GUILTY Canada - Taliyah Marsman, 5, & Sara Baillie, 34, Calgary, 11 July 2016 #2

Yes you’re right, the quote from the trial is below. That’s really disturbing, how those early media stories seem to have been totally inaccurate.
....
Prosecutor Carla MacPhail asked if Baillie had ever expressed her views on escorting. AB said "she would never do it."...”

Who knows... maybe we will hear more as the trial progresses.. in this early article it states that the 'escorting' by SB had been confirmed by police.

"according to Baillie’s friend — and confirmed by law enforcement Baillie worked as an escort prior to her death. The friend suggested that Baillie was concerned about saving money for Taliyah’s future education, and was looking for ways to supplement her $19,000 income."

Well, time will tell I guess. If the defence doesn’t bring that evidence forward, then the media story must just be plain wrong. Another reason I’m sceptical of the media story is because of the prosecution’s opening statement. As the trial proceeds we will learn more, but just because something is printed in the media doesn’t make it true, particularly since the source of information was not named.

Today’s trial highlights below. Downey’s cellphone data led LE to Taliyah, initially they’d really hoped she’d be found alive. Even though this is a horror trial given the actions of the accused imo, I think CPS’s efforts were extremely thorough and commendable beginning with the welfare check and throughout the entire investigation. It can’t be easy for officers involved to be witness to such disturbing death scenes. I suppose their only solice is a conviction and knowing at least they’ve provided some answers to family and friends.

Kevin Martin reported on Twitter:

“There was a significant amount of blood,” Const. Chiasson says, adding the hamper Sara Baillie was stuffed in was saturated.”

I don’t mean to be gruesome but why would there be so much blood if she was strangled? It’s hard to piece it all together from reading tweets.

I am surprised this trial is not getting more attention, it doesn’t seem like the reporters are even there all day some days. I believe it was mentioned either in the opening statement or by the initial responding officer that testified, Sara had been badly beaten before being asphyxiated but I can’t find a link. Meg Grant of CBC tweeted that jurors have been forewarned there will be autopsy photos shown in court on Monday. (Twitter)

The #Downey trial has been adjourned for the weekend. Jurors were told they would hear from the medical examiner on Monday and have been warned that they will be viewing autopsy photos

The main events of the trial are featured in Calgary MSM headlines each day. But I think because of the significant depravity involved in both murders, details are being omitted but that’s okay by me. Generally speaking, there’s not a lot of good news stories happening in this province to balance out reading the news. :(

IMO Downey is likely taking advantage of free legal aid to intentionally twist the knife into the hearts of grieving family members who are witness to this unnecessary trial. He should’ve just plead guilty. MOO

Some of today’s testimony, tweets from Global Calgary. Medical examiner... Sara incurred “forceful injuries”, duct tape was wrapped around her head “I think five times”.....

“Court hears Adeagbo autopsy report: Sara Baillie died of neck compression and suffocation...asphyxia -- he classified her death as "homicide"-- death at the hands of someone else #Downey

Fatal injuries of mother and daughter detailed in double murder trial of Edward Downey
WARNING: Details in this article are graphic and may be disturbing to some readers. Discretion advised.

“Family members of Sara Baillie and her five-year-old daughter Taliyah Marsman broke down as details of the injuries they suffered were detailed in court by an expert forensic pathologist....

.....Adeagbo told court Sara died of asphyxia, caused by neck compression and suffocation. Adeagbo described numerous bruises on Sara’s face, caused by “blunt force injury.”

Court heard she suffered trauma to most of her body, including her stomach and back, but noted those weren’t the fatal injuries.

“They are just part of the story,” he said, pointing to the neck injuries as what killed her.....

.......Dr. Adeagbo said Taliyah died from asphyxiation.

Details of her injuries were too much for most family members, and many broke down before leaving the room.

He testified the manner of death was not determined but said it was likely from smothering or strangulation.....”

What happened to poor Sara sounds so extreme and so personal. It took time and intention to inflict these wounds and bind her up.

I feel like the motive of “she told my girlfriend to break up with me” sounds kind of weak. Was there more to it? Does motive matter that much in this case?

"Dr. Adeagbo talks about numerous injuries to Taliyah that were inflicted before she was killed...and also injuries after she was killed including an abrasion on her back that could have been from moving her body over brush or twigs."

I want to put my fist through the computer monitor.

I know how you feel. It sure is a disturbing trial, just reading the daily highlights. How awful it must be for family members there to support the victims, even for the jurors, reporters, and court personnel to have to sit through this just because Downey has the right to a fair trial.

