Well written motion. Thorough exploration of the Brady ruling and implementation of the rights and tools available to all defendants.

One thing draws my attention in the “preamble”. The topic of a co-defendant. Have I missed something? Someone please enlighten me.
This is most likely not a typo. For it to be in the opening statement of any motion is of significance

The defense for double-murder suspect Coley McCraney filed new motions regarding the case’s evidence Monday.

McCraney was arrested and charged for the 1998 murders of J.B. Beasley and Tracie Hawlett as well as J.B.’s alleged rape before her death.

The motions, signed by attorney David Harrison, ask for evidence to be provided to the defense so it can be examined and tested again by appointed experts, satisfying the higher standards capital murder cases have to prove them..

This includes independent testing of the DNA match between McCraney and the DNA evidence found on J.B. Beasley’s body and clothing.

Ok ..... So his attorneys need him to walk them through the crime scene??? The car??? Where it was found (After being moved)?? A different scene? How if he didn't know them? And if it's not his DNA? This whole motion is contradictory if it's as reported.

His Defense team is trying a force play. To have the prosecution commit (and thus limit to an extent) to the sequence of what their the timeline and locus of the crime. Also, it locks in how the prosecution would/can do if during the trial phase if they should want to take the jury on crime scene visitation.

It’s both a discovery technique and a force play. If there are any chess players in our audience it is similar in theory to a technique known as “castling”.

McCraney will likely go on trial in 2020 for teens murders and the rape of Ms. Beasley. If convicted, he could be sentenced to death.

An October 7 hearing on the request has been set in Dale County Circuit Court.

Is he an educated man? Just curious given what he/we now know given the DNA evidence that has come out. I'd love to hear an alternate theory that is stronger than the DNA evidence.

If you are referring to Lanier Beasley (J.B.'s father), I'm not certain of his education level, but he has suffered more than any human being ever should have to suffer. He had 3 daughters and has had to bury all three of them. As a parent, that would have to be the worst pain ever and I am sure it has had a devastating effect on him.

It appears he is being advised by a former Ozark PD Police Officer. He (the former police officer) had a theory that J.B. & Tracie were killed by Ozark Police Officers who were involved in a drug smuggling operation. According to his theory, J.B. & Tracie were killed because they somehow had information on this illegal operation. There is no evidence of any of this, just one guy's theory that sadly Mr. Beasley has bought into.

I will add this...Please do not judge Mr. Beasley too harshly. As I mentioned before, he has suffered more than any human should ever have to suffer. All of this must have had a devastating effect on him.

Thanks, that makes sense. He isn't the first family member to be led astray or to believe in an unlikely conspiracy story. Sometimes that is easier to take than the (likely) reality. Kind of similar to Johnny Gosch's mom. Didn't she believe for years (maybe she still does) that he was sold into some kind of sex trafficking ring and is still alive? Anyway, good words about Mr. Beasley. Nobody should have to go through that, but I hope that when all the evidence is laid out on the table and the dust has settled that he finally has a true picture of what happened to his daughter and can finally get some closure.

I think his attorneys will advise him against testifying as most attorneys do. But, I think it will come down to how McCraney sees the trial going. If the Prosecution's case is going badly and made to look weak, he will not testify. On the other hand, if sees a strong case against him and feels testifying will be the only way he can win, then he will probably do it.

The semen found on and in J.B. will be damning and I am certain his attorney has told him that. It really won't shock me me if sometime before or during the trial, he comes forward and says he and J.B. had some sort of romance and had consensual sex the night of the murders. He originally told the investigators that he did not know either of the girls. So, he will have to explain that, also.

All of the above is MOO.

I agree that they will probably try to explain the DNA by saying McCraney had a relationship with J.B. The families have been through so much. I hate to think that in an effort to save himself, he will try to besmirch J.B.’s memory.

Well spoken TedMac. I discount the theory on that (as presented) at face value. After all, the reality is that you cannot have your cake and eat it also.
Meaning that OPD could not be the case bungling, constitution violating keystone cops that some purport and also be a key player in a here to be discovered drug smuggling (et. Al) criminal enterprise. The solidly proven facts of consistency prove that well.

Yes, Mr. Beasley is most likely being misled, probably even played. A sad situation that has not seen its twilight yet.
