Last year, Harvey Weinstein was found guilty by a Los Angeles jury — though in a mixed verdict, jurors could not reach a unanimous decision on all counts, with the judge declaring a mistrial on three of seven charges.

On Tuesday, the judge dismissed those three remaining charges, and ruled that she would not be putting Weinstein back on trial.

Prior to the judge’s decision, the prosecution announced the Los Angeles District Attorney’s office would not be proceeding with the remaining charges.

Weinstein was sentenced last month to 16 additional years for his most recent conviction in L.A. He is already serving a 23-year sentence for his 2020 rape and sexual assault conviction in New York, and will all-but-likely spend the rest of his life behind bars. He is appealing both of his convictions.

For the duration and preparation of his Los Angeles trial, Weinstein was extradited to the west coast and has been in L.A. County Jail. Now that he’s been convicted and all charges have been settled, he will return to prison in upstate New York to finish the remainder of his 23-year sentence on the east coast, which he began serving in March 2020. The judge ordered Weinstein to serve his 23-year sentence and 16-year L.A. sentence consecutively. On Tuesday, the judge announced that Weinstein will be sent back to New York imminently, but did not give an exact date for him to be moved out of L.A.

Nearly four years after Harvey Weinstein was convicted of rape and sent to prison, New York’s highest court will hear arguments Wednesday in his quest to overturn the landmark #MeToo-era verdict.

Weinstein’s lawyers are asking the state’s Court of Appeals in Albany to dismiss the disgraced movie mogul’s 2020 conviction, arguing the judge trampled his right to a fair trial by “succumbing to the pressure” of America’s reckoning with sexual misconduct perpetrated by powerful figures.

The judge, James Burke, allowed testimony from three women whose allegations weren’t part of the case and ruled that prosecutors could confront Weinstein about other, unrelated misbehavior if he had testified, which he declined to do.

NEW YORK (AP) — Nearly four years after Harvey Weinstein was convicted of rape and sent to prison, New York’s highest court appeared torn at oral arguments Wednesday about potentially overturning the landmark #MeToo-era verdict.,..

Weinstein, 71, was convicted of a criminal sex act for forcibly performing oral sex on a TV and film production assistant in 2006 and rape in the third degree for an attack on an aspiring actress in 2013.
He was sentenced to 23 years in prison. Last year, he was convicted in Los Angeles of another rape and sentenced to an additional 16 years in prison.

If the Court of Appeals were to rule in Weinstein’s favor, he would remain locked up because of his California conviction. Weinstein did not attend the arguments but was said to be monitoring a livestream from the state prison where he is incarcerated, Mohawk Correctional Facility, about 100 miles (160 kilometers) northwest of Albany.

The Manhattan district attorney's office said it will retry Weinstein should the alleged victims be willing to come forward again.

"We will do everything in our power to retry this case, and remain steadfast in our commitment to survivors of sexual assault," a spokeswoman for Manhattan District Attorney Alvin Bragg said in a statement.

Weinstein was also convicted of sex offenses in Los Angeles and sentenced to 16 years in prison there.

Because Weinstein is already convicted in California, he will not be released, but instead transferred to the custody of prison authorities in California.
 
I wonder who pays to have him moved back and forth from California to New York for court hearing and such.

Although maybe it cost less to fly him around on Con Air than pay for room and board to house him in a New York prison until his is retried.

I believe that HW will not be transported back and forth between CA and New York if he has a new trial in NY. What will happen is HW will be housed in NY for the duration of his trial. Likely in a NYC jail near the courthouse....2 Cents

“Thankfully it will not impact California prosecutions of child molesters or serial rapists,” he said. “Thirty years ago California addressed this very issue when it passed a law that specifically allows ‘bad acts’ testimony to show propensity to commit sexual assault.”

Gov. Gavin Newsom, whose wife, Jennifer Siebel Newsom, testified at the Los Angeles trial that Weinstein raped her in 2005, said Thursday that Weinstein “should never see the light of day. Period. Full stop.”
“Let’s just make something crystal clear: Harvey Weinstein is a stone-cold predator, a rapist, twice convicted. Not once. Twice,” Newsom said during a news conference on renewable energy at a solar installation outside Winters, a farm town near Sacramento
