Casey Anthony attorney withdraws venue motion after secret meeting
Judge denies Casey Anthony's defense team motion to exclude George and Cindy Anthony from courtroom at the upcoming murder trial.

George and Cindy Anthony will be allowed to attend their daughter's first-degree murder trial, beginning with jury selection in an unknown county Monday, Chief Judge Belvin Perry ruled this afternoon. The defense wanted to keep them out, stating that Casey Anthony's right to a fair trial could be affected because her parents are also witnesses in the case.


Anthony's attorney, Jose Baez, withdrew his motion opposing the venue change.

Details about why he filed or withdrew the motion were not made public because it is under seal.

The appeals court returned their opinion late Friday afternoon regarding jury selection in the Casey Anthony case, essentially stating that the court has the right to withhold disclosure of the location in the interest of providing Casey Anthony a fair trial.

The affect of this order is that all media outlets will be informed by the court at the same time and this will not force a delay, and the trial will commence as scheduled Monday morning.

ORANGE COUNTY, Fla. -- The search for the 12 jurors and 8 alternates who will sit in Central Florida's highest profile murder trial in decades is set to begin in Pinellas County, WFTV learned Monday. The jury selection location will be in Clearwater. Chief Judge Belvin Perry kept the location secret until early Monday morning.

Testimony about the air samples taken from Casey Anthony's car that showed signs consistent with decomposition will be allowed to be presented by the prosecution in her upcoming first-degree murder trial, Orange-Osceola Chief Judge Belvin Perry ruled today.

In his order, Perry noted that the state asserts that the determination of the admissibility of expert opinion isn't whether or not the opinion itself is one that would be generally accepted.

"The analysis focuses instead on whether the opinion is based up[on] data gathered using generally accepted methods and interpreted using generally accepted scientific principles applied to a generally accepted body of scientific knowledge," Perry wrote, summarizing the state's argument.

Anthony's defense team objected to Perry's ruling this morning, raising the issue before jury selection began in a Pinellas County courtroom.
Perry told Baez he should have handled things ahead of time and raised the issue much earlier in the process, instead of objected at the "ninth-hour."

Casey Rejects Plea Deal On Day 1 Of Jury Selection

Casey couldn't hold back her tears Monday Judge Perry read the charges against her during jury selection for her high-profile murder trial on Monday in Clearwater.
When Judge Perry told prospective jurors that she is charged with first-degree murder and faces the death penalty, Casey broke down and shook her head "no."
Prosecutors complained to the judge about Casey's crying. The judge told the group of 120 to ignore Casey's emotions.

WFTV reporter Kathi Belich was told that the whole thing could have been avoided Monday because there was discussion of a possible plea deal, but Casey said no. She would have had to admit to every detail of Caylee's murder.

Baez objected to the first panel of about 100 people in its entirety, saying that it wasn't representative of Orlando's demographics because it had only two Hispanic and four African-American jurors.

49 Potential Jurors Dismissed On Day 2 Of Casey Trial

Judge Belvin Perry ended jury selection early and dismissed the 49 potential jurors because someone was talking about the case while inside the jury room on Tuesday.

Everything has been pushed back another day in the already difficult process of picking a jury of people who will be willing to devote 6 to 8 weeks of their lives to the trial.

Perry began Tuesday's proceedings in Pinellas County by calling people from the original panel of about 110 potential jurors brought in Monday. Perry got through that initial pool early in the afternoon and then brought in an additional 50 prospective jurors.
One excused potential juror said no one had any idea they'd be called for the Casey Anthony murder trial, so just about everyone was talking about it.


After jury selection ended, Perry immediately began hearing more on a defense motion about air tests.

He said they would discuss this matter on Fri morning @ 8a.m.

Perry admitted that the process was running behind schedule.

Perry said he ordered a new set of jurors for both Wednesday and Thursday morning.

As long as progress was being made in selecting a jury, the process could continue Saturday and Monday, Perry said.

If Perry is unable to seat a jury in Pinellas County, he has indicated he may return to Orange County to select jurors.

Casey Cries, Has Pain, Potential Juror Fined

Casey cried for the second time since her trial started, and then a potential juror was held in contempt for trying to talk about the case to a reporter, Casey then cried again, and later was escorted out of the courtroom by officers- she had some sort of pain in her hand or wrist.

Wednesday's jury selection ran late, because Judge Perry decided to question the remaining 40 potential jurors. It wrapped up at 7:08pm.

Judge Perry said jury selection will resume at 8:30am on Thursday.

In an attempt to find more minorities, the defense accepted Perry's offer to pull jury pool members from a nearby homeless shelter.

"I'm told it has a high concentration of ethnic population," the judge said.

Perry said the court would need to verify driver's license information for those at the shelter.
 
Defense Lists Reasons Why Casey Shouldn't Get Death

ORANGE COUNTY, Fla. -- The jury hasn't even been seated yet in Pinellas County, but already in court on Thursday, Casey Anthony's defense team revealed a list of reasons why Casey should not be put to death if she's found guilty.

