"The Crown's theory doesn't make any sense, ladies and gentlemen," Dungey says. Crown's theory is they planned to steal a truck and kill for over a year. "That theory is nonsense."
by Adam Carter 9:56 AM

The only evidence that we have is evidence of planning to steal a truck, Dungey says. "What would be the motive for this? That was never shown to us."
by Adam Carter 9:57 AM

Dungey says we will never know what went wrong.

Bull Excrement!!
Eliminator is huge evidence, blood on, remains inside, pre-purchased and planned use of prior to murder, hiding receipt.
How did the Eliminator assist in the stealing of a truck exactly???

"My client was not in the truck. He can't tell you what happened."
by Adam Carter 9:57 AM

"All we know is that a man was killed for a truck for no reason."
by Adam Carter 9:58 AM

What else could it be other than something "overcoming" Millard, Dungey says.
by Adam Carter 9:58 AM

"Mistreatment of society, his mistreatment for people ... this millionaire who had it all, who would just go on a binge and do what he felt like," Dungey says about Millard.
by Adam Carter 9:59 AM

"There is no motive. People do things for a reason."
by Adam Carter 9:59 AM

"It doesn't make any sense. Period." Dungey says.

Thrill. Stealing a floor polisher, trees. No sense, just the thrill of it. Real World Grand Theft Auto game.

"If it was a thrill killing, they could have gone out and kill anybody. If it was just to kill, why didn't they kill Igor?"
by Adam Carter 10:00 AM

Dungey says it's "nonsense" that they didn't kill Igor Tumanenko because he was a big guy with army experience. He says the intention was to "scope" a truck, not to kill.
by Adam Carter 10:01 AM

It doesn't make sense, "unless something happened to Mr. Millard in that truck," Dungey says.
by Adam Carter 10:02 AM

"We know what Mr. Smich was going to get out of this ... he was going to be paid. He was going to get a couple of hundred dollars for helping to steal a truck." He calls the Cadillac theory a "red herring."
by Adam Carter 10:03 AM

Dungey points out how there was no violence in any previous thefts.
by Adam Carter 10:04 AM

"The only planning was to scope and assist in the planning of stealing a truck," Dungey says. "A truck Mr. Millard wanted."
by Adam Carter 10:05 AM

Dungey says Millard had assets, yet paid Smich "pennies."
by Adam Carter 10:05 AM

"He's no boy scout. No altar boy. But he is not guilty of murder. He's a small-time dope dealer ... there's no reason for him to commit murder."
by Adam Carter 10:06 AM

"The Crown's theory, with all due respect, has huge holes in it," Dungey says. He says it's based on "suggestions."

Except for the "goes well , be an all-nighter."

Crown's theory is that Bosma was shot in the field near his home. "That's a suggestion. That's all that is. No evidence."
by Adam Carter 10:08 AM

"Suggestions are not evidence," Dungey says. "You are not to decide this case on suggestions."
by Adam Carter 10:09 AM

"Where they got this theory from we will never know, because they called no evidence to support that theory."
by Adam Carter 10:09 AM

by Adam Carter 10:07 AM

Of course the Crown's theory has holes in it. They can only guess at what happened based on what evidence hadn't yet been destroyed. Only MS and DM could have said what really happened, and both chose to spin out fairytales.

Dungey points out only three people were there - but Bosma is dead, and Millard didn't testify.
by Adam Carter 10:09 AM

"They went thoroughly through the field ... they had dogs, they looked at it microscopically. The result? No evidence. None."
by Adam Carter 10:11 AM

"In the dark, and yet no evidence?" Dungey says there would have been blood, DNA, gunshot residue.
by Adam Carter 10:12 AM

There would have been blood/GSR in the Yukon too, Dungey says. "Did they find any in the Yukon? No."
by Adam Carter 10:12 AM

"Surely they would have dropped something, sure;y there'd be some glass from the window being shot ... but there's nothing found. Not a trace."
by Adam Carter 10:13 AM

"How could that be? Two fumbling amateurs? These aren't hitmen!" Dungey booms. "Give me a break."
by Adam Carter 10:14 AM

The last point about not transferring blood to the Yukon is something I was having trouble with too.

by Adam Carter 10:14 AM

Dungey's been doing his WS homework.

Dungey says a millionaire and a pot dealer wouldn't have been able to pull off a gangland style execution and not leave evidence.
by Adam Carter 10:15 AM

Dungey says that Bullman or his dog would have noticed a shot around that time too, when they were out for a walk.
by Adam Carter 10:15 AM

Dungey also says Sharlene Bosma would have heard a shot, too.
by Adam Carter 10:16 AM

by Adam Carter 10:09 AM

Of everything that has been presented, this is where I get stuck, but the Crown is adamant that this is where it happened. I wonder if they will elaborate or make a further point on this in their closing submission?

"They didn't hear any shot. Folks, it just didn't happen."
by Adam Carter 10:16 AM

Dungey says jury needs to "put aside" Crown's theory.
by Adam Carter 10:17 AM

Dungey also talking about Bullman testifying that he didn't see any vehicle marks deep in the field.
by Adam Carter 10:18 AM

I think the Crown's fatal flaw is their theory that the shot was taken in that field.

Not hearing the shot in the field doesn't really bother me, but the lack of evidence transfer to the Yukon does.
