The preliminary hearing in the case against Paul and Ruben Flores is set to begin in San Luis Obispo County Superior Court next week.

The preliminary hearing is expected to be lengthy, lasting up to three weeks. Preliminary hearings typically last one to two hours.

On Monday, evidence and witness testimonies in the 25-year-old Kristin Smart case will be presented in court for a highly-anticipated preliminary hearing.

A preliminary hearing allows the court to examine evidence and determine if there is enough evidence for a trial.
 
Monday, August 2nd:
*Preliminary Hearing for both (@ 8:30am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing) – *Paul Ruben Flores (19 @ time of crime/44) arrested & charged (4/13/21) & arraigned (4/15/21) with 1st degree murder. Plead not guilty. No bond.
*Ruben Ricardo Flores (55 @ time of crime/80) arrested & charged (4/13/21) & arraigned (4/15/21) with accessory to murder after the fact. Plead not guilty. $250K bond. Bond was lower to $50K. Has posted bond (4/22/21), out of jail.

7/12/21 Update: Pre-Preliminary hearing in the case against Paul & Ruben Flores took place Monday morning via Zoom. Ruben was not in attendance & was represented by his attorney. The defense discussed subpoenas for two witnesses called for the evidence hearing set to begin next Tuesday, July 20. The judge indicated while there will be a one-week break, that hearing could last through Aug. 20. Multiple witnesses are expected to take the stand & discovery in the case revealed. A motion hearing in the case is scheduled for Wednesday, July 14, at San Luis Obispo County Superior Court. It will be the first time all parties involved in the case appear in person before the judge since the arrests. An amended complaint was filed in court last week by the prosecution. Court officials say the defense has filed opposition to the amendment, but due to the documents being sealed, it’s unclear what in the charging documents has changed. Preliminary hearing on 7/20/21 will take place in the courtroom & will probably take a month thru 8/20.
7/14/21 Update: Another pre-preliminary hearing & the second to discuss a motion to amend charges against Paul. Prosecutors are looking to file rape charges against Paul Flores from cases out of L.A. in addition to the murder charge. San Luis Obispo Superior Court Judge Craig van Rooyen on Wednesday ruled to unseal the court records in the Smart murder case related to the San Luis Obispo County District Attorney’s Office’s amended complaint. In court, prosecutor motioned to add two counts of rape of an intoxicated person against Paul. Stems from two alleged rapes in LA County. Judge denied the requested addition of the two rapes of an intoxicated person charges from LA, calling the evidence of rape in the Smart case “weak” & saying the LA evidence would prejudice a jury in the SLO case. Susan Flores did not take the stand & her opposition to her subpoena will be taken up before the preliminary hearing. Preliminary hearing has also been continued to Aug. 2 & will probably take 3 weeks to complete. Traces of human blood were found in a patch of disturbed soil beneath Ruben Flores' house, newly unsealed records. An archaeologist told investigators that “someone dug the soil out and put it back.” The evidence — rape *advertiser censored*, homemade videos & so-called “date rape” drugs — support San Luis Obispo County officials’ allegations that Flores has long been a sexual predator. The records also include allegations of sexual misconduct by 30 women, some of whom told investigators they were drugged before they were sexually assaulted by Flores in incidents going back to the late 1990s. It appears nearly 3 dozen women will testify in the case about his alleged predatory history.
7/28/21: Detectives searched Huasna Road today in Arroyo Grande through trees, farmland & trees, but so far, no remains were found.

SAN LUIS OBISPO (CBS13) – Paul Flores, the man charged in the death and disappearance of Kristin Smart, will face a judge Monday in a highly anticipated preliminary hearing where we will hear evidence and witness testimonies.

The beginning of what’s expected to be a historic hearing is set to play out in a San Luis Obispo courtroom.