There are 68 finalists for the jury. Attorneys started interviewing them early Thursday morning, and at about 4:30pm, they were only on the third one.
Late Thursday afternoon, Judge Perry sent 32 potential jurors home and asked them to come back on Friday, because the process was taking so long.

The defense said it's planning to blame Casey's family if she is convicted of murdering her daughter, Caylee.

The excuses they plan to use to convince the jury is Casey's lack of maturity, no impulse control, they said she has a history of sex abuse, insomnia, nightmares, no parental guidance or protection, verbal and emotional abuse as a child and poor coping skills.

ORANGE COUNTY, Fla. -- On day five of Casey Anthony's murder trial, defense attorneys dismissed a man on Friday from a pool of potential jurors after they claimed he misled them about a prior arrest.

The first African-American man in this phase was called and made it through, even though he said he was against the death penalty. WFTV jury expert Randy Fisher said he is the best juror, so far, for the defense.
The state didn't eliminate him, even though he's against the death penalty, to cut off the defense argument that there isn't enough minority representation in the group.

The state did try to eliminate an African-American woman who said she couldn't judge people, but Judge Perry didn't allow it.

PINELLAS COUNTY, Fla. -- Ten prospective jurors were dismissed on day six of the murder trial.

The judge retained four people on Saturday. Since the jury selection began on Monday, a total of 12 possible jurors, six men and six women, have been retained.

Casey started her day with six people saying they believe she murdered her daughter.

Among the 12 possible jurors, one is against the death penalty, one knows nothing about the case, and another has been a juror before.

17 Chosen Potential Casey Jurors May Not Last

PINELLAS COUNTY, Fla. -- Seventeen potential jurors have been approved on day seven of Casey Anthony's murder trial on Monday in Pinellas County. However, they may not last.

They need a total of 20 to cover the jury and the alternates.

As of late Monday afternoon, the potential panel was predominantly white, with two African-Americans. There were 10 men and 7 women. Their ages ranged from 20s to 60s, with the majority being in their 40s.

Their occupations included chef, secretary, insurance, counselor, nurse and nursing student, IT tech, auto mechanic, student, retiree, truck driver, and even a delivery manager for the St. Petersburg Times.

Tuesday afternoon, the court picked 12 potential jurors for the second time in the day. "We will proceed to swear them," Perry said.
Perry got up, and the defense paused waiting for the state to challenge. It didn't, so defense attorney Jose Baez used a challenge and knocked it back to 11.

Baez complained the judge is preventing Casey from hearing from everyone before deciding who she wants on her jury.

Tuesday evening, lawyers questioned the last potential juror of the day. After a 10 minute break to discuss her, the defense challenged that potential juror, using another strike.

Judge Perry called recess for the day at about 6:50pm. The court will resume at 8:30am on Wednesday, where another small set of potential jurors will be questioned.

PINELLAS COUNTY, Fla. -- Casey Anthony's murder trial came to a sudden stop on Wednesday. Judge Belvin Perry unexpectedly dismissed court after returning from an extended lunch recess on day 9 of Casey's murder trial.

"Mr. Mason, have you had an opportunity to discuss the matter with Ms. Anthony?" Perry asked.
"I have, Your Honor," Mason said.
"Anything you need to add?" Perry asked. "OK, this court will be in recess until 8:30 tomorrow morning."

In Session's Beth Karas received a text from defense attorney Jose Baez, saying, "Today's adjournment was due to a private matter. Please stop the speculation, as jury selection will continue at 830 am tomorrow morning. No further statements will be made."

The defense began on Wednesday, objecting to the court's procedure of jury selection. The defense filed an oral motion against Perry's court procedure. However, Perry said the court has to balance the interest of jurors with Casey's right to a fair trial.

After 20 minutes of arguments from the defense, Perry denied it.

Judge Plans To Swear In Casey Jury On Friday

PINELLAS COUNTY, Fla. -- A jury may finally be sworn in on Friday for Casey Anthony's murder trial. However, it may not be the jury that her defense team was hoping for.

Thursday marked the tenth day of jury selection. Currently, there are 16 jurors that are still on the panel, 9 women and 7 men.

Less than a third of the new panel of 30 brought in on Thursday for alternates have survived the hardship issue.

Not one of the 160 people called for jury duty for the Casey Anthony murder case has said he or she believes that Casey's innocent.

Prosecutors said they plan to use photos, video and audio in their opening statement, which could include party pictures of Casey, video of Caylee and Casey's mother's 911 call.

Casey Anthony Back In Orange County Jail

ORANGE COUNTY, Fla. -- Casey Anthony was booked back into the Orange County jail on Saturday after being in Pinellas County for jury selection for almost two weeks.Casey will be in the jail until she is brought to the Orange County courthouse Tuesday morning for the opening statements and start of testimony in her murder trial.In Pinellas County 17 jurors, including 5 alternates, were sworn in on Friday and will most likely be transported to Orange County at some point Monday.Opening statements in the trial are set to begin 9:00 Tuesday morning and can be seen live on WFTV.com.
