‘The man who lured, raped and murdered outback nurse Gayle Woodford has lost his bid to have his jail sentence reduced.’

‘Davey lodged an appeal against his sentence arguing it was manifestly excessive and he should have been given a greater discount for his guilty pleas.

The timing of Davey's pleas entitled him to a potential discount of up to 30 per cent under South Australian legislation.

But the sentencing judge said applying the maximum discount would be inappropriate and disproportionate to the seriousness of the offending.

The prosecution argued the appeal should not be granted because the community needed to be protected from Davey who had shown no remorse or insight into his behaviour and needed to be punished.

Chief Justice Chris Kourakis and Justice Timothy Stanley and Martin Hinton, were unanimous in their decision.

In the Chief Justice's written reasons, agreed by the other justices, he said a substantial prison term was warranted.‘

‘A law named for murdered nurse Gayle Woodford has passed South Australia's Parliament, meaning health workers will no longer be permitted to work alone in remote areas.’

’Gayle's Law means single-nurse postings in remote areas will be abolished and call-outs will require two health practitioners.

SA Health Minister Peter Malinauskas today paid tribute to Mr Woodford in Parliament.

"It takes a particular degree of courage and source of strength to be able to pick oneself up after such a devastating incident as what was imposed upon the Woodford family," he said.

“There are often moments of tragedy in our society but rarely do they translate into a suite of legislative reform that will protect so many people for so many years to come."

The law passed the Legislative Council with one minor amendment, and was signed off by the Lower House shortly afterwards.’

The family of murdered outback nurse Gayle Woodford say they were left feeling "angry" and "insulted" by SafeWork SA's finding that her death was not work-related.
Gayle Woodford had been a remote area nurse with Nganampa Health Council, based in the small APY Lands community of Fregon, for almost five years before she was killed.
She was on call on the night when she was lured out of her home and raped and murdered by Dudley Davey, who is now serving life with a non-parole period of 32 years.
Now her family has revealed SafeWorkSA, the body responsible for regulating workplace health and safety across the state, determined her death was not linked to the night-time on-call work she was tasked with.

In a letter to husband Keith Woodford, dated November 25, 2016, SafeWork SA said it had completed its investigation and sent its findings to the Coroner's office that, "the death of your wife was not work-related".

SafeWork SA is now reviewing the decision after questions from Australian Story.
Gayle Woodford's daughter, Alison Woodford, was perplexed by the decision.
"I was really angry. I felt insulted," she said.

‘In a stunning about-face, South Australia's health and safety regulator has reclassified nurse Gayle Woodford's death as work-related and reopened its investigation.

A SafeWork SA spokesperson said executive director Martyn Campbell met with the family of the murdered outback nurse late last week to discuss the findings of his review into the agency's handling of the matter, and to apologise to the family for the error.

Husband Keith Woodford said he had mixed feelings over the latest decision.

"At least somebody from that department is taking time to care was the main thing," he said.

"He seemed genuine to me."

Gayle Woodford's legacy

The SafeWork SA spokesperson said the review found that, based on the evidence available at the time, SafeWork SA should have concluded Mrs Woodford's death was work-related.

The agency said it is also reopening the investigation as a result of new information.‘

Gayle’s and all who follow her work should be treated as gold and should never work alone but in pairs.
Like our ambos in the suburbs need protection so should our outback nurses.

Two years ago outback nurse Gayle Woodford was abducted and murdered in the APY Lands in South Australia’s north.

Gayle’s sister, Andrea Hannemann, and the rest of her family are still fighting for safer working conditions for remote and regional nurses and health workers.

Mrs Hannemann said it was important to her family that all nurses and health workers had a safe place to work.

“It must never happen again; we never want another family to go through the pain and trauma we have,” she said.

Gayle’s Law, abolishing single nurse postings in remote and rural areas, passed the South Australian parliament in November 2017, but it only covers the state-funded Oodnadatta and Leigh Creek areas, not the APY Lands.

“The family want Gayle’s Law to be recognised by every state government and federally across Australia,” Mrs Hannemann said.

“Every workplace across Australia should be safe.

“It is the responsibility of our government to ensure laws are in place to guarantee workers’ safety.

“Gayle’s Law will ensure higher levels of safety for health workers across Australia.

”
Mrs Woodford’s family is asking for everyone concerned with the conditions in these remote and rural areas to contact their local federal member to more pressure on the federal government to pass the law.

Mrs Hannemann said Nganampa Health Council in the APY Lands had made changes to the protocols and procedures for nurses, despite Worksafe SA initially finding Mrs Woodford’s death was not work related.

“Worksafe SA made its decision from a round table in an office in a city without visiting Gayle’s workplace to do an investigation,” she said.

“The decision was an insult to Gayle and her work ethic and left the family in further anguish.”

Worksafe SA apologised to Mrs Woodford’s family for its decision on the eve of the second anniversary of her death and acknowledged her death was in fact a workplace incident. It has reopened the investigation into her death.


“The family welcome the apology and look forward to a thorough investigation into Gayle’s workplace and all other similar workplaces across Australia.”

Inquest opens into SA nurse's brutal outback rape and murder


Dudley Davey subsequently pleaded guilty to her rape and murder and is serving a minimum 32-year jail term.

It's believed Davey had tricked Ms Woodford into opening a security cage around her home and overpowered her as she walked to her ambulance.
Opening an inquest into the death today, counsel assisting, Ahura Kalali, said a "catalogue of blunders" occurred in the lead-up.
He said Davey should have qualified for ANCOR, the national child offender register, which would have allowed police to monitor and share information about registered offenders.
The court heard a failure to comply with ANCOR reporting obligations could have landed Davey back in court prior to Ms Woodford's murder
Inquest opens into SA nurse's brutal rape and murder
 
SafeWork SA has now made the decision to not prosecute Ms Woodford's employer, the Nganampa Health Council.
"We were gutted, absolutely gutted. We feel like we just don't know where to turn to," Ms Woodford's husband, Keith, said.
SafeWork SA said a team completed a 12-month investigation to determine whether the health service should be pursued for any breaches of the Workplace Health and Safety Act.

 
"Having thoroughly investigated the matter and assessed all the evidence with the Crown Solicitor's Office and after receiving advice from senior counsel, SafeWork SA determined that there was no reasonable prospect of conviction," it said in a statement on Thursday.
"Public servants operate under the prosecution guidelines of the Director of Public Prosecutions, which provides criteria for laying charges against breaches of law.
"One criterion is that charges cannot be laid if there is no reasonable prospect of success at trial.
"This was the circumstances in this matter."
