No, and I believe that's the reason they want the coroner to determine if the baby took a breath. My guess is they are doing this because if there is no breath, then there is no murder charge.

I could be wrong though. I tried briefly to google it and could not find anything.

I do wonder if she thought the baby would be ok though after 30 weeks? It’s hard to know. She is not bright though so that’s why I’m wondering what her true intention was - but I think you are probably right.

Ahhh, thanks - I don't understand US laws at all - there's so much of it, then there's state and federal laws - it's confusing.
Really hope that someone is held responsible for the murder of Valkry, because that is what it was.
If they couldn't charge for murder am guessing they can't charge for abduction/kidnapping her then? Cos they did that too in my non legal eyes

I was just thinking about this and wondered if maybe the state could charge her with Valkrie's murder and the Feds do Ashley's.

I'm also not sure if it's a requirement that the Feds charge and try the case or if it could be kicked back to one of the states.

According to Goodwin, Amber allegedly had the placenta in her pants when EMS showed up, causing Jamie to think she had the baby.

WTF. This crime was already horrible enough but that is truly disgusting.

Taylor Parker did the same thing with Reagan Hancock's placenta. There are quite a few similarities in the cases which makes me wonder if Amber has been keeping up with Taylor Parker's trial.

So she refused medical treatment. While the baby was taken to the funeral home, she handed over the placenta.

According to Goodwin, the Benton County Coroner arrived after the memorial service to take the baby for an autopsy. Goodwin says the Waterman’s demeanor changed when they found out an autopsy would be performed, and Amber allegedly asked multiple times if DNA tests would be performed. He says as soon as Jamie heard that, he “got up and ran out of funeral home.”

“Hands down craziest things I have ever dealt with as a coroner for 16 years," Goodwin said.

Goodwin says the Watermans had named the baby Dakota.

Ya I bet he did run. They both are being charged. There's more to him than being an accessory after the fact.

There is a 2004 federal law about feticide but after reading it twice over I still do not understand it. Article isn't great (disclaimer, it is Wikipedia) and a large part of it discusses Roe which is definitely outdated now.

Thanks @SimplyCass I found another document but it's more about neonaticide; when a mother kills her newborn.


Whew, what a mess. I'm still shaking my head about her putting the placenta in her underpants. WTF