I get the feeling Downey’s only defence might be, even though evidence connects him to both the victims, he didn’t directly cause their deaths. That will never fly as neither had any chance whatsoever of surviving regardless if he left them alive to suffer. That makes it even worse imo. :(

Pure evil. My heart breaks for all involved. I don't know how Colin Marsman restrains himself from attacking that monster.

Also consider this: Taliyah had blueberries in her stomach. They ceased a box of blueberries from Downey's home. To me it seems as though he brought those blueberries to Sara's house knowing Taliyah was there - he went there with every intention of not only murdering Sara, but little Taliyah as well. He knew Taliyah and knew she'd be there. He planned her murder just as much as he planned Sara's. And he brought the blueberries to somehow pacify her or coax her before he drove her away to slaughter her. And he hurt her before he killed her.

Absolutely pure evil.

Today’s court highlights include a woman who testified she contacted LE after the news of Downey’s arrest because between July 10th and 12th she was texting with him and his texts were “flirtatious in nature”. (alleged murders occurred July 11th). A friend was trying to get them together - some friend - although she doesn’t say why she was introduced to him. But considering the earlier testimony of his girlfriend AP, one could make a good guess why he was looking for a replacement :(

And during their opening statements, the prosecution mentioned Downey’s cellphone evidence would be introduced, from the Blackberry he had when he was arrested on July 13th.

“.....From that information, (Patricia Pace on behalf of CPS) she said that five areas of interest were identified through the records:

  • Sara Baillie’s home in Panorama Hills
  • where Baillie’s vehicle found
  • the daycare that Taliyah attended
  • Edward Downey’s home
  • the rural location where Taliyah’s body was found (Township Road 250)
Pace said that on July 11, between 4:24 and 4:40 p.m., there was quite a bit of activity on Downey’s cell phone, particularly in the area of cell phone towers near where Taliyah’s body was found.

As a result, Pace produced a map that was used to help investigators locate the young girl’s body...”

I agree, the graphic details do not need more exposure. I was thinking of the contrast of the coverage of this trial with that of the Garland trial. Maybe the impact of that trial was significant enough to change how child murders are reported on.

Downey is a monster. :(

Absolutely disgusting....
however the fact that he carried his cellphone with him, maybe to ensure he could stay in contact with this new opportunity was also his downfall. Excellent work by the CPS employee who was able to track his route and identify a search area so precisely.

More here:
Calgary police employee describes Downey's phone records at murder trial
“Multiple messages were exchanged between Edwards’ phone and Sorochan around 4:30 p.m. on July 11, which Pace said used cellphone towers just east of the site where Marsman’s body was recovered, and another near Chestermere Lake.

That evening, court heard, Edwards told Sorochan in a text that his current relationship was failing.

“My thing ain’t working and I think it won’t last so I’m testing what’s out there for me and you seem like a go green light,” he texted her...”

In court today testimony regarding insect evidence associated with human remains and time of death..

And this. If it’s the best Downey’s defence lawyer has to attempt to create doubt, what’s the point given the presence of his car spotted on surveillance when Talitah was taken, plus his clients fingerprints are apparently on the duct tape wrapped around Sara’s head, who was beaten and then stuffed in a laundry hamper? That his client, the alleged killer, would’ve taken her cellphone and maybe even faked her calling on it so it appeared she was still alive on the 12th doesn’t require a huge stretch of imagination —

“During cross-examination, defence lawyer Gavin Wolch asked Pace about Baillie’s cellphone.

Earlier, court heard that phone was found under a tree in a northwest Calgary park in the evening of July 12, 2016.

Pace confirmed there was internet usage and “short code messages” associated to the phone the day after Baillie was found dead in her basement suite.

Pace explained short code messages are five digits long and are usually connected to subscriptions, appointment reminders or marketing messages.

Pace told court she is not able to tell if the activity on July 12 was user-generated or consisted of automated messages to and from the phone.

Pace has been stood down as a witness, and told she will need to return for further testimony on Monday.”

Thank you so much for the trial updates! Wow! I had no idea there was so much damning evidence in Sara's and Taliyah's murders. If this isn't an open and shut case then I don't know what is. Downey needs to go away for a long, long time - what a cold-blooded killer!!

Sounds like a good candidate for consecutive sentencing.

You’re welcome. Yes, it’s a horrifying yet open and shut case IMO as well so for the sake of the two victims who no longer have a voice, I think this animal deserves as much negative exposure as possible.
