and, as is natural and expected, she is very shook up by the recent events. I will not push her for information. If she feels she wants to share it with me then that's fine. I'm here to help any of the victims' families. Especially now that I know that my family and I are safe.
The prosecutor told me that he wanted nothing more than to prosecute him on all of these murders. They're all connected. But, as he said, "We usually only get the dumb ones. We finally got a very very smart one." Hopefully, as time passes, more technology will come into play. Technology that Ken never would've dreamed of in the 80's and early 90's.

We just did a podcast on four unsolved rape/murders in Akron in 1987, some of whom are listed on this thread. It's shocking to see how many potential victims could be out there. Give a listen if you like: Ohio Mysteries, available on most popular podcast platforms. You can also find a direct link, photos, newspaper clippings and other material at our website, Home. Thanks for keeping these names in the public while their killers are sought!

I feel badly for all the families of the four murdered women because the crimes have gone unsolved. I feel particularly bad for Barbara Blatnik's family, since she probably wasn't murdered in Summit County and her killer would most likely be found among people she interacted with in Cuyahoga County on the night of her death. On a cold, wintry night, her friends wouldn't have driven such a long distance out into the remote countryside before taking her home. She most likely met her killer at or near the party she attended in Garfield Heights that night. Summit County LE wouldn't have taken a lot of time to travel all the way up there to question her friends. They should have invited Cuyahoga County LE to work on the case with them.

I wonder if they retrieved DNA from Barbara, since she was the victim of a sexual assault. Maybe we should make a separate thread for these women.

Looks like AG Mike DeWine said he was going to do something about Barbara's case back in 2013, but hasn't yet.

30 Dec 2013, Page A001 - The Akron Beacon Journal at Newspapers.com

He should test all the evidence of these crimes for DNA, then run the results through CODIS and elsewhere to see if there's a match. Send the samples to Parabon, check familial DNA databases.

I tried to set up individual cases for all of these women here - none of the four have pages - but I apparently haven't made enough posts to be eligible to create threads. If you want to set them up, I can go in and link our podcast pages with info. Hopefully I'll qualify for post creation soon :)

I'm working on another project tonight, but will certainly try to get something started this week.

I happened upon this thread by accident and have to admit when I first started reading it, it sounded really far fetched, like something out of a thriller novel (sorry).
Just wanted to say well done to you and tour husband on your bravery and compassion for his victims, I don’t think I would have been as brave if it were me in your position. This has amazed me, truely and well done to the people on here for taking you seriously and helping you.
I hope you can find peace in your lives now and hopefully put it behind you. I hope your husband will get the help he needs to overcome what he witnessed also. You are amazing.

Langley, who was not Craig Smith’s daughter, said recently from her Mississippi home that authorities had determined that her mother was killed on a Wednesday, either in the late afternoon or early evening.

Langley recalled being at church in December 2009, singing as she practiced for a performance, when “around 4:30 p.m., all of a sudden I could just feel her presence. The sun was starting to go down, the rays of sun were coming in through the stained-glass windows. ... It was one of those ‘awe’ moments.” It made her think of her mother, who always had encouraged her most in music.

On the way home from church, she called her mother. No one answered, and Langley thought little of it.

If Smith's daughter's instincts are correct, her mother was killed around the same time of day as Kay Gulosh. Just thought that was interesting to note.
Stark prosecutor: DNA key to solving 2009 murder case

By Ed Balint
CantonRep.com staff writer

CANTON The trial of a man accused of killing a 61-year-old Osnaburg Township woman starts today in Stark County Common Pleas Court.
